Sixty One (61) and 65 Woodbine Avenue - VOL Planning Commission - This is a Type I Action in a critical environmental area on the Premium River. Permits required are for grading and alteration, phragmite removal, and for the new residence. Material received to date include a cover letter dated May 27 with a joint application for a permit on behalf of Mrs. Amy Cohen; application for an expansion of the existing residence at 61 Woodbine with a reconstruction and demolition of the garage to be made into a new house; grading ® alterations to fill around this structure to accommodate terrace, gardens, courtyard, etc.; and replanting of phragmites at the edge of • • Printed nn Panvrieri P CZMC Minutes July 28, 1992 Page 2 the water. Also received was a June 22 letter to the DEC requesting that the VOL Planning Board be the lead agency. Mr. Gagliardo gave a presentation explaining his company's work on the site. He spoke of same primary concerns to CZMC: (1) Construction of a single family residence to include grading alterations around the structure. Because the grading alterations are within 56 feet of the wetland edge, it requires a wetland permit. (2) Estimate of 2,000 cubic yard of fill to be brought in for terrace, gardens, patios, and dry stone walls. Mr. Gagliardo showed where the fill will go and the retaining wall. (3) Phragmites removal. This reed grows to about 8 feet high and obstructs the water view. They will follow any recommendations for replacement planting. When Mrs. Wittner originally saw the application it required phragmites removal with a product called 'Round Up". Because of concerns on the use of this product, Mrs. Wittner researched it and found it was not the correct product for this application. Monsanto has another product called 'Rodeo"" which has no known adverse impact on fish and wildlife but the AMA Journal reports it is a weak carcinogen and mild eye and skin irritant. The DEC has recommended its use. Joan Hansen gave a presentation explaining which plants might be used in place of the phragmites. She expressed concern about the no-salt tolerant plants selected by Mr. Gagliardo and made up a list of salt tolerant plants for him to consider. She explained the advantages of keeping the phragmites (an exotic plant whose root system takes up heavy metal) but also its disadvantages (can destroy beneficial plants) . Another suggestion was to cut back the phragmites up to the point where the slope drops off and plant shrubs and other types of salt marsh plants to get a view of the River. Because of the pros and cons of the phragmite removal, it was suggested to exclude permission for removal from the permit until such time that removal is demonstrated essential to the project. (4) There are no catch basins along Woodbine Ave. and water runs down the curb line. When it reaches the driveway, it cuts across and settles into a low area. The Planning Board said this is a preexisting condition and the applicant could correct it at her awn expense. Mr. Gagliardo reported they will put in a catch basin at the Village Engineer's request. He also suggested a yard drain to pick up any water which comes in and/or might drain off fran the grading. The existing sanitary sewer line will be relocated. When asked about a possible o surcharge fran the storm drain spilling out onto Woodbine Ave., Mr. Gagliardo replied that the Village Engineer said the drain CZMC Minutes July 28, 1992 Page 3 would be adequate. There is concern about the low spot where one of the catch basins is planned. It was suggested to build a pond up front but Mr. Gagliardo did not think the property would be suitable and they would look at other solutions to this problem. One solution they will investigate is a retention basin and finding a way to discharge the water allowing silt and sediment to filter out. It was decided that some members of the Commission should speak to Joe Morgan, the Village Engineer, about technical questions. The CZMC will request that the applicant submit an erosion and sediment control plan. CZMC will give their opinion at the public hearing at the end of August. B. TOM Planning Board - Hammocks Park Apartments, 1361 Boston Post Road Gary Trachtman gave a presentation and explained the drainage plans. Malcolm Pirnie proposes a series of catch basins but have not decided the connection point because of concerns about subsurface conditions where the connection would be made and in other cases, they have concerns regarding the relative elevation of discharge point to the available cover over the top of the sewer pipe. He also explained the possibility of using a chamber. It was questioned as to the increase in flow to the sanitary sewer due to added kitchens. Mr. Trachtman replied that it was determined that the existing sewer is adequate and the impact will be very minimal. Where there are impervious surfaces, any water will be captured and directed underground. Mr. Trachtman reported that the EAF that was filed showed the pervious surfaces increasing slightly and the impervious surfaces decreasing. This may not be a plus because of the nature of the rocky site. Mr. Martin raised the question of high pollution levels in East Creek when the motel was in use at the point where the 48" sewer pipe canes in and decreased pollution levels after the Hotel was closed. He feels there might have been a cross connection between the sanitary system and the storm sewer system. Mr. Trachtman recommended alerting the Building Department and having the matter checked out. In concluding, Mrs. Wittner felt all