A regular meeting of the Coastal Zone Management Commission (CZMC) was held on November 27, 1990 commencing at 8:05 P.M. in Conference Room A of the Town Center, 740 West Boston Post Road, Mamaroneck, New York. Members Present: Phyllis Wittner, Chairman Richard Coico Elinor Fredston C. Alan Mason Richard Metzner Shirley Tolley Richard Young Others Present: Wallace Irwin Jr. ,Consultant James G. Johnson,Jr, .Friends of the Reservoir Mary Anne Johnson, Former Member Angel J. Martin, Prospective Member Claudia Ng, Environmental Coordinator Lillian Sellers, Secretary MISCELLANEOUS Mrs. Wittner reported that two CZMC members explained their absence: Howard McMichael who advised that he would like to be involved with the Local Waterfront Revitalization Program Update and Larry Lowy who broke his arm but will be back soon. LOCAL WATERFRONT REVITALIZATION PROGRAM (LWRP) UPDATE A new draft of the LWRP Update, dated November 19, 1990 was previously distributed to the CZMC. Mr. Irwin reiterated that the intent of revising the LWRP is to bring it up-to-date and clarify or enhance local policies and reflect any change in goals which would require bi-municipal commitment. As an "enhancement",the Update would probably just have to go to the local municipal boards for approval. Mrs.Wittner emphasized that one of the important initial elements for discussion is how best to organize the Update. She referred to Mr. Irwin's November 19th draft as what seems to be the best way to approach the Update. Rather than attempt to update the LWRP chronologically, she supported Mr. Irwin's suggested basic format: a brief historical introduction, Part 1: Area-wide Matters, Part II: The Premium-Pine Brook Area, Part III: The Sheldrake Area and Part IV: The East Creek - Hommocks Area. CZMC Minutes 11/27/90 . Mr. Irwin pointed out that he had only submitted a thumbnail sketch draft pending the CZMC's input. He stated that perhaps the Commission is contemplating actions which thus far have received no coverage. It was also • noted that the chart on Page 87 of the LWRP should be revised and included in the LWRP Update. Mrs. Fredston stated there may be a need for a map. She suggested • the inclusion of consistency referrals in the Update. It was Mrs. Wittner's feeling that since all consisteu y referrals sinic;e the CZMC' s inception ire • detailed in they Annual. Reports. that should he sufficient.. • Mr. Irwin pointed out that while there is less detail in the Annual. Report. (in reference to the Premium area, for example, there is indeed more • extensive data to be noted) , one of his goals is to make readers aware that none of these watersheds is completely self-contained. He pointed out he • was generalizing and trying not to editorialize. Mrs. Wittner added that in reading the first paragraph on the Pine Brook Premium area, she had an immediate reaction - "No editorializing. " The Chairman asked for comments concerning the format Mr. Irwin presented, • and asked the Commission to decide whether they are in agreement with it. • Mrs. Tolley commented that by properly laying the initial groundwork, it will simplify future updates because one will only need to amend the existing • sections instead of having to write entirely new ones. ANNUAL REPORT Mrs. Wittner has the Third Annual Report in her computer. She has begun the • Fourth Annual Report but requires help. For the past 2 years, an editor was hired. She said that could be done again or, if the Commission agreed, the • subjects could be divided among the members and written in that manner. She emphasized the fact that the Report, as she has compiled it to date, • definitely requires work. The Commission agreed to participate in writing the document. It was Mrs. Tolley's comment that we should consider getting • an editor to give the document its final polish. APPROVAL OF MINUTES The October minutes were approved. • CHAIRMAN REPORTS • A. CORRESPONDENCE - INCOMING • 1) 11/7/90 - Cora Rust, Chairperson re: Human Rights Commission Awards Nomination. • 2) Stormwater Management Guidelines for New Development - NYS DEC - forwarded by VOL Clerk in October. -2- • • CZMC Minutes 11/27/90 • 3) 11/20/90 - Joseph Morgan, VOL Engineer re: Sewer hookup request by Dr. Robert Leaf from Premium Point (TOM) to Pryer Lane (VOL) . The Chairman would like to ask for a postponement until the Town of Mamaroneck Building Inspector and Engineer refer a complete • application. Since the CZMC won't meet again until January, she asked if this is o.k. , or should the CZMC submit an opinion just on • habitat basis? The Commission agreed to request a postponement. 4) On November 1, material was received relevant to the 1987 NYS designation of Significant Fish and Wildlife Habitat fo r or the Premium River - Pine Brook Wetland s Complex. Mrs. Johnson spoke about a strong smell of gas on "Red Bridge", • located at Pryer Manor Road. The bridge has two holes on top of the wall that may be due to the recent work done there by Con Edison. • Mrs. Wittner agreed to call Con Edison the following morning. • CORRESPONDENCE - OUTGOING • 1) 11/2/90 - Collision Tech consistency opinion. • 2) 10/29/90 - to Laura Tessier, District Manager, Westchester County Soil and Water Conservation District re: Review of proposed Erosion • & Sediment Control law. (Also see County Budget Cuts below. ) A draft of the proposed law was sent to her for review. In response • to a follow-up phone call, Ms. Tessier promised to review the draft. However, she advised it might take at least a month or so • ----- before she could do so. • COPIES 1) Rye City Councilman George Latimer to "New York Times" relevant to • Davids Island editorial. 