MAY 26, 1992
A regular meeting of the Coastal Zone Management Commission (CZMC) was
held on Tuesday, May 26, 1992 in Conference Room A at the Town Center,
740 West Boston Post Road, Mamaroneck, New York. The meeting commenced
at 8:05 p.m.

Kluge Property, Premium Point - At last month's CZMC meeting, it was
decided that there was insufficient information on this referral for CZMC
to make a judgment regarding its consistency. A letter dated May 1, 1992
was sent to Building Inspector William Jakubowski stating that additional
information was needed under the following headings:
1. Site Plan indicating roof drainage plan, amount and placement of
fill indicating contours,
2. Landscape Plan,
3. Erosion and Sediment Control Plan during construction, and
4. A written statement by the designer of the septic system
clarifying the necessity for applying for a Small Sewage
Disposal System permit from the Westchester County Department of
Health, Division of Environmental Quality pursuant to its
regulations.

There seem to be conflicting opinions from the County Department of
Health as to whether a Small Sewage Disposal System permit is necessary.
Mrs. Wittner read various communications between the County Health
Department and Mr. Kluge's agents and Dr. Leaf. Dr. Leaf, who was
present at the meeting, contested the varying opinions sent from the
County to both he and Mr. Kluge's agents. He also questioned the
existing system since he was informed it is an ancillary system to the
pool. Mr. Mastromonaco replied they have pictures of the existing septic
system. Dr. Mason requested wing them but they were not available at
the meeting.
Mrs. Wittner also read communications between Mr. Mastromonaco and Town
Building Inspector William Jakubowski. Mr. Jakubowski requested
clarification of the County's position on the septic system and stated
that in response to Mr. Mastromonaco's inquiry of May 13, 1992 regarding
whether Mr. Kluge's application must return to the CZMC, they must
continue with CZMC until a consistency opinion is rendered. The CZMC
will notify Mr. Jakubowski of their opinion before any permits are
issued. Mrs. Wittner stated she received a letter dated 5/4/92 from Mr.
Burnham, Dr. Leaf's attorney, explaining Dr. Leaf's perspective in this
entire matter. Dr. Leaf commented at the meeting that he was required
to obtain permits for the property, whereas Mr. Kluge had not needed
them.
Mrs. Fredston asked how much fill would be brought to the site. Mr.
Mastromonaco stated that data from the previous subdivision map was used
for the elevation, and that he did not have a figure for the amount of
fill. Dr. Mason pointed out that there are two datum to determine
elevation. He questioned which one was being used. Mr. Mastromonaco
replied he only knew of one. He said the building has been raised to
conform to the flood damage protection law. The top of the sea wall is
about 14 feet and the first floor elevation will be 18 feet. In total,
the two floors are 5,800 square feet. Mrs. Wittner noted that a Flood
Damage Prevention Permit would be required along with a building permit
from the Town but no other permits seem to be required from N.Y. State.
She read a letter dated 12/6/90 which was in response to a request by Dr.
Leaf for a sewer hookup from Premium Point, TOM, to Pryer La. , VOL. Mrs.
Wittner's letter stated that the Department of Environmental Conservation
advised by telephone that a proposed sewer connection would require a
N.Y. State Tidal Wetlands Permit.
As to a landscape plan, Mr. Mastromonaco replied there is no "decorative"
plan other than what exists there now.

Mrs. Wittner asked the Commission for any comments on this application
which she believed now provided the requested information. No comments
were given. She stated that, unless told otherwise by the Commission,
she will mention in her opinion letter to Mr. Jakubowski the past history
on this matter. The letter will be written within two weeks.
APPROVAL OF MINUTES
Minutes: The minutes of April 28, 1992 were approved after minor
changes on page 1 and page 3.
CHAIRMAN'S REPORth
A. Correspondence - Incoming:
1. 4/15/92 - To George Latimer, County Legislator, from County
Executive Andrew O'Rourke regarding the Legislator's letter to
the Acting Commissioner of Planning Lynn Oliva regarding his
support for the establishment of a County Coastal Zone
Management Plan. The Planning Department will commence the
planning stage in the fourth quarter of this year.
B. Correspondence - Outgoing:
1. Mrs. Wittner's response to the Village of Larchmont to their
request for "Larchmont Notes".
2. 5/13/92 Opinion Letter - comments on the DEIS for the DiForio
subdivision.
C. Other:
1. 5/7/92 Joe Morgan to Sanford Bell, TOM Planning Board Chair,
regarding the DiForio property with concern to zero additional
runoff and surface water quality.
2. Letter appointing Elaine Price to two committees, the County
Point Source and Biological Controls Committees.
3. 5/21/92 memo to Chairman and Members of the Town Planning Board
from Steve Altieri Re: refeLrdl of the service business
district zone amendments by CZMC. It was reviewed at the Town
Board Meeting 5/20/92.

MEMBERS' REPORTS
A. Erosion and Sediment Control - Mrs. Wittner read Mr. Martin's
comments which were mostly agreed to by the Commission and noted.
The Commission members gave their comments which were also noted.
Mrs. Wittner said that she gave this "final draft" to Messrs.
Jakubawski, DeVore, Morgan, and Laura Tessier. She will now call all
of them, make all the appropriate changes to the proposed law, and
send it to the Mayor, the Supervisor, and respective Boards.
B. LWRP Supplement - Mrs. Wittner advised that she meet with Steve
Resler and Renee Parsons from the NYS Department of State. She
distributed copies to the Commission of the State's final version of
the LWRP which the members will need for working on the supplement.
Previously they had been using the draft as reference. Mrs. Wittner
said there will be a section in the back of the supplement that will
summarize all that has gone before.
Mrs. Wittner explained that the supplement must go through SEAR with
a public hearing, review by the proper Federal and State agencies,
and a response from CZMC noting any changes.
Mrs. Wittner noted that the Coastal Management Plan, Section 6217, on
"Non-Point Source" will be incorporated into the State's Coastal
Management PLJ Lam and will appear in the LWRP. The main topics CZMC
will be working with are: water quality, watershed planning (being
done by Westchester County and other up-State counties) , habitat, and
intermunicipal cooperation and consistency review, as well as scenic
views.
Shirley Tolley commented that this new document should not be
referred to as a supplement since the LWRP has been approved. Mrs.
Wittner commented that as there are still changes being made, it
should be referred to as an amendment. Ms. Tolley pointed out that
the maps in the document are not accurate, e.g. , the fresh water
wetlands map. She requested that Steve Resler and/or Charles
McCaffrey attend a CZMC meeting to have various questions cleared up
regarding the supplement. Mrs. Wittner said she will ask Mr. Resler
to attend the next meeting if he has something to show the
Commission.
C. Other - Mrs. Wittner showed the Committee a book by the L.I. Sound
Taskforce entitled "Quality Monitoring" which she feels is very good
and quite technical.
