CZMC MINUTES
March 23, 1999
A regular meeting of the Costal Zone Management Commission (CZMC) was held on
March 23, 1999 in Conference Room "A", 740 West Boston Post Road, Mamaroneck,
New York. The meeting was called to order at 8:05 p.m.

1. Approval of Minutes:
- The minutes from 2/23/99 were not discussed at this meeting.
2. Presentation from Actionville Students:
Proposed Improvements at Hommocks Conservation Area
- The Actionville students read the report that had been submitted to the CZMC
regarding their proposed improvements at Hommocks Conservation Area.
- A discussion ensued and the Commission commented that the students had some
very good ideas and stated that the Hommocks Conservation Area would certainly
benefit from increased attention. The Commission asked the students which ideas
they felt the strongest about.
- The students stated that they would like to pursue the interpretive trail markers and
the addition of signage.
- The Commission stated that these are both good ideas and the students should work
on the specifics for these projects.
- Kate Honeywell and the Actionville students will be working in cooperation with
James Athey to organize their ideas and to come up with detailed plans for their
projects and for the Arbor Day celebration.
3. Discussion of East Creek Restoration Project
- Immediately preceding this meeting, Rob Doescher, Michael Petti and Sven Hoeger
presented the proposed tidal gate in East Creek to allow for stream bank stabilization
in East Creek.
- R. Doscher stated that the tide gate is not designed to be a sediment trap, however it
may be a good idea to install some type of sediment trapping feature. The primary
drawback of this feature would be future maintenance issues. Mr. Doscher also
stated that the way the tidal gate is designed, the brackish water from Long Island
Sound would not be permitted to rise into East Creek during high tide, however
sediment and water would flush through the gate during storm events.
- The Commission asked if consideration had been given to expanding the scope of
the project to also encompass storm water quality issues.
- R. Doscher stated that this project is one of many projects that were identified
through the WAC studies and although this section of East Creek is not particularly

large, it is part of a cumulative effort that should have a positive effect on water
quality. The changes proposed for East Creek (plantings, stabilization, etc.) will
help to trap pollutants and act as a biofilter before polluted water can flow out to
Long Island Sound. He continued by stating that, unfortunately, there is not a
monitoring project proposed with these improvements therefore they will be unable
to quantify possible changes in water quality.
- The Commission stated that whether intentional or not, this area will act as a
sediment trap and means of regularly maintaining this area should be considered.
The Commission also stated that perhaps the engineers should investigate the
condition of the pipe that connects LIS to East Creek before proceeding with this
project.
- A discussion ensued and the Commission agreed that without the specific site plans
it is difficult to make a detailed evaluation, however the CZMC agrees that this is a
worthwhile project and it will support the Village of Larchmont's participation and
encourage it to move forward. In addition, the CZMC recommends that some type
of monitoring program be established in order to assess the project's effectiveness.
4. Consistency Referral:
Proposed Construction of Two Single Family Residences
Currently Undeveloped Properties Btwn Marbourne Dr. and Old White Plains Rd.
Block 330 Lot 350.1 and Block 330 Lot 350.2

SECOND REVIEW (first review at the 1/26/99 meeting of the CZMC)
- Al Ragazzimo stated that they are proposing to fill in the drainage trench and use a
french drain-type system to direct the water into two separate banks of six infiltrators
with an overflow device draining to the storm sewer.
- The Commission stated that it is generally pleased with the proposal, however it
does not approve of the overflow to the storm sewer system.
- Joel Negrin distributed a copies of a letter addressed to Jack Pisco to the members of
the Commission. The letter addressed six primary concerns of the surrounding
property owners: 1) debris currently on lot, 2) changes in grading, 3) tree plan filed
with the Planning Board on June 23, 1986, 4) distressed trees, 5) guard rail and 6)
siting of houses.
- A lengthy discussion ensued and the Commission agreed that these six issues do not
fall under the CZMC's review of this matter, and therefore will not be considered in
the CZMC's recommendations for this project. The CZMC will mention these
concerns to the Town of Mamaroneck Building Department so that these issues may
be handled through the appropriate channels.

- A discussion ensued and the Commission agreed that due to the stormwater retention
system proposed on the site plans dated 3/16/99 which indicate that there will be a
"no net increase in runoff' from the proposed site upon completion, it is the opinion
of the CZMC that the proposed site conditions, in terms of drainage, for block 330
lots 350.1 and 350.2 will neither advance nor hinder the policies set forth in the
Local Waterfront Revitalization Plan and accordingly is neither consistent nor
inconsistent therewith. However, the CZMC recommends that 1) an overflow from
the proposed infiltration system to the Town's storm sewer system should not be
permitted and 2) a textual description of the percolation testing including the
location(s) of all percolation testing and information regarding weather conditions
preceding the percolation testing be included with the site plans and runoff
calculations before review by the Town's consulting engineer. In addition, although
the concerns mentioned in the March 23rd letter from Joel Negrin addressed to Jack
Pisco do not fall under the CZMC's review of this matter, the CZMC will note these
concerns in it's letter to the referring agency.
5. Discussion of Proposed Wetlands Law Revision with Steve Coleman
- Stephen Coleman distributed copies of the wetlands law proposal to members of the
CZMC. Coleman reviewed the entire proposal with the Commission and noted
several changes throughout. S. Coleman will incorporate the changes discussed at
this meeting and members of the CZMC will thoroughly read the proposal for a
detailed discussion at the next CZMC meeting. Copies of the proposal, with the
changes discussed at this meeting, will be mailed to all absent members.
- S. Coleman noted that he will begin working with James Athey in the upcoming
weeks on the wetlands map revision.
6. Chairpersons' Reports
- N. Seligson stated that the Village of Larchmont is in the process of making changes
to their zoning law. Madelaine Berg agreed to investigate this matter further on
behalf of the Commission and discuss the proposed changes at the next meeting.
- N. Seligson announced that Ruth Gyure has resigned from the CZMC.
The meeting was adjourned at 11:35 p.m.
The next scheduled CZMC meeting will be held on April 27, 1999.
