MINUTES
MAY 28, 1991
A regular meeting of the Coastal Zone Management Commission (CZMC) was held
on May 28, 1991, in Conference Room A of the Town Center, 740 West Boston
Post Road, Mamaroneck, New York. The meeting commenced at 8:05 P.M.

REFERRAL: SUBDIVISION - 26 BONNIE WAY
An application to subdivide 26 Bonnie Way into two lots was referred by the
Town Planning Board as a Type 1 Action because of its connection to a stream
which is part of the Critical Environmental Areas as well as the Freshwater
Wetlands and Water Courses network. The owner of the property, Mr. Paul M.
McCarthy, and his attorney, Mr. Thomas R. deRosa, were present. Mr. McCarthy
said that it had originally been designed as two lots, but a previous owner
had merged them. Now he just wants to return it to its initial state.
The Commission reviewed the topographic survey and grading plan, dated
7/1/90. The attorney emphasized that the applicant currently has no plan to
build a house; the design on the map is strictly hypothetical and was done at
the request of the Planning Board to assist in visualization. The Commission
noted that although they may have no site plan, it must be reviewed in such a
manner, because under Town law, once it has received its designation as a
separate lot, it can be built upon without further review if it meets all the
existing codes. Any concerns or constraints must, therefore, be addressed in
the subdivision resolution.

The Commission asked for further elaboration about the grading and
drainage. Mr. deRosa explained that the swale would be filled in to create a
gentle slope with the eastern side of the property which now has a retention
wall. They anticipate making the driveway out of gravel to assist in
percolation.
When asked about the behavior of drainage, it was noted that water comes
down from the conservation area into a drainage pipe at the end of Bonnie
Way. If surcharged, then the water overflows onto the street and enters the
McCarthy property making its way to the stream in back, instead of going into
two catch basins on the street. The attorney noted that this may, therefore,
be a design problem and not the responsibility of his client.
Dr. Mason redirected the drainage question to what drainage changes would
result from the development of a single-family residence on the property
itself, noting that there is a Town policy for zero increase in the rate of
runoff leaving the site. Dry wells would not work on this land. A detention
system would most likely be called for here. Mr. deRosa responded saying
that the house would sit primarily on the protruding rock, so according to
their engineer, Mr. Sinopoli, little change in runoff is anticipated. Dr.
Mason asked for the engineering analyses to substantiate the claim. Mr.
Martin emphasized the problem of incremental increases from development.
It was noted that the land behind the rock is forested. Neighboring
resident, Mr. Ladner, added that some trees there were fairly large,
indicating that substantial soil must be present to accomodate them. He
further mentioned that every property from 26 Bonnie Way to Weaver Street is
wet after a rain. The other residents present, who are "in the wake" of
these drainage problems, voiced similar concerns, urging that nothing be done
to aggravate this situation.
The Commission questioned how the house would be built and whether
blasting would be needed, to which Mr. deRosa said that the part of the house
on the rock would have a crawl space and the garage in back could be below
the house and that jackhammers would be needed to level the rock a couple of
feet.
CZMC decided to table conclusion of its comments due to insufficient
information. The Commission will return to the matter at its next meeting
pending submission of the drainage information to the Town engineer. Mrs.
Tolley will draft the letter to the Planning Board advising them of same.
APPROVAL OF MINUTES
The minutes of April 30, 1991 were approved.

