HomeMy WebLinkAbout1992_01_28 Coastal Zone Management Commission Minutes APPROVED Town of Mamaroneck — Village of Larchmont COASTAL ZONE MANAGEMENT COMMISSION TOWN CENTER: 740 West Boston Post Road, Mamaroneck, NY 10543 914-381-7845 MINUTES JANUARY 28, 1992 A regular meeting of the C'nastal Zone Management Commission (CZMC) was held on Tuesday, January 28, 1992 in Conference Room A at the Town Center, 740 West Boston Post Road, Mamaroneck, New York. The meeting began prcxtpLly at 8:05 p.m. Members Present: Phyllis Wittner, Chairman Richard Coico Mary Feldtsnose Elinor Fredston C. Alan Mason Richard Metzner Shirley Tolley Richard A. Young Others Present: Robert U. Alonzi, Superintendent, Winged Foot Golf Club Ellen Morse, Recorder Referral: Winged Foot Golf Club - TOM Planning Board - Type 1 action (CEA) for Freshwater Wetlands and Watercourses permit. Mrs. Wittner noted that she and Mrs. Tolley visited the golf club, as had Ms. Ng at another time, and Mr. Alonzi was most informative. Robert Alonzi appeared before the commission members and explained his proposal to replace the underground gas tanks installed ten years ago with above ground gas tanks. He indicated his concern for the safety of the public and the environment as a reason for replacing the tanks becatls it is very difficult to detect an underground leak until it is too late. Depending on which type of tank is used, there would be either a 20 or 30 year warranty. Design of the tanks was briefly discussed. Mrs. Wittner explained the detailed procedure that is followed for the removal of underground tanks which she learned from Mr. Alonzi. When asked about the visibility of the tanks, Mr. Alonzi said they would neither be visible from the golf course nor to the neighbors. He suggested planting shrubs around the tanks. When asked how the tanks would rest on the ground, he replied they need a 6" reinforced concrete slab. He also mentioned that N.Y. State approved this type of tank. Dr. Mason asked if there were a containment area around the tanks. Mr. Alonzi replied there was not and none was required. He mentioned that Nick's Electric will be responsible for the electricity to the pumps which will sit on top of the tanks. It was asked if there was any provision for fire control, such as extinguishers or a built-in system. Mr. Alonzi replied that he does not believe there is nor is one required. All they have is a detection sensor. Mrs. Wittner stated that CZMC will write a letter on the consistency opinion to the Planning Board and will send Mr. Alonzi a copy before he is to appear before the Planning Board. Mrs. Tolley offered to write the letter. APPROVAL OF MINUTES Minutes: The minutes of November 26 were approved after corrections on page 5 and other minor changes. CHAIRMAN'S REPOKlb A. Correspondences - Incoming: 1. 1/14/92 - Mayor Curnin, RE: '92-'93 Budget. The Mayor once again requested that everyone propose strict budgets for '92-'93 as they did in '91-'92. No new projects should be introduced unless its costs have been met through equal reductions elsewhere. MLS. Wittner is not sure this applies to the CZMC now since CZMC's budget is done under the Town and the Village shares in it. CZMC has already taken a big cut in its only discretionary line, the Outside Consultant line. 2. 1/14/92 - Shirley Tolley's letter Re: Draft of NY State Open Space Conservation Plan by the Office of Parks, Recreation and Historic Preservation (OPRHP) . On December 20, 1991 the Mayor forwarded the Notice of Receipt of that document to Mrs. Wittner. Mrs. Wittner did not spend too much time reviewing it as Ms. Ng told her CAC would be responding to it. Only two areas in the document pertain to our area - Bonnie Briar and Davids Island. On January 21, 1992 Mrs. Wittner received a blind copy of Councilwoman O'Flinn's letter to the NYS OPRHP. She made very good points such as not having enough time to review the document, and the non-inclusion of the list of 133 projects in Westchester County which were considered before they only selected Bonnie Briar and Davids Island. 3. The League of Women Voters is having a midwinter luncheon on Febniary 4, 1992 at 11:30 a.m. at the Wainwright House. Kathryn Clarke is the speaker. CZMC Minutes January 28, 1992 Page 3 B. Correspondences - Outgoing: None other than the LWRP Update and the Annual Report. C. Correspondences - Copies: 1. 12/30/91 - Supervisor Silverstone to Elizabeth Sluder, Chairman of the EMC, Re: Forwarding CZMC's comments about EMC's Water Resources Policy, Part 1 - Water Quality. 2. 1/8/92 - County Legislator George Latimer to Mayor Curnin Re: Introducing himself and encouraging people to contact him. 3. 