A regular meeting of the Coastal Zone Management Commission (CZMC) was held
on September 25, 1990, in Conference Room A of the Town Center, 740 West
Boston Post Road, Mamaroneck, New York. The meeting commenced at 8:15 P.M.

1. HISTORICAL & ARCHEOLOGICAL SURVEY TECHNIQUES
Nora Lucas, an historic preservation consultant and current vice-chair
of the Village of Mamaroneck Landmarks Preservation Committee, informed the
Commission on several aspects of the historic and archeological survey
process. In introducing Ms. Lucas, Mrs. Wittner reminded Commission members
that in May, 1990, she suggested that the CZMC sponsor such an investigation.
It was the Commission's wish that a presentation be made to clearly define
C what historical and archeological surveys comprise, and this meeting was the
first mutually convenient time.

Ms. Lucas said that such surveys serve as vital documents in
determining the impact of development. They can be used in referral cases,
just as feasibility studies and master plans are used. They represent
research that cannot be made at the point of development. Historical research
is done on two levels: reconnaissance and intensive. The latter is conducted
when defining historic districts and making proposals for inclusion on the
National Historic Register. In the reconnaissance level, an area is studied
by drive-through research and study of library materials, historic maps and
building patterns. Lists of significant sites are made and the list becomes
vital not only in identification of important sites, but in identification of
those sites that are not important. Historic significance may be granted to
sites of 1940 and earlier.
Bruce Byland, of Earthwork Archeology, spoke to the Commission briefly
about archeological surveying. He said that it is of immense value in giving
a governing body prior knowledge, thereby lessening dependence upon surveys
conducted by a developer. A survey ensures that developers are not
unreasonably delayed but allows for planning to avoid sensitive areas. Mr.
Byland said that in Mamaroneck Village, he located a site pristine since
Pleistocene times. Plans for a building were altered so that the site would
not be disturbed.
2. REFERRAL
a. Finast Supermarket Expansion (TOM Planning Board referral)
Richard Rheaume, site engineering consultant for Sal Pepe and Ten 5� ")
Grand, Inc. , presented a plan for expansion of Finast Supermarket. Sal F. (0�.
Pepe, of Ten Grand Inc. , attended the meeting. The plan showed an addition to
the north of the present store and an alteration of both the Finast parking
lot and the parking lot adjacent to Boston Post Road. The alteration would
require development in a residential zone and removal of standing trees. Mr.
Rheaume explained that no new parking spaces would be created, but parking
islands would be built, including new trees, both along the Weaver Street
side of the property and the Boston Post Road side.
Commission members inquired about Mr. Pepe's intent regarding land he
owns that is adjacent to the Finast property. Mr. Rheaume said that he knew
of no plans regarding adjacent property.
Mrs. Wittner read aloud a letter just received from Peter Eschweiler,
Commissioner of the Westchester County Planning Office, stating that Ten
Grand Inc. should satisfy a number of criteria, including proof of
justification for encroaching on residential space, before final
consideration by the Town planning board. . Shirley Tolley reminded Mr.
Rheaume that the removal of trees would severely affect the critical
environmental area and flood plain. The property drains into the Hommocks
Salt Marsh CEA, the Westchester County CEA, and the flood area designated on
the National Flood Insurance Rate Map.
After hearing the Finast proposal, the CZMC pinpointed two areas of
concern specifically related to the LWRP: the need for silt traps, which have
the capability of removing oil and grease in the parking lot, and the loss of
a current "wooded" (the applicant's word) residential zone parcel to a
parking lot. The applicant agreed to provide, maintain and clean out