CHAIRMAN REPORTS
A. Correspondences
Incoming:
1. NYS DEC "Erosion & Sediment Control Guidelines for New Development"
- copies were passed out to the Commission.
2. 5/6/91 - Town of Mamaroneck notice of Arbor Day celebration on
on May 11. A tree was planted in honor of retired Highway
Superintendent Tom Leddy.
3. 5/6/91 - Letter from Mayor Curnin informing the CZMC that they
missed the Volunteer Recognition Ceremony. Pins were given to all
Larchmont volunteers.
4. 5/8/91 - Notice from Mayor Curnin indicating that the deadline for
articles for Larchmont Notes is May 31. Richard Coico volunteered
to submit an article on restoration at Lorenzen Park.
5. 5/15/91 - Mayor Curnin copied CZMC on a letter signed by several
Sound shore community officials to the Governor supporting the
l" retention of Gail Shaffer as head of the Coastal Management Program.
6. 5/20/91 - Lt. Governor Stan Lundine's announcement of the upcoming
Governor's Task Force on Coastal Resources Conference. The Chairman
will attend. She asked if anyone else was interested in attending.
Mrs. Tolley reported to the Commission that County Executive Andrew
O'Rourke wrote a letter to the Governor supporting the Davids Island
development.
7. 5/21/91 - Richard Coico letter updating the CZMC on the restoration
of Lorenzen Park. Mrs. Wittner noted that one of the suggestions
made by the wetland specialist was to remove boulders at the edge of
the field next to the water to increase the wetland area. Mary Anne
Johnson brought up a very important factor, which was verified by
Village Engineer Joe Morgan, that some of these boulders are holding
back the fill that created Lorenzen field. Mr. Coico reported that
the Village of Larchmont Parks and Trees Committee met with Tony's
and Larchmont Nurseries. The Village negotiated purchase of 42
trees: Norway Spruces, Austrian Pines, Dogwoods, Crab apples etc.
Two landscape architects helped layout the plantings which will be
done shortly. Mrs. Wittner commended the Village on its great job
of cleaning up the area and improving parking. Volunteers also
helped with improvements. Little League involvement in
maintaining/cleaning up the area was encouraged.

B. Other
1. DGEIS for Golf Club Properties - There will be a special meeting of
the Town Board on May 29 to declare the completion of the Draft
Generic Environmental Impact Statement on the proposed Conservation-
Recreation zoning for the golf club lands. The documents will be
available for public review the following day. Public hearings are
scheduled for June 17 and 18, and July 1st. Deadline for written
comments is July 15. There are limited copies for distribution, so
division of the various volumes among the members was discussed.
Lawrence Lowy and C. Alan Mason agreed to review the hydrological
sections. Mrs. Wittner requested that members bring written
comments to the June CZMC meeting.
2. Westchester Water Quality Monitoring Volunteers - Long Island Sound
Taskforce is sponsoring a training session for new citizen water
monitoring volunteers on June 22. The Chairman expressed the
thought that homeowner associations should adopt their local
streams.

ENVIRONMENTAL COORDINATOR REPORTS
Claudia Ng informed the CZMC of a notice she received from the American Water
Resources Association which was arranging a conference to improve cooperation
among water-related organizations.
MEMBERS' REPORTS/MINUTE
Larchmont Planning Commission - Mrs. Fredston reported that the Planning
Commission is reviewing the Village's old parking regulations because they
are based on lot size instead of the square footage of the building.
A retail office building is being proposed at the old gas station on
Palmer Avenue. However, there appears to be oil tank problems.
The Commission is also reviewing the provisions for car dealerships.
Although a special permit is required under current zoning laws, the
regulations need to be tightened with regard to loading areas.
Mrs. Price mentioned some of the car dealerships that are planning to
come into the Town on Boston Post Road: Saturn plans to move in where the
old Tristar Jeep used to be and Lexus wants to replace Tristar Ford.
Board of Architectural Review - Mr. Metzner reported that the only thing
of interest at the last meeting was the Town's plans to plant trees along
Boston Post Road between Blockbuster and Dunkin Donuts. The BAR wanted to
see the overall plan.
Village of Larchmont Zoning Board - Mrs. Wittner mentioned that the
Village's Zoning Board has a lot of items on their agenda which might be of
concern, particularly the Abadir house which has excellent views of Long
Island Sound. Mr. Metzner volunteered to go to that meeting.
Old Hory Property - Mrs. Price mentioned that the owner will continue
construction despite the uncertainty of Nynex, which was supposed to move in
to sell cellular phones.
