The meeting was called to order at 8:11 p.m. MEMBERS PRESENT: Lili Andrews, Co-Chairwoman Marc S. Godick Bernard Kaplan Dr. C. Approval of Minutes: - The minutes from 7/28/97 were unanimously approved with corrections from members on a motion by B. Kaplan seconded by H. McMichael. 2. Consistency Referrals: Freshwater Wetlands and Water Courses Permit New Single Family Residence 28 Bonnie Way, Block 104 Lot 52.1 Requested by: Town of Mamaroneck Director of Building CZ_0898M.WPD CZMC-8/25/98 Pg.1 tJ Printed on Recycled Paper - N. Seligson announced that the Town reviewed an application to build on this lot two years ago. There was opposition from the surrounding residents and the owner decided to abandon the project before the CZMC had a chance to make its recommendations. - The lot in question has several unusual features including the following: a large bedrock outcropping protrudes throughout much of the site; the immediate area is already prone to documented flooding and drainage problems; a tributary to the Sheldrake River flows through the rear of the property, which is defined in §92-9.C. of the Code of the Town of Mamaroneck as part of a Critical Environmental Area and in Section II.N.2. of the Town of Mamaroneck and Village of Larchmont Local Waterfront Revitalization Program as Locally Important Fish and Wildlife Habitat; freshwater wetlands exist on and adjacent to the property; and many large trees currently exist on the site. - N. Seligson stated that when the applicant had previously applied to build on this lot, Laura Tessier was hired by the opposing residents to study the feasibility of building on this site. A copy of the resulting report is available to all CZMC members. - Several members of the Commission commented that the proposed residence does not appear to have changed since the last application. - The Commission agreed that its main concerns involve the encroachment onto and degradation of the wetland and watercourse buffer, a possible increase in the rate of runoff and potential adverse effects on drainage and flooding in the immediate area. - It was agreed that at this time the CZMC is unable to give a determination of consistency with the Local Waterfront Revitalization Program (LWRP) due to insufficient information. In order to determine consistency with the LWRP, additional information should be submitted by the applicant to the CZMC addressing: 1) delineation of all wetlands on and adjacent to the site 2) confirmation of the accuracy of all previous percolation tests 3) adequacy of the proposed drainage structures 4) borings and documentation of the water table 5) proposed landscaping - A letter will be sent to the referring agency noting the above listed concerns and this matter will subject for review at the next CZMC meeting. Freshwater Wetlands and Water Courses Permit New Retaining Wall and Chain Link Fence 24 Winged Foot Drive, Block 204 Lot 310 Requested by:Town of Mamaroneck Director of Building - N. Seligson stated that the rear of this property borders the Leatherstocking Trail. There is an existing chain link fence along the property line and immediately beyond, the conservation area slopes down towards the trail. The wetlands are located on the other CZ 0898M.WPD CZMC-8/25/98 Pg.2 side of the trail. The resident is proposing to raise the grade of their backyard and install a retaining wall which will be five feet six inches (5' 6") at its highest point with a four foot high chain link fence atop. - It should also be noted that this property is adjacent to a mapped wetland area on the Town of Mamaroneck Freshwater Wetlands Map. This wetland is part of the Larchmont Reservoir - Sheldrake - Leatherstocking Freshwater Wetlands Complex which is designated as a Critical Environmental Area in §92-9 and §92-12 of the Code of the Town of Mamaroneck. This area is also designated as Locally Important Fish and Wildlife Habitat in Section II.N.2. of the Town of Mamaroneck - Village of Larchmont LWRP. - A discussion ensued and the Commission agreed there are no foreseeable adverse impacts that would result from this project. The Commission stated that although this project appears to be consistent with the policies outlined in the LWRP, CZMC makes the following recommendations to further promote consistency with the LWRP: 1) the property should be surveyed and carefully marked to ensure that the proposed retaining wall does not encroach on Town Conservation Area property 2) the retaining wall should be located far enough onto the residents property to ensure that construction activities do not disturb Town Conservation Area property 3) if roof leaders or other drainage structures from the residence currently discharge to the ground surface, drywells should be installed in the proposed fill area to contain this runoff and allow it to gradually recharge ground water 4) if any landscaping is to be performed, native plant species should be used to minimize the need for fertilizers and pesticides - The Commission will reflect the above listed recommendations in a letter to the referring agency. 3. Discussion of Mamaroneck-Larchmont Coastal Assessment Form (CAF): - W. Bailey was unable to attend the meeting, therefore the CAF discussion will be postponed until next months meeting. 4. Members' Reports: - P. Wittner announced that the Village of Mamaroneck is considering building a new fire house on Harbor Island. 5. Chairpersons' Reports: - N. Seligson stated that she received a public hearing notice from Syrette Dym, chairperson for the Village of Larchmont (VOL) Planning Commission, regarding a proposed expansion of an automobile repair shop/gasoline service station at 2107 Palmer Avenue. The owner of this facility is proposing to build an addition onto the existing structure to house new vehicle inspection equipment. After a brief discussion , the Commission agreed that due to the fact that all stormwater drainage from this area drains to the Premium River-Pine Cz 0898M.WPD CZMC-8/25/98 Pg.3 Brook Wetlands Complex which is part of a County Critical Environmental Area (CEA) and a locally designated CEA, as defined by Chapter 254 of the Code of the Village of Larchmont, and is also designated as Significant Coastal Fish and Wildlife Habitat by New York State and as Locally Important Fish and Wildlife Habitat in Section II.N.3. in the Town of Mamaroneck-Village of Larchmont LWRP, the CZMC believes that this proposal warrants further review. The CZMC further agreed that the information provided with this referral is insufficient to determine consistency with the LWRP. A letter will be sent to the Planning Commission expressing the CZMC's interest. - N. Seligson announced that Steve Coleman has submitted a proposal for completing the revised Town of Mamaroneck Wetlands Law and Wetlands Map. The project should take around three to four months to complete from start to finish. - N. Seligson stated that Stephen Altieri requested that the CZMC change its meetings from the fourth Tuesday of every month to the third Tuesday of every month in an attempt to improve the referral process between boards and commissions. C. A. Mason stated that he has a conflicting meeting on the third Tuesday. The rest of the CZMC members will be consulted at the next meeting and J. Athey will further discuss this matter with S. Altieri. The next scheduled CZMC meeting will be held on September 22, 1998 CZ_0898M.WPD CZMC-8/25/98 Pg.4