appropriate traps in accordance with specifications provided by the Town
Consulting Engineer. However, the applicant did not offer a plan
to mitigate the loss of the water retention and filtering functions that such
land now provides. Therefore, the CZMC found that one part of the application
was consistent with the coastal zone policies of the LWRP and the other part
of the application was not.
b. Collision Tech, 2430 Boston Post Road (TOM Planning Board referral)
Because the firm did not submit further plans for this application as
requested by the planning board, a memo was sent to the latter stating that
this proposal would not be heard at this meeting. The referral regards two
businesses, one an auto body shop and the other a "fast lube" concern,
located next to the car wash with the new green awning.
3. CHAIRMAN REPORTS
a. Correspondence - Incoming to CZMC:
8/29/90 - Daniel Shuster to Phyllis Wittner: Draft summary of
proposed VOL Waterfront Zoning, corrected and returned.
CZMC members have received the draft; it was forwarded to
the Mayor with a request for distribution to the Board,
heads of clubs, Manor Park Society and John Sann. The VOL
meeting in which the presentation is to be made --
October 1 -- was arranged after a resolution was reached
by the Mayor and Trustees regarding possible conflicts of
interest in board members who are Yacht Club members
and/or live in the proposed new zoning district.
9/11/90 - Richard A. Young: Submitted a clean draft of the proposed
Erosion Sediment Control Law and proposed Surface Water
Control to be added to the Site Plan Approval Law. The
draft had been given to Mr. Silverberg for comments. At
the request of Alan Mason, CZMC members will receive
copies of the documents before they are sent to Laura
Tessier, District Manager, Westchester County Soil & Water
Conservation District.
9/17/90 - Mayor Curnin: Reminder of "Facts of Life in Larchmont"
deadline - this date, 9/25/90.
9/19/90 - Notice of Adopted Scoping Document for the Draft GEIS
for the proposed CR district, Town of Mamaroneck.
Memo from Larry Lowy regarding "Standards for Non-Commercial Docks, "
which the CZMC might want to consider for the LWRP revision, under
o the topic of water use management. Mrs. Wittner appointed Larry Lowy
�.. to look into this topic and to take into consideration the
Underwater Land Use Study prepared for the Village of Mamaroneck.

Correspondence - Copies
8/27/90 - Finding of Inconsistency by VOM CZMC regarding the
Continental View proposal. Also note their
recommendation that "no new structure should be
allowed within 75 feet of a CEA."
9/14/90 - Mark Stellato, of the New Rochelle Dept. of Development
to Claudia Ng: Regarding coordinated review of a
three-lot subdivision at Gaillard Place and Dillon
Road. Mrs. Wittner wrote a summary of the background
of this project for Mr. Stellato.
9/18/90 - Mayor Curnin to Richard Metzner regarding reappointment
to CZMC for a three-year term, September 1990 to 1993.
9/20/90 - Steven Silverberg to Commissioner Thomas Jorling (NYS DEC)
regarding Davids Island, supporting the determination of
Criminal Law Judge Andrew Pearlstein.
b. Other Communication
(1) Dee Sansone of Bonnett Avenue called Phyllis Wittner for
assistance in keeping truck drivers in the Grand Union parking
lot from running their truck engines, and polluting air, for
half-hour and hour-long periods of time. Also, she decried dirt
in the parking area. Cheryl Lewy said that she would follow up
on Ms. Sansone's call.
(2) Jim Townsend, an aide to Nita Lowey, called Mrs. Wittner for
suggestions regarding the need, if any, for wetlands
legislation.
c. Liaison Assignments: The Village of Larchmont Planning Commission
will continue to be covered by Elinor Fredston and Mary Feldtmose
will join her. Town Planning will again be covered by Shirley
Tolley. Mrs. Wittner said that she would like to appoint someone new
to assist with that assignment. Shirley Tolley will also attend CAC
meetings for a period of time.
4. UPDATE ON GARDENS LAKE
Elaine Price reported that Gary Trachtman went again to examine the
silt in the channel built up at the pond. When the channel was created it was
with the idea that it would need scooping out every three to five years or
so. It is ready to be scooped now. Access was built in for equipment so that
the dredging will be cost-effective and not disruptive. Shirley Tolley
suggested that tall grasses be planted for beauty and to discourage geese.
The geese counter any plans for lawns. Studies are being conducted for new
plantings.
7. NEW OR OTHER BUSINESS: Wally Irwin is scheduled to appear at the next CZMC
meeting, October 23, 1990, with proposed LWRP revisions.
