CZMC MINUTES
January 24, 1995
A regular meeting of the Coastal Zone Management Commission (CZMC)
was held on January 24, 1995, at the Town Center, 740 West Boston
Post Road, Mamaroneck, New York. The meeting was called to order
at 8: 01 p.m.

I. CONSISTENCY REFERRALS
A. Metropolis Westchester Lanes - Natural Depot, 2444 Boston
Post Road.
Town of Mamaroneck Planning Board. Type 1 (Westchester
County CEA) .
Andrew Fredman, Architect explained that he has requested an
• application for a special permit from the Planning Board for a
retail-use health food store at the Staples Shopping Center . All
renovations will be interior work. The Planning Board wants

confirmation that there are no outstanding issues with the CZMC.
When this application was originally in front of CZMC, the issue of
runoff detention was addressed. A sand and oil intercepter was
installed that will accommodate a 150-year storm. The Commission
found this application neither consistent nor inconsistent with the
Policies of the LWRP.
B. Vixen Ente prises, adjacent to 2345 Boston Post Road.
Village of Larchmont Planning Board. Type 1 (Westchester
County CEA) .
No one was present for the applicant. The majority of the site is
zoned R-B (retail-business) . This is the corner lot on Lorenzen
and Boston Post Road. There is an existing, blacktop parking lot
behind an existing building. To the right of the building (facing
it from BPR) is a large unpaved area. This is the area in
question. This is the area where the owner had taken down many of
the large trees and it is now visually unacceptable to the area.
The plan shows a 15' foot buffer of evergreen trees and shrubs
separating this site from the residences. There are two very large
evergreens in what; is proposed to be a parking area.
P. Wittner suggested that the Commission might want to recommend a •
silt trap with the capability of removing oil and grease, since
there will be alot of cars attendant to this building.
P. Wittner suggested writing a letter to the Planning Board and
Vixen Enterprises stating that the CZMC had not received a complete
application and was requesting an extension from the Planning
Board. The Commission needs more information and will put it on
the February agenda. S. Tolley stated that the applicant should
show the location of the storm drains on this site.
C. Proposed Zoning Amendment Cellular Telephone Antennas.
Town Board. Type I.
The zoning amendment is based on property values only. The two
issues raised in the amendment that are relevant to CZMC policies
are setback and visual concerns, policies 5 and 25. This zoning
amendment would restrictthe placement of cellular antennas and
accessory structures to two areas - 1) anywhere in the Light
Industry (LI) zone which is around Maxwell Avenue or 2) in the
middle of the recreation zone (RZ) . If it is in the RZ, it has to
be 1, 200 feet from the nearest residence. Regarding visual
environmental concerns, "all towers and antennas shall be sited to
have the least possible practical visual affect on the
environment. " - • I

The towers could be as high as 125 feet from the ground surface.
There would have to be site plan approval prior to granting a
siting permit. The Planning Board will require the site plan
submission to include a completed visual EAF.
The Commission agreed that this zoning amendment is neither
consistent nor inconsistent with the Policies of the LWRP.
2. DISCUSSION
A. Proposed Expansion Hommocks School
This item was put on the agenda at the request of Sarah Tate,
Assistant Superintendent for Mamaroneck Schools. She explained
that the District is contemplating building an addition onto the
Hommocks School. LAN Associates has been hired to look at the
environmental issues.
The Board of Education (BOE) is exempt from all local zoning or
planning ordinances. However, they are subject to Consistency
Review because the BOE's agency is the New York State Department of
Education. The BOE has to find consistency with the State Coastal
'• Management Program. Since the LWRP was approved by the Department
of State and the LWRP has the force of state law, the proposal has
to be consistent with the LWRP.
S. Tolley questioned whether they would be completing an
Environmental Impact Statement. Ken Carle of LAN Associates
explained that the Department of Education has their own
Environmental Assessment Form which LAN Associates just submitted
as well . as the separate short form or project description form.
The Department of Education form is similar to the Long Form EAF.
P. Wittner explained that this would be the type of information
that would come into the CZMC. The Commission members then
expressed to Sarah Tate and the LAN Associate representative some
of the CZMC views regarding the Hommocks namely whether this
addition will add to the existing drainage problems and have an
adverse impact on the very fragile Hommocks Salt Marsh Complex, a
town Critiical Environmental Area.
K. Carle gave the Commission a brief description of the intended
project, indicating that the proposed addition is in the fenced in
ball field in the bend of Hommocks Road and that the building was
conceptualized in 1966. He explained how Hommocks Road used to be
a straight-away and that it was moved in 1966 to form the loop with
the anticipation that the future addition would go in some day.
K. Carle said that the flood (FEMA) maps they looked at showed part
' • of this site as flood plain but he said that they also showed

Hommocks Road as a straight road. He said that the maps are out-
of-date. They are having surveys made for topographic elevation so
they can compare it with the base flood elevations on the FEMA map.
They are having soil borings done to determine the physical and
chemical characteristics of the soil in this area. The existing
building is on piles. The borings will provide a soil log, and
would determine if deleterious materials are present or if there
was a landfill in the area.
S. Tolley strongly suggested that they do an Environmental Impact
Statement because she thinks it would be beneficial to their
relationship with the community. That way, all the questions could
be discussed and there could be a hearing on it. Also she wanted
to know where new sewer pipes would go because the existing sewers
in the area needed pumping facilities and the drainage there is
extremely bad.
S. Tolley said that if Consistency has to be found, Consistency
comes under the SEQR Law. She read from the SEQR handbook. It
says, "if your area is in the Coastal Zone then you have to also
say in the Environmental Impact Statement that the project is
consistent with the Coastal Policies and if there is a local LWRP,
consistent with the local LWRP. "
P. Wittner said that the Commission all agreed that they will have •

to come back with an Environmental Impact Statement. She also
asked whether they will be addressing the Flood Damage Prevention
Law in the Environmental Impact Statement. K. Carle said they are
trying to ascertain at present if they are in a floodplain. There
is an amendment procedure that can be followed if one can
demonstrate that the FEMA map is incorrect. Another.;issue: raised
by the CZMC was sedimentation during construction.. The
Environmental Impact Statement - needs. to demonstrate-. the public
need, adverse affects and discuss other alternatives.
The proposed Hommocks School Expansion project will be put on
February's agenda if they have documentation ready.
B. David's Island
Shirley Tolley explained two options of the Save David's Island
group: continue opposition to project or develop a proposal that
would meet the Coastal Zone policies, something that would be
acceptable to the State Dept. of State. No decision was rendered.
3. Approval of Minutes
The minutes of 10/25/94 were approved, as revised, on a motion from
R. Metzner, seconded by R. Young.

grant in their name as advocated by Friends of the
Reservoir and L.I.F.E. to convert a former water
storage tank into an environmental center. NYS
Office of Parks has grant monies (Environmental
Protection Fund) has grant monies for acquistion or
development of parks.
5. Watershed Advisory Committee (WAC 5) meeting
1/31/95.
