HomeMy WebLinkAbout1993_02_23 Coastal Zone Management Commission Minutes Town of Mamaroneck — Village of Larchmont COASTAL ZONE MANAGEMENT COMMISSION TOWN CENTER: 740 West Boston Post Road, Mamaroneck, NY 10543 _ 914-381-7845 APPROVED MINUTES FEBRUARY 23, 1993 A regular meeting of the Coastal Zone Management Commission (CZMC) was held on Tuesday, February 23, 1993 in Conference Roan A at the Town Center, 740 West Boston Post Road, Mamaroneck, New York. The meeting commenced at 8:05 p.m. Members Present: Angel J. Martin, Chairman Lilian Andrews Elinor Fredston C. Alan Mason Richard Metzner Phyllis Wittner Richard A. Young Others Present: Stephen V. Altieri, Town Administrator Kevin Brenner Lawrence Gordon Claudia Ng, Environmental Coordinator Ellen Morse, Recorder Chairman Martin opened the meeting by announcing CZMC's new member, Lili Andrews from the Village of Larchmont. REFERRAL: SITE PLAN APPLICATION FOR NEW HOUSE AT 102 WILLOW AVENUE This is a referral, Type I action from the Larchmont Planning Commission which is adjacent to the critical environment area at Premium Marsh. Architect Lawrence Gordon showed a demolition plan whereby the present house at 102 Willow Avenue which is the last house and adjacent to Woodbine Park will be razed and a new house built. It is proposed to build a one family, four bedroom, two and one-half bath house on a 50' x 100' lot. Two dry wells will be built and plantings will be put in along the side of the house. Mr. Gordon has been to the Planning Board and will return again. A zoning variance is needed for a one and a half foot deck and for the front setback. The Village of Larchmont owns about ten feet in front to the curb line. Chairman Martin expressed a concern that any soil or dirt which is moved not end up in the catch basin which discharges into the Premium River. He wants them to provide same protection to prevent this from occurring. This referral does not cane under the new Erosion & Sediment Control Law since the Village has not passed it yet. In closing, Chairman Martin said that CZMC will respond to the Village of Larchmont Planning Board with their suggestions and comments. ips Printed on Recycled Paper CZMC Minutes February 23, 1993 Page 2 EROSION AND SEDIMENT CONTROL LAW Town Administrator Steve Altieri attended this meeting to answer any questions on this issue. He stated that the Town Board asked the Town staff to recheck certain aspects of the law because of unfavorable public reaction. They focused on three issues: the question of the mapping, performance (cash) bonds, and possible exemptions of certain applications to the law that would not have a significant impact. Regarding the first issue, the cost of the contour map was found to be excessive for individual homeowners. Ms. Ng has prepared a Request for Proposal for mapping out the entire Town with itemized cost estimates for doing the two Villages and the unincorporated area. The proposal is to increase the inspection fee schedules for residential, commercial and multifamily properties by $100 each to cover the value of the cost of the maps. This does not include the filing fee of $50. Initially, the maps will show topography, streets, and structures. These maps will eventually serve a variety of purposes, including siting of utilities, because the data will be digitized and additional information can be added as funds are available leading to the development of a full Geographic Information System. The aerial photography must be done by the end of March or beginning of April. The second issue of performance (cash) bonds was discussed in terms of the difficulty for individual residents to obtain one and the possibility of having to put up collateral. The third issue is the question of threshold for work below which you would not need a permit. At present the only exemptions include accessory structures of 100 square feet or less such as sheds or garages, excluding decks. Mr. Jakubowski's letter specifies that additions of 100 square feet or less should also not require a permit. The Commission agreed to support this threshold of 100 square feet. At present the law does not include any standards to be followed by those who are exempt. It was decided to have certain standards incorporated into the law for those who are exempt. Mr. Altieri said that the Town attorney will redraft these sections with the appropriate changes and they will submit this redraft back to CZMC. COIN REPORT - DISCUSSION ON RECOMMENDATIONS FOR RSL-CEA Steve Coleman was present to discuss his Management Plan for the Reservoir, Sheldrake, and Leatherstocking areas. Mr. Coleman recommends that the Town adopt a "no net loss" policy which many municipalities are switching to. The theory is that when an area is small it can be a significant habitat. Often buffer areas are destroyed adjacent to wetland areas and the "no net loss" policy ensures that the developer takes this fact into consideration. The CZMC agreed that this is a very complicated issue and more research needs to be done if it is to be passed in the Town. Another recommendation of establishing vegetative 111 CZMC Minutes February 23, 1993 Page 3 buffers was thought to be a good idea but Mr. Coleman would need a map to work with and Chairman Martin asked that this report be passed along to the CAC for their input and assistance. Another recommendation for managing pesticides, herbicides and fertilizers on the golf courses was discussed. Mrs. Fredston suggested that CAC write the County about issuing a best management plan for all golf courses. In conclusion, Mr. Coleman reported that for now the CAC has agreed only to the inventory portion of his plan. APPROVAL OF MINUTES The minutes of January 26, 1993 were adopted on motion of Mrs. Fredston and seconded by Mr. Metzner after minor changes were made. IWRP SUPPLEMENT Mrs. Wittner reported that she, Mary Anne Johnson and Shirley Tolley met as a subcommittee. Mrs. Wittner asked that if any CZMC members wish to work on the document that they join this subcommittee. After they 41) have finished this portion on Inventory and Analysis, they will give it to the commission for comments and/or additions. Chairman Martin and Dr. Mason stated that they are interested in helping. CHAIRMAN REPORTS DOS Workshop - Chairman Martin reported that he and Mrs. Wittner met with John Bartow and Charlie McCaffrey of the Department of State (DOS) on February 5, 1993. The DOS is developing a training program for LWRP committees and any other interested citizens which will be given in two sessions. The first session would include the basics of coastal management processes and the second session would be a guide to using the consistency review process. Chairman Martin stated that other CZMC's from Port Chester and Rye would also be invited. It was decided to have the first session on Tuesday evening, March 30 and the second session on Tuesday evening, April 20 in Mamaroneck Towns Court Room. Diforio Property - Chairman Martin received a phone call fran Jenny Carter, Reservoir Committee member, inviting the CZMC to visit the Diforio property. Mr. Diforio will be returning to the Planning Board to present a DEIS again. He will be taking any interested parties on a walk around his property to explain his plans for the property. This will take place on Sunday, February 28 at 10:30 a.m. Anyone interested should call Ms. Carter. Coastal Management Regional Plan - Chairman Martin reported that he received a phone call from John Bartow of the DOS who wants to be invited to CZMC's next meeting to discuss the regional plan they are preparing for coastal management. r CZMC Minutes February 23, 1993 Page 4 Con Edison - Chairman Martin received a phone call from Richard Brand of Con Edison asking if CZMC had noticed any improvements in Con Edison's construction practices. As a result of their meeting with C2MC in October 1992, Con Edison developed a set of guidelines for best management practices for their construction crews. He asked CZMC to inform him of any problems they see at their construction sites. MEMBERS' REPORTS/MINUTE Elinor Fredston - Planning Commission - Mrs. Fredston reported that the Planning Board approved the project on Sherwood Drive and the project for a driveway. The meeting adjourned at 10:05 p.m. r
