A regular meeting of the Coastal Zone Management Commission (CZMC) was held on October 22, 1991 in Conference Room A of the Town Center, 740 West Boston Post Road, Mamaroneck, New York. The meeting commenced at 8:05 P.M. Members Present: Phyllis Wittner, Chairman • Mary Feldtmose Lawrence Lowy • C. Approved. September 24, 1991 - Correction son pages 1 and 2. Approved. CHAIRMAN REPORTS A. Correspondences - Incoming: 1. 9/23/91 - Mayor Curnin & Larchmont Village Board, RE: Short. & long • term goals of Commission - The Chairman read the response she wrote, dated October 3, 1991, explaining the CZMC's desire to retain its existing consultant line and reducing it by 10% to $9,000. The Commission had no long term goals to propose at this time. 2. 9/25/91 - Charles McCaffrey, Chief, Bureau of LWRPs, Dept. of State, • RE: Thank you letter for organizing the Town meeting of August 21 with local officials and Senator Oppenheimer for Michael Weber. 3. 9/26/91 - Michael Weber, NYS Legislative Budget Analyst, RE: Thank you for site vist. Chairman submitted article on the "what, who and when" of the CZMC for "Larchmont Notes". 3. 10/3/91 - To Town Planning Board, RE: 26 Bonnie Way - Read consistency opinion letter written by Shirley Tolley to Commission. Correspondence - Copies: 1. 10/10/91 - Town of Mamroneck to NYS DEC in Albany, RE: Extension of agreement regarding state funding for Premium dredging project. 2. 10/11/91 - Town of Mamaroneck to NYS DEC in New Paltz, RE: Extension of permit date for Premium dredging project. 3. 10/12/91 - Richard Coico to Mayor Curnin, RE: Lorenzen Park Qbeautification and outstanding job by Dept. of Public Works. CZMC Minutes October 22, ]991 , Page 3 : 0 B. Other 1 . Honmmocks Boom - The Chairman found out that funding is available in ' , this year's budget for a boom and trash trap in the Hom►nocks Marsh. Contract should have been signed by this date with Blasland & Bouck , engineering firm. Ms. Ng was asked to followup in a week or two. , 2. East Creek Boom - Ms. Ng informed the Commission that the boom observed by Angel Martin appears to have been placed by NYS DEC in response to a report of an oil leak from a parking lot on Vine Street. Frank DeVore of the Village knew nothing of the boom, Mrs. Wittner reported. He will check into the debris to determine who would be responsible for its removal. He will talk to Volvo about the dirt near the Creek. Mrs. Wittner asked for suggestion of how to handle this matter with the Town. 3. Reappointments - As indicated at the last meeting, the Town reappointed Howard McMichael, Richard Young, and Phyllis Wittner (as chair) on September 25. Town appointments expire on August. 31, but members remain until appointment or reappointment is made. 4. Larchmont Waterfront Zoning Amendment - passed after public hearing concluded on October 7. The Chairman thanked Elinor Fredston for attending with her. ® 5. CAC/CZMC - Mrs. Wittner met with Louise Perez, new chair for the Conservation Advisory Commission (CAC), Supervisor Silverstone and Councilwoman O'Flinn on October 9 to discuss the roles of CAC and CZMC. She read the list she compiled, showing that most of the original duties of the CAC still remain with the CAC, such as open space management, environmental education, and tree preservation. CZMC assumed only planning and zoning board reviews, because of its mandate to give a consistency response, and wetlands and watercourses as they pertain to permits and LWRP policies from CAC. Mrs. Wittner noted that CAC will handle the storm drain stenciling project. 6. NYS Dept. of State contact person is now Steven Resler. He sent Elaine Price the book "Putting the Public Trust Doctrine to Work" (Mr. McMichael has an extra copy and will donate it to the , Conservation Office) . In addition, Mr. Resler sent to Mrs. Wittner, "Evaluation of Land Use Impacts on Environmental Quality in Urban & , Semi-rural Streams Tributary to Great South Bay, Long Island, New York, " dated March 1990 which is in the Conservation office library. • 7. New books in the Conservation Office: a. The Living Ocean h. Environmental Disputes 8. Pace University Environmental Citizens Action Forum on November 9, • 1991. 