CZMC MINUTES
June 24, 1997
A regular meeting of the Costal Zone Management Commission (CZMC) was held on June 24, 1997 in
Conference Room A, 740 W. Boston Post Road, Mamaroneck, New York. The meeting was called to
order at 8:15 p.m.

1. Approval of Minutes:
The minutes from 4/29/97 and 5/27/97 were approved with corrections from members on a motion
from William Bailey, seconded by Madelaine Berg.

2. Consistency Referral:
Proposed Zoning Amendment, Regulation of Food Related Retail Establishments
- TOM Town Board
- The Mamaroneck Town Board is requesting a consistency referral from the CZMC regarding the
proposed zoning amendment because it covers an area greater than 15 acres, which makes it a
Type I action. The proposed amendment deals with the spacing of food related retail
establishments.
-Concerns expressed by the CZMC regarding possible increases in litter and traffic are
already addressed in the existing law.
-The CZMC unanimously agreed that the approval of the amendment will neither advance nor
hinder the policies set forth in the Local Waterfront Revitalization Plan (the LWRP) and
accordingly is neither consistent nor inconsistent therewith.
3. Preliminary Discussion of the Proposed Freshwater Wetlands and Water
Courses Protection Law and Creation of Local Tidal Wetlands Law:
-Although Laura Tessier was unable to attend the meeting, she is willing to meet with anyone
interested to discuss and offer guidance with the proposed wetlands law.
-There was a general consensus among the commission that the existing wetland maps are
inadequate due to inaccuracies and a lack of data.
-It was suggested that the wetlands proposal be submitted to the planning and zoning boards
before attempting to draft it into a law and that the town attorney should draft an outline of
the proposed law before submitting it to the planning and zoning boards.
-The town/village engineer would have the power of enforcement of the wetlands policies.
-A Freshwater Wetlands Commission could be formed to handle wetlands applications. In some
instances this would require the hiring of an outside consultant to do site specific studies.
After reviewing the proposal, it was agreed by all members of the commission that the
following points should be included in the discussion with Laura Tessier:
-Why did she select the wetland definition stated in the proposal?
-Regarding the statistics for wetland losses, what are the comparisons based on and
what are the time frames?

-The buffering distances need to be discussed.
..should they be based on topography?
..should there be a standard distance, possibly varying between different
zoning districts?
..is the distance suggested in the proposal (100 ft) too large?
-Is recommendation #3 practical? (defining wetlands, watercourses, and
wetland/watercourse buffers)
-Chapter I of the proposal needs to be more specific.
4. Discussion of Proposed Amendment to Consistency Law.
-Phyllis Wittner commented that the law needs to be adjusted so that issues will come before
the CZMC. She then stated that the changes need to be made so that it is not quite so
cumbersome to review.
-Ken Bialo suggested working with the town attorney to revise the changes.
5. Chairman's Report:
-Nancy Seligson thanked William Bailey and Ruth Gyure for compiling the minutes for the past
two meetings. She then continued to thank the members of the commission that attended the
Habitat Restoration Meeting.
The meeting was adjourned at 10:09 p.m.
