The meeting commenced at 8:05 p.m. Members Present: Angel J. Martin, Chairman Lilian Andrews Elinor Fredston C. Alan Mason Howard McMichael Richard Metzner Others Present: John Bartow, NYS Department of State Kevin Carpenter, Supervisor for the Fernandez Premium Point addition Dean Davis, Architect Charles McCaffrey, Jr., NYS Department of State Daniel S. Natchez & Associates, Inc., Environmental Waterfront Design Consulting Company Geoffrey Young, Seacord, Young & Young, Attorney for the Fernandez Premium Point Addition REFERRAL: TOWN ZONING BOARD - FERNANDEZ ADDITIONS, pRaIrm POINT Chairman Martin pointed out that this referral has not yet been referred to CZMC. The applicant asked to see CZMC for the purpose of answering any questions that CZMC might have or to find out if the applicant needs to do any additional work in the hopes of expediting this referral. Mr. Young said they are to appear before the Zoning Board tomorrow evening when the referral will be formally referred to CZMC. The Commission noted that it has 30 days from presentation after the date of referral to respond. Same manbers of CZMC will visit the site on Saturday, March 27 at 11:00 a.m. Mr. Young will make provisions for the absent CZMC manbers who wish to visit the site on other date. Mr. Natchez distributed copies of his letter dated March 16 which explains the project to renovate the property which is at the south end of Premium Point. This letter has addressed the LWRP policies. The work includes enclosing an open veranda located on the south side of the first floor, adding one bedroom above it; enlarging the existing garage from a three-car garage to a four-car garage and building two stories on top of it; demolishing the present 35 foot pool and building a larger 60 foot CZMC Minutes March 23, 1993 Page 2 (25 foot wide lap pool) to be enclosed and winterized. This new pool will be located in the same spot as the present one but will be turned 90 degrees. This is the only area which might require blasting. Minor portions of the work will require a variance from the Zoning Board and they are not sure if a variance is needed for the garage area. A question was raised as to the integrity of the septic system. This on-site septic system is about 12 years old and is separate from the storm water drainage system. Mr. Natchez said that after all the work is completed, the septic system will be tested and he does not anticipate any problems with the system. They plan to replace the seawall and retain the 4 foot height. NYS DEPT. OF STATE - LIS REGIONAL COASTAL MANAGEMENT PROGRAM Mr. McCaffrey and Mr. Bartow of DOS appeared before CZMC to explain the program and distributed reading material. Mr. McCaffrey stated that the Governor's Task Force on Coastal Resources made several recommendations: one, to revise the State coastal prvytam which will be rewritten as a series of regional programs instead of a single State program. It will not change the relationship between the State coastal program and the local waterfront programs that are approved, nor will there be inconsistencies between the two programs. Mr. McCaffrey explained how the present policies will be reduced in number while retaining the scope of the study and he mentioned some revisions to be made. Another recommendation is to identify the environmentally sensitive areas and areas for concentrated development. One issue not presently, adequately reflected and which affects local programs is identifying priorities for State investment in the coastal zone areas and having the State agencies agree on priorities. Mr. McCaffrey said they are presently gathering useful information and developing a geographic information system. The first draft of this program is expected by June 30, 1993. The Governor will request legislation this year that would have DOS make the determination of consistency for major activities including the environmentally sensitive areas. Mr. Bartow said it is felt that the local programs will have a significant say in the consistency review process. There is a major focus on developing a coastal non-point pollution control program and implementing it in the L.I. Sound. The Governor has proposed an Environmental Assistance Fund which is now before the legislatide and most of the money will go to local governments. One item that would be covered under this proposal is local waterfront programs eligible for implementation grants. Mr. McCaffrey suggested that if CZMC is interested in this legislation, they should communicate it to their local legislators. They concluded their presentation by showing photographs taken of the L.I. Sound shore area. p C7,NIC Minutes March 23, 1993 Page 3 APPROVAL OF MINUTES The minutes of February 23, 1993 were adopted on motion of Mrs. Fredston and seconded by Dr. Mason after minor changes were made. CHAIRMAN REPORTS DOS Meeting - Chairman Martin reported that the DOS selected two dates of April 20 and April 29, 1993 for their meeting to be held at the Town Center. Diforio Subdivision Chairman Martin reported that this subdivision is miming back with another DEIS. Chairman Martin attended a meeting with Jenny Carter of the Reservoir Committee, Mr. Goldberg, Mr. Weiner, and Edgar Lehman (Friends of the Reservoir) . They visited the site and saw where a longer retention pipe will be developed. They were informed by the owner that he has no intention of selling or developing the PAY. Surface Water, Erosion and Sediment Control Law - The proposed amendments for this law should have been on the last Town Board's agenda for notice of a public bearing. This will probably be on next month's C2MC agenda. Mayor Lewy had told Chairman Martin that the Village of Larc1m nt Will wait to implement this law until after the Town has passed and implemented it. Governor's Coastal Erosion Task Force - This is a result of the December storm and is composed of communities, officials, and interested parties affected by the storm. It has five or six working groups one of which is the local community working group which keeps local officials abreast of what the task force is doing. They are to make recommendations on what measures are to be taken to minimize damage during. these kinds of storms and make sure the necessary repairs and permits are done in a timely fashion. One problem is that most of the people involved are from Long Island communities and not Westchester County. Mayor Lewy is concerned that CZ14C keep abreast on what is happening. Chain Martin asked for a volunteer to make phone calls to Laura Tessier for updates. Dr. Mason volunteered. FRS' REPORTS/MINUTE Elinor Fredston - Planning Commission - The Willow Avenue project was approved. Mrs. Fredston announced a meeting on the Comprehensive Coastal Management Plan to be held in New Rochelle on March 24, 1993 from 1:30-4:30 p.m. and in the evening at SUNY, Purchase from 7:00-9:00 p.m. NEXT MEETING: April 27, 1993. The meeting adjourned at 10:30 p.m.
