MINUTES
JUNE 26, 1990
• A regular meeting of the Coastal Zone Management Commission (CZMC) was held
on June 26, 1990 in Conference Room A of the Town Center, 740 West Boston
Post Road, Mamaroneck, New York. The meeting commenced at 8: 10 P.M.

ADMINISTRATIVE MATTERS
Appointment - Richard Metnzer, the newest appointee to the Commission,
was introduced by Phyllis Wittner. Ms. Wittner by way of introduction
mentioned that Mr.. Metzner holds a Bachelors Degree in Civil Engineering and
a.Masters in both Business Administration and Architecture. She also noted
that he is a practising architect.
Approval of Minutes - The minutes of May 22, 1990 were approved pending a
minor correction on page 4.

LOCAL WATERFRONT REVITALIZATION PROGRAM (LWRP)
In the fall of 1989, Wallace Irwin Jr. , former Co-Chairman of the CZM
Committee and former member of the CZMCommission, was retained to work with
the CZMC and write revisions of the LWRP. Mr. Irwin was in attendance on
June 26 and requested input from all members regarding issues which they felt
required attention. Ms. Wittner informed the Commission that she had spoken
with Randy Lanza, of the Department of State (DOS) , and he suggested a page
amendment to the document rather than a whole rewrite. Mr. Irwin agreed
stating that the LWRP in and of its self is a historical document and
therefore should be amended rather then altered. Ms. Wittner then referred
to a memo she sent .to all members on February 16 which contained a
preliminary revision list. After discussing the contents of the memo and
additional concerns, Mr. Irwin stated that he felt the task of revision
consisted of 2 steps. 1> listing the topics requiring amendment (see Feb. 16
memo) with an outline of resolutions; 2> the actual writing. Ms. Wittner
noted than all substantive revisions of existing policies required approval
of both Boards. Also during this discussion C. Alan Mason noted that the
• Army Corps of Engineers will be returning with a scaled down project for the
• Sheldrake River. Since the Commission felt that the Feb. 16 memo was fairly
complete in its assessment Mrs. Wittner asked Mr. Irwin to begin writing so
that a specific topic could be discussed at the next scheduled meeting.
CHAIRMAN REPORTS
III Smoke Testing - Mrs. Wittner noted that the study of storm water
ltrating into the sanitary sewer system has been completed for the Town
and Village owned properties. The problem areas concerning individual
property owners has not been addressed.
Historic Preservation - Mrs. Wittner informed the Commission that she had
scheduled two speakers to address the issue of historic preservation for this
meeting. She said that they requested a postponement to August. The CZMC
requested that the talk be scheduled for September.