0 • CZMC Minutes October 22, 1991 o Page 4 9. 10/17/91 - Mrs. Witmer was invited to the New Rochelle Waterfront Committee meeting. 10. Soundkeeper Signs - first week of November the Village of Larchmont will post 2 signs along Bostin► Post Road, one by Pine Brook, near Tony's Nursery, the other by East Creek, which says: "This river flows to the Sound. Please protect our water. Tnfo: Call the Soundkeeper 1-800-933-SOUND. " The 15" x 30" reflective white metal signs with black lettering and the bolts will be provided by the Long • Island Soundkeeper Fund (Terry Backer) . The municipality is to . provide the pole and publicity. Dr. Mason suggests that these signs • be put up along Brookside Drive as well. MEMBERS'REPORTS/MINUTE Harbor Commission - Mr. McMichael reported that the Village of Mamaroneck Harbor Commission is rewriting its Chapter 210 laws regarding Mamaroneck Harbor. However, they did not mention anything regarding Larchmont Harbor. Mrs. Wittner noted that Section 6 of the Local Waterfront Revitalization Program (LWRP) would be applicable to discuss at a later date under LWRP • Update. © LWRP UPDATE • The Chairman asked for comments on the revised draft she sent out. Only . Mrs. Tolley submitted written comments. Mr. Metzner had a comment with • regard to the format. He felt that it would be easier to follow if the document was enumerated. • Mrs. Wittner also 'asked if the Commission had any recommendations for . improving the consistency review law. Most of the members expressed that • they do not think this law needs to be strengthened. They felt that in the long run it is better to build a consens..s than force acceptance of CZMC's • decisions and chance the buildup of resentment. It was noted that in all of CZMC's history, only twice did the approving agency go against CZMC's advice • (Fenbrook, which was virtually a fait accompli when it was referred, and the Kluge property on Premium Point) . NATURALIST CONSULTANT INTERVIEW Mr. Stephen Coleman appeared before the CZMC. He has 12 years of experience in the environmental field, mostly for non-profit organizations, but in recent years has consulted for some developing agencies. He is experienced in inventorying and site assessments. He is a bird specialist and is knowledgeable in native species. He has also had much experience with freshwater wetlands; not as much with saltwater wetlands, but is familar with 0 the Coastal Program. He can design monitoring programs or a protective r CZMC Minutes October 22, 1991 C Page 5 management plan and help with habitat restoration (he cited his past work on establishing a native prairie on an old landfill site) . He has lived in New York for 8 years and is familiar with the Westchester area, having worked for 3 years as director of Teatown Lake Reservation in Ossining, for the Nature Conservancy in Mamaroneck, and for Butler Sanctuary in Mt. Kisco. His charge is approximately $40 per hour, but he prefers to work on a project basis. He is highly recommended by Tracy Kay, director of Rye Nature Center. . Mr. Coleman asked for an idea of what CZMC wanted to accomplish with a ' naturalist, to which the Commission explained the following: 1. Inventory of the three conservation areas in town--biological and botanical. (He said that he was familiar with natural resource inventory maps. ) • 2. Site-specific recommendations for mitigation and buffers. 3. Restoration and enhancement of habitats, such as Critical • Environmental Ares. Mrs. Wittner, Mrs. Tolley, Dr. Mason and CAC Chairwoman Louise Perez will • meet as a subcommittee on November 13 to outline the Commission's main goals/concerns. Dr. Mason then recommended paying Mr. Coleman to do a brief tour of our area with a few CZMC people so that he could fine-tune the work that would need to be done to accomplish those goals or alleviate the . concerns. • NEW OR OTHER BUSINESS Coastal Erosion Hazard Areas - New York State Department of Environmental Conservation will be holding a public information meeting on the new management regulations on October 29 at 7 p.m. in the Town Center.
