CZMC MINUTES
July 28, 1998
A regular meeting of the Costal Zone Management Commission (CZMC) was held on
July 28, 1998 in Conference Room "A", 740 West Boston Post Road, Mamaroneck,
New York. The meeting was called to order at 8:10 p.m.

1. Approval of Minutes:
- The minutes from 6/23/97 were approved with corrections from members on a motion by
M. Godick seconded by R. Gyure.

2. Consistency Referrals:
Request for a variance to replace 12,000 gal. capacity UST with 15,000 gal. capacity UST
Jack's Automotive

- Dale English stated that Jack's Automotive is applying for a variance to increase the
on-site underground storage tank capacity from 12,000 gallons to 15,000 gallons.
- The Commission inquired if dewatering was going to be required.
- Mr. Baxter stated they did not know at this time. He added that he was unaware of any leaks
either and that all matters will be handled properly as outlined in all applicable state
and federal regulations.
- The Commission stated that this site drains to a storm sewer system which flows directly
to the Premium Marsh, a County and Locally designated Critical Environmental Area.
Special care should be taken to minimize/eliminate the runoff of pollutants from this
site.
- A discussion ensued and the Commission agreed upon the following:
If the applicant complies with all applicable regulations regarding tank closure,
contaminated soil management and tank installation requirements, it is the opinion of the
CZMC that this project will neither be consistent nor inconsistent with the policies set
forth in the Town of Mamaroneck - Village of Larchmont Local Waterfront Revitalization
Program (LWRP). However, due to the fact that all stormwater drainage from this area drains
to the Premium River - Pine Brook Wetlands Complex which is part of a County Critical
Environmental Area(CEA) and a locally designated CEA, as defined by Chapter 254 of the Code
of the Village of Larchmont, and is also designated as Significant Coastal Fish and Wildlife
Habitat by New York State and as Locally Important Fish and Wildlife Habitat in Section
II.N.3. in the Town of Mamaroneck-Village of Larchmont LWRP, the CZMC recommends the
following:
• best management practices be utilized to minimize the amount of soil runoff from the site
• if contaminated soil is discovered during tank excavation, not only should best
management practices be utilized but the soil should be removed from the site immediately
in order to prevent runoff of any hazardous substances
• even if soil is not found to be contaminated, any excess soil should be removed from the
site as soon as possible

- Located behind this property is a mapped wetland area on the Town of Mamaroneck
Freshwater Wetlands Map and the proposed rear addition would encroach on a critical
wetland buffer. In addition, this wetland is part of the Larchmont Reservoir-Sheldrake-
Leatherstocking Freshwater Wetlands Complex as defined in §92-9 and §92-12 of the Code
of the Town of Mamaroneck. This area is also designated as a "Locally Important Fish and
Wildlife Habitat", or a Critical Environmental Area, in Section II.N.2. of the Town of
Mamaroneck- Village of Larchmont LWRP and it is the opinion of the Commission that it
should be protected as such.
- As neither the applicant nor a representative was present at the meeting, the CZMC was not
presented with the opportunity to discuss possible alternatives or variations to the site
plan.
- It is the opinion of the CZMC that the proposed rear addition at 7 Winged Foot Drive is
inconsistent with the policies set forth in the Local Waterfront Revitalization Program
(LWRP).
THIRD REVIEW
Requesting a Variance to Construct a 2nd Story Addition to an Existing 1 Story Building

Requested by: Town of Mamaroneck Zoning Board of Appeals
- Henry Meltzer announced that Beechmont Bus had hired an engineer to review and revise the
previously submitted site plans. He then stated that the existing oil/water separator is
connected to the sanitary sewer. Beechmont Bus is proposing to remove and replace this
oil water separator. The new oil/water separator will connect to the storm drain. He also
stated that tests were performed to determine where the sub-grade pit drainage is
directed. These tests were inconclusive and it was decided that this pit should be
connected to the new oil/water separating system.
- After a brief discussion, the CZMC agreed that compliance with the following
recommendations would assure consistency with the policies set forth in the LWRP:
• all interior shop wastewater, from existing and proposed facilities, be directed to a
properly designed coalescing type oil/water separator
• the existing undercarriage washing pit be either plugged or connected to the coalescing
oil/water separator
• roof drainage be introduced directly into the storm sewer without being tied into any
oil/water separators
• the stormwater collection system within all paved areas of the facility be connected to a
new box type oil/water separator as displayed on the drainage and erosion control plan
submitted on July 21, 1998
• no soaps, surfactants or any hazardous materials be discharged to any drains whatsoever
• proper maintenance be performed on the separators in order to ensure functionality and
compliance with design specifications; at a minimum, accumulated waste materials be
removed quarterly and properly disposed of

- Mr. Meltzer agreed to the above listed recommendations and stated that their engineer will
revise the existing plans to reflect any changes.
- The engineer will remain in contact with Marc Godick until site plan revisions accommodate
the above recommendations. Mr. Godick will report these discussions to the CZMC at the
next meeting.
3. Discussion of Mamaroneck-Larchmont Coastal Assessment Form:
- William Bailey has been in contact with Ned Benton regarding the Coastal Assessment
Form and is in the process of contacting representatives of other municipalities who have
created similar-type review forms. He will continue to work on the form over the next
month and will report to the Commission at the next meeting.
4. Members' Reports:
- Eileen Weingarten stated and emphasized that it is important for all members to closely
monitor the meetings of the boards/commissions for which they have been appointed
liaisons in an effort to guide these boards/commissions on referable matters, especially
due to recent changes in the Consistency Law.
- Eileen Weingarten stated that the Village of Larchmont is planning to hire an independent
engineering firm to review the entire Pine Brook area drainage system and the New Rochelle
sewage treatment plant to evaluate the systems and to identify where leaks between
systems occur.
- Ruth Gyure stated the Town is in the process of turning the Monroe School on Weaver
Street into a nature center and permanent home for L.I.F.E. and the Friends of the
Reservoir.
- Ruth Gyure announced that the Westchester County funded and locally organized
Streamwalk Project is currently underway where volunteers are walking the length of the
Sheldrake River and its tributaries to assess water quality and identify areas that may
contribute significant amounts of non-point source pollution. Volunteers are given
surveys to fill out and upon completion the information will be compiled and become part
of the Watershed Advisory Committee 4's report.
The meeting was adjourned at 9:45 p.m.