of CZMC's concerns had been dealt with. COUNCILWOMAN ELAN' PRICE A. Update Westchester County Citizens Committees Non-Point and Point Pollution in Long Island Sound Councilwoman Price explained that these committees were formed by County Executive Andrew O'Rourke to look into the problems with the nitrogen cap. Councilwoman Price said that she is on two subcommittees. The Point Source Pollution Committee's members are: Chairman Christopher Russo, Warren Ross, Larry Bock, and Councilwoman Price. CZMC Minutes July 28, 1992 Page 4 Councilwoman Price, who is also on the Non-Point Biological Controls Committee headed by Laura Tessier, felt that with the non-point biological controls, they might at best only eradicate 8% of the total nitrogen going into the Sound. It is felt that the target should be point source. Councilwoman Price explained that the non-point committee had a master map sent to communities to identify wet and dry detention basins, and what Best Management Practices (BMP) they were using in their community. About 20-25 communities responded. The purpose was to identify areas that can be retrofitted to wet retention basins that would keep the water in and minimize soil erosion. Gary Trachtman did this area's map which he showed. The difference between wet and dry was explained through identifying certain areas, e.g., dry areas would be the Fenbrook subdivision, Larchn nt Apartment complex and Carleton House. Examples of wet facilities would be Gardens Lake. Sixteen locations were identified in that category. Half are structures, one third are natural and another one third are man made. Those areas have sane value as being capture points before things get out into the Sound. Mr. Trachtman explained that dry ponds remove only about 10-20% of the nitrogen and phosphorous caning in. Wet ponds drain anywhere from mid 20% on phosphorous to 40-60% on nitrogen, thus the wet pond would be more efficient. But more wet ponds result in more mosquitoes requiring maintenance. As the Premium Marsh is becoming more of an upland environment, Mr. Trachtman suggested channelization - extending the River back into an area where a lattice work of channels would promote growth of certain species. B. Pohlmann Report - Councilwoman Price distributed copies of this report which outlines the necessity for cleaning up the Sound and Hudson River by combining the sewer districts and gives figures about cost appreciation of the sewer districts. Councilwoman Price feels by phasing in the merging of the districts, certain districts such as Mamaroneck would only have a slight increase. She asked for CZMC's support in backing this project and said she would keep them informed about the project. APPROVAL OF MINUTES The minutes of June 16, 1992 were approved. CHAIRMAN REPORTS A. Correspondence - Inconinq: 1. 7/1/92 - Received the disc for the LWRP. 2. 7/2/92 - Supervisor Silverstone re: Housing Task Force Update on the Status of Affordable Housing. 3. Letter from Councilwoman Price to P. Wittner re: Biological Controls Subcommittee Draft Report. CZMC Minutes July 28, 1992 Page 5 B. Correspondence - Outgoing: 1. To Mayor Lewy and Supervisor Silverstone re: CZMC appointments. Angel Martin will become Chairman starting in October; both Shirley Tolley and Larry Lowy will be stepping down, although Shirley Tolley will still continue doing work for CZMC; Mary Feldtmose has been reappointed. The VOL will appoint a replacement for Mr. Martin to a one-year tern and another person will be appointed to a three-year tern as a replacement for Mr. Lowy. 2. 6/13/92 to Joan Hansen requesting her consultation on 61 Woodbine Ave. 3. 6/19/92 letter to the Planning Board re: information on amendments to the Service Business Zone. 4. 6/23/92 to Sandy Bell re: non-submittal of opinion on Hammocks Park Apartments as awaiting drainage information. C. Correspondence - Copies 1. 6/16/92 from Councilwoman Price to Supervisor and Town Administrator re: Joint Work Session for Proposed Surface Water, Erosion, and Sediment Control Law. 2. Notice from Commissioner Oliva, Westchester County Department of Planning, Clarification of County CEA's. 3. Gary Trachtman to S. Altieri re: Contractual Arrangement for Joan Hansen to do work on Woodbine Avenue and attend the July 28 CZMC meeting this evening. MEMBERS/ REPORTS/MINUTE Richard Metzner - Scenic Views: Took pictures from Dog Beach east/south around and to Lorenzen and up to Pine Brook of any places that had a view toward the Sound and other water bodies. Mrs. Wittner said the Commission has to decide if they want to get into this for the LWRP update. She tabled this topic until the next meeting. Shirley Tolley - Updated Town of Mamaroneck Freshwater Wetlands Map: Shirley Tolley gave her proposal for a more accurate updated wetlands map. She proposed that sameone with expertise in wetlands go out into the field and do an updated map. She would get estimates and put together aerial maps and other material which the Town already has. She showed the present map where a Sheldrake tributary that parallels Bonnie Way is also a wetland area which should be on the map. Ms. Tolley said she would check with the County to see what maps they have, and it was suggested that Con Edison might have maps which could be used also. Mrs. Wittner asked whether it is appropriate to also propose this project to the CAC, Planning Board, and Town Board. She asked Claudia Ng to discuss the project at the next CZMC meeting when this proposal could be considered. NEXT MEETING: August 25, 1992. The meetina adjourned at 11:00 D.M.
