CZMC Minutes-2/25/97 Town of Mamaroneck — Village of Larchmont COASTAL ZONE MANAGEMENT COMMISSION Lit TOWN CENTER: 740 West Boston Post Road, Mamaroneck, NY 10543 914-381-7845 CZMC Minutes February 25. 1997 • A regular meeting of the Coastal Zone Management Commission(CZMC)was held on February 25, 1997 in Conference Room A,740 W.Boston Post Road,Mamaroneck,New York. The meeting was called to order at 8:05 p.m. MEMBERS PRESENT: C Lili Andrews Co-Chair C.Alan Mason CZMC Frank McGahan CZMC Howard McMichael CZMC Richard Metzner CZMC . Nancy Seligson Co-Chair Richard Ward CZMC OTHERS PRESENT: Ken Bialo VOL Liaison Eve Bocca Environmental Coordinator Wallace Irwin Friends of the Reservoir(FOR) Cheryl Lewy VOL Mayor 1.Presentation: Protection of the Sheldrake Watershed-Briefing by Wallace Irwin-Friends of the Reservoir Downstream flooding,siltation and pollution in the lower reaches of the Sheldrake River watershed requires intermunicipal cooperation and solutions with upstream communities. The LWRP,in particular Policy 14,states that the VOL and TOM would seek the cooperation of neighboring municipalities in the control of flooding and erosion from land development and contruction. Upstream siltation must be controlled because there is already a considerable silt island in the Reservoir. The silt has drastically reduced the retention capacity of the lake and interferes with the value of the lake as a retention basin. Eventually the lake will have to be dredged and that will be very expensive. Additionally,the lake is an important wildlife habitat for fish,birds and amphibians and is also a scenic Qtreasure. 41, tett Printed on Recycled Paper CZMC Minutes-2/25/97 The Friends of the Reservoir is interested in establishing an intermunicipal cooperative structure to control upstream siltation and the cooperation of Scarsdale,New Rochelle and to a degree White Plains is needed. As a responsible organization for the implementation of the LWRP,especially as it relates to the Sheldrake, the CZMC could play a role in this intergovernmental plan. Stephen Altieri,Town Administrator will approach his counterparts in New Rochelle and Scarsdale to see if they will,as a matter of routine,notify the Town with regard to development projects in the Sheldrake watershed. The securing of funds from the Clean Water/Clean Air Bond Act in order to implement the above will be further investigated. The CZMC will prepare a list of priority issues. Ron Tocci,Suzi Openheimer and Albany as well as DEC and DOS have been made aware of the TOM and VOL priorities. 2. Continuing Business Revised Wetland Law-Update N. Seligson and E.Bocca met with Laura Tessier on 2/14/96. The purpose of the meeting was to review the goals and objectives of the RFP and to clarify and confirm specific elements of the work tasks outlined in the consultant Scope of Services. Interviews have already been conducted with the Town Building Inspector,Environmental Coordinator and Councilwoman Wittner and a summary of same was circulated. A meeting with the Town Attorney, Town Planning Board Chair and the Consulting Engineer has also been arranged. The City of Rye wetland regulations and the WC S&WCD Model Ordinance for Wetlands will be reviewed in relation to the TOM law. Federal and State wetland regulations will be reviewed primarily for their relationship to local wetland laws. A preliminary draft report will be prepared for a work session with the CZMC at the March meeting. A draft report will be available for the April meeting. Because of the liability of creating a draft(liability generating phrases,etc.),the attorneys for both TOM and VOL will evaluate it prior to circulation. 3. New Business Consistency Law-Rough draft of proposed amendment The amendment will make the existing Consistency law stronger and codify it so that it is consistent with the 1996 changes to SEQRA and subsequently MEQR. A question arose regarding the enumeration of the Type II list rather than referring to SEQR and MEQR. A question was raised regarding the procedure the CZMC would follow if an incomplete appliction was referred to them. The members should review the proposed amendments over the next weeks and come to the March meeting with all comments or call N. Seligson prior to the meeting. P.Wittner can be contacted to clarify specific questions. A decision on a recommendation to the Town Board will be made at the March meeting. 4. B. Other 1. N. Seligson and Lili Andrews presented the Annual Report to the VOL. The VOL seemed © appreciative of the work the CZMC has been doing. The co-chairs thanked them for working with the Commission. 2. R.Metzner explained the proposed renovations to Village Hall. The$2 million renovations will primarily bring the Village Hall into compliance with the American's With Disabilities Act by installing an elevator.Other changes may stem from that. 3. E.Bocca has resigned effective 4/1/97 and has accepted a position with NYC DEP. Stephen Alfieri is soliciting resumes for the position. N.Seligson and L.Andrews would like to meet with the finalists.