2) 10/22 - Mrs.Tolley sent two letters to The Editors of the "New York • Times" responding to their editorial about Davids Island. • 3) 10/31 - Deputy Mayor Cheryl Lewy to "NY Times" re: Davids Island. B. BOARD OF ARCHITECTURAL REVIEW (BAR) Mrs.Wittner stated that a public hearing would be held on December 5 for the proposal to create a BAR for the commercial district. Elaine Price referred the proposed BAR law on November 9 and requested comments by November 23. Since the CZMC did not meet until the 27th, Mrs. Wittner submitted her own comments. However, she welcomed comments that she would read into the record at the public hearing. Mr. Metzger commented on • there being only one architect required out of the five members to be appointed. The importance of BAR appointees being well qualified was • voiced by several CZMC members. Mrs. Tolley discussed the fact that we should know more about what the actual duties of the various Boards are, and that thus far it appears -3- CZMC Minutes 11/27/90 these duties overlap one another. She said we still are not fully aware if the BAR is going to look at signs. It looks as if they want to have an ordinance for common design. She commented that the Sign law may need amending in order to achieve appropriate design. C. PROPOSED ZONING AMENDMENT - TOM Mrs.Wittner asked if there were additional comments on the CZMC's proposed Zoning Amendment concerning Special Use Permits in the Service Business (SB) District in the Town of Mamaroneck. Mrs. Wittner referred to Item D in the Village of Larchmont Law which forms the basis for the proposal. It states that all vehicles should be kept in fully enclosed structures. The Town Attorney does not believe this is enforceable. He suggests instead some kind of buffer requirement. Mrs. Tolley suggested that the cover letter accompanying the CZMC request reflect the fact that the SB district is in a Critical Environmental Area and requirements are needed to mitigate the effects of toxic and non-point pollutants from entering our wetlands and waterways. D. NYS PUBLIC HEARING Mrs. Wittner reminded all present there was to be a review of the Department of State (DOS) to be held by the U.S. Department of Commerce on November 29 at 7:30 P.M. in the Village of Mamaroneck. Details can be found in the public Notice regarding the name and address for written statements. She urged members to attend. COUNTY BUDGET CUTS Mr. Johnson spoke to the CZMC regarding an item before the County Budget and Appropriations Committe to cut the budget by abolishing the Westchester County Soil and Water Conservation District and by cutting the Parks Department staff. He encouraged everyone to attend one of the two public hearings. All sessions are open to the public but the public is only allowed to speak at these two hearings. He urged people to write or call County Legislators and members of the Budget and Appropriations Committee before the third of December. MEMBERS REPORTS/MINUTE TOM PLANNING BOARD: COLLISION TECH Mrs. Wittner stated that both she and Mrs. Tolley wrote a long consistency opinion letter about the many problems encountered with this application and that of Louis Vitiello. The information submitted by the applicants was sparse and incomplete and therefore a consistency opinion could not be rendered. -4- CZMC Minutes 11/27/90 Mrs. Tolley stated that Fred Kellogg was hired by the applicants as their engineer. At the Planning Board, he explained away various points in the CZMC's letter, but nevertheless, Collision Technology agreed to take care of various CZMC recommendations. Mr. Kellogg did agree that storm drains from the property go directly into the Premium Marsh. Mrs. Tolley went on to say that subject to the following conditions, the application could be found to be consistent: make the spray-painting booth watertight to prevent contaminants from entering the floor drains; install appropriate oil containment devices in two of the rear parking lot drains and periodically clean them. It was agreed by the Planning Board that if the Town Building Inspector found that the latter requirements were not carried out, they would have to install more sophisticated devices. It was further recommended that Collision Technology remove the trash, other debris and old auto parts from their rear parking lot, and that some agreement be reached with the Town with regard to a dirt embankment which constantly erodes and carries sediment into the parking lot drains. Based on these stipulations, a letter of consistency would now be written by the CZMC to the Planning Board. VOL PLANNING COMMISSION: VOLVO SITE PLAN Mrs. Fredston stated that the Planning Board approved this expansion with certain conditions. A No Left Turn and Stop Sign would be added. She pointed out there are many dead trees there and the Parks Commission should look into exactly what trees would grow there. The Parks Commission will review the Shading/Landscaping Plan. The Planning Board also began to review the CZMC Waterfront proposal and have raised many questions. GOLF COURSE STUDY - TOM Mr. Mason stated that Malcolm Pirnie, Inc. , is doing the hydrological study portion of the GEIS for the Town's proposed Conservation-Recreation Zone for golf courses. He mentioned that he gave them raw data to both analyze and evaluate. Mr. Mason also spoke about a 1,500 ft. sewer line at the Reservoir which will run from the Westchester Water Works Plant past Lhe caretaker's house to the Weaver Street line. The Westchester Joint Waterworks will put up most of the funding. ENVIRONMENTAL COORDINATOR REPORT Ms Ng mentioned that the Colonial Village Shopping Center zoning change has been approved. The meeting was adjourned. Per tradition, the December meeting has been cancelled. The next CZMC meeting will be held on January 22, 1991. -5-