UPDATES
SListen to the Sound - National Audubon 6/14/90. Mrs. Wittner noted that
she and Mrs. Tolley attended the Conference and had both testified. Mrs.
Wittner also responded, at a later date, to remarks made about oil in the
Premium which were not based on fact. She stated that they had heard
excellent testimony and cited Barbara Dexter's advocacy of regional, close to
shore water quality testing.
County Critical Environmental Area (CEA) Recommendations - Mrs. Wittner
thanked Shirley Tolley for researching and drafting comments. Mrs. Wittner
wrote Diane Keane again on 6/15/90 referencing her letter of 4/23/90,
requesting County CEA Designation for the entire Hampshire Country Club and
procedures for an intergrated review of inter-municipal CEA's
TOM Proposed Conservation-Recreational Zone - The TOM Board held a
scoping session on June 6, 1990. Mrs. Wittner thanked Mr. Mason for his
"unequivocal statement" and requested that he submit it to the office for the
files. CZMC members have received a copy of Mrs. Wittner's statement. She
also noted that the consultants, Ferrandino & Associates, were hired.
Premium Project - An update meeting (Gary Trachtman and Anthony Russo
representing Malcolm Pirnie with Stephen Altieri and Phyllis Wittner) was
held on 6/20/90. Landowners in the area were notified of the impending
surveying required before dredging. Mrs. Wittner also noted that the
proposed disposal site for the dredged material fell under the Connecticut
S
Department of Environmental Protection and the New England Corps of
Engineers. She said that 3 foot cores of soil samples had been taken and it
would be determined at a later date if more is required. Also the Tidal
Wetlands permit should be submitted by the end of July. State Environmental
Quality Review (SEQR) recommendations are to be made by the Town Board at
their next scheduled meeting (July 16). She noted that it will be referred
to the CZMC for consistency review at the July 24th meeting.
The preliminary concept and bidding process will he prepared for the 7/16
meeting with subsequent review by the Board. The proposed schedule is as
follows: bids advertised Oct. 15, received Nov. 15, with the contract
awarded by 11/21, and the project commencing by Dec. 1.
Waterfront Zoning - On 6/18/90, the Village of Larchmont Board of
Trustees received a draft local law implementing the CZMC's recommendations
re: Waterfront Zoning. Mrs. Wittner distributed copies to all those present
and requested that they attend the Board's July 2, 1990 meeting to be present
during the discussion and respond to questions if necessary. She noted that
a public hearing would not occur before September.
Stencil Storm Drains - A proposal was received by Mayor Curnin and
Supervisor Silverstone from Mary Anderson and Melissa Baristain of the
Cornell Cooperative Extension on behalf of the Long Island Sound Study to
have storm drains painted with a appropriate slogan to deter people from
illegally pouring oil or other pollutants into the storm drains. Mrs.
Wittner proposed endorsing the program because "pollution prevention works;
IIpollution control is sometimes second best that often does not work". The
CZMC agreed to an endorsement with the following recommendations: 1 . Use of

visual as well as written message for stencil with something to indicate that
Sleaves and grass clippings do not belong in the drain (Alan Mason) 2. Better
publicity and education regarding law requiring establishments that generate
500 gallons of oil annually to accept used oil for recycling (Richard Young) .
MEMBER REPORTS
Town Planning Board - 26 Bonnie Way - Shirley Tolley noted that the
property located at 26 Bonnie Way is a narrow lot which contains a tremendous
rock. Her suggestion was to elicit the help of a consultant before making
recommendations and Ms. Wittner agreed stating that the property contains a
"impossible rock situation", a valley which must be a water collector.
Claudia Ng was asked to alert Steve Tomecek to the possible need for his
services.
Village of Larchmont Planning Commission - Mrs. Wittner and Larry Lowy
both covered the June Meeting for Elinor Fredston. The following was
discussed: 1) a request for removal of 3 trees at 30 Park Avenue, a site
which had restrictions placed on it; 2) the archeological study commissioned
by St. John's Church was accepted. The Planning Board questioned the depths
of pits dug and whether or not water was found. The Board will be requesting
rock & water testing to see if a dry well will work. Mr. McMichael
interjected and said that, as of yet, no rock has been found but, water has
been encountered.
Town Council Meeting - The Chairman stated that she questioned the Town
• Council about the status of the Hommocks Boom Project to catch trash and oil
and was told that the item would have to wait until next year's budget.
ENVIRONMENTAL COORDINATOR REPORTS
Proposed New TOM Litter Law - Claudia Ng informed the Commission that the
Town proposed to eliminate the registration process for distribution of
notices by individuals. The proposed law does not include the
recommendations of the CZMC. She said that enforcement of the law would be
left to the Building Inspector. She also noted that the law is targeted
towards ad litter and not garden dumping because the Town already has a
dumping law that was passed in December of 1987. The Town Board expects to
hold a public hearing some time in September. This gives the CZMC additional
time to make recommendations. The chairman asked Shirley Tolley to review
the half a dozen or so existing Town laws touching on the subject of litter
for further discussion.
NEW OR OTHER BUSINESS
Davids Island - Elaine Price said that she will be in Washington on
Thursday addressing the Davids Island issue. Elinor Fredston informed
members that there is a demonstration flotilla scheduled for Saturday at 11
a.m. in opposition to Davids Island. She noted that they hoped to attract
800 boats or more and said to contact Nick Rey if the weather was
questionable.

the Town Center at 8:00 P.M.