1/9/92 - Stephen V. Altieri to William Steidle, Deputy Regional Permit Administrator at DEC, New Paltz requesting change in dredging window fLcul DEC's Oct. 1, 1991 through Nov. 30, 1991 to conform with federal agencies determination of Oct. 1 through Jan. 25, 1993 and to extend the overall permit to March 31, 1993. (Mr. Steidle has replaced Larry Biegle at DEC.) D. Other: 1. "Don't Dump" signs were posted at Pine Brook/Premium River and East Creek on 12/11/91 due to the efforts of Trustee Lewy and the Village of Larchmont Engineer, Joseph Morgan. Mrs. Wittner passed around an article published in the local newspaper on the "Don't Dump" signs. She had suggested to Trustee Lewy that a fine of $1,000 be imposed for those people caught dumping into our waterways. Right now it is only a $250 fine. Mrs. Wittner asked if the CZMC is interested in her fine proposal. The Commission did not want to pursue the proposal at this time. 2. Mrs. Wittner attended the Village of Larchmont Board Meeting on January 6, 1992 to hear Syrette Dym, the Planning Commission Chair, present their Annual Report to the Mayor and Trusties. Chair Ism commented that it has been the lightest year in the 10 years that she has sat on the Board. Long range items the Board is thinking about are the need for parking around the station area and the opportunities that exist on North Ave. near the station, and the placement of street trees, their types, and the possible use of County Community Development funds. 3. Horseshoe Harbor Yacht Club sent a letter stating that Phyllis Wittner would be recognized at their annual dinner dance for her role as Chairman of the CZMC. 4. The motions of the "Governor's Task Force" document incorporated scene of the CZMC's suggestions and recommendations into their final report. The latter is well worth reading. • CZMC Minutes January 28, 1992 Page 4 HIRING CONSULTANT At the last meeting it was decided to have a subcrmmittrr go out in the field with Steve Coleman, the prospective naturalist consultant, to -Inc, how he works. Mary Ann and James Johnson, Irma Volk, Louise Perez, Martha Kaufman, Claudia Ng and Shirley Tolley walked the Sheldrake area and came away with positive opinions. Mrs. Wittner then contacted Mr. Coleman and asked him to send in a proposal, which she then read to the Commission. There was a motion to hire Mr. Coleman which was acrppted. Mrs. Wittner will send a copy of his proposal to Louise Perez, the CAC Chair, and Edgar Lehman, President of the Friends of the Reservoir, informing them of CZMC's decision. FIFTH ANNUAL REPORT Mrs. Wittner was scheduled to make her presentation of the CZMC Annual Report to the Village Board on January 27, 1992 and postponed it as the report is not ready. She is now scheduled for February 24th. She requested that anyone who had comments submit them to her now. EROSION AND SEDIMENT CONTROL Gary Trachtman's copy of the Erosion and Sediment Control document was received just before tonight's mooting. Mrs. Wittner gave the text and meter disk to Mr. Young for his review. She also asked Mr. Young to note that SyLette Dym should receive a copy when CZMC circulates the document. GENERIC ENVIRONMENTAL IMPACT STATEMENT - CR ZONE A supplement (SEIS) is being done partially by Ferrandino and Associates and by local volunteers. Volunteers will be used because of the prohibitive cost if Ferrandino prepares the whole report. CZMC has been asked to do the "Wetlands and Terrestrial & Aquatic Resources" sections and the "Conformity with the CZM-LWRP-Town Master Plan" section. Mrs. Wittner thinks that in addition to corroborating the bird and plants lists she has already prepared, Mr. Coleman will be most helpful with the first section. The draft of the fits L two sections is due March 9, 1992 and the final by March 30th. The Master Plan section draft is due March 16, 1992 and the final by April 13th. Mrs. Wittner suggested working in subs mmittoP format. Shirley Tolley and Richard Young volunteered to work on the draft with Mrs. Wittner and help fruit Dr. Mason. • LWRP SUPPLEMENT Regarding the LWRP Update, Mrs. Wittner received comments from Mayor Cumin, Cheryl Lewy, Angel Martin and Wally Irwin. Mrs. Wittner then read Mayor Cumin's positive tents dated January 24, 1992, other • 'fit �Gcaz"•-cw- CZMC Minutes January 28, 1992 Page 5 corrections, and some conments from Mr. Irwin. The Commission reviewed Mr. Irwin's comments and decided not to incorporate much of the history he proposed. Dr. Mason said he would read the supplement for Mrs. Wittner. The Commission said it was not necessary to resubmit the supplement to them and for Mrs. Wittner to go forward with it. NEW OR OTHER ITEMS A. Councilwoman Elaine Price asked if CZMC wanted to input into the nitrogen cap solutions/problems for the L.I. Sound study. Dr. Mason said he would speak to her on Friday. B. The term of the Town of Mamaroneck members of CZMC officially expires on August 31, 1992, and the Village of Larchmont term expires on September 30, 1992. Mrs. Wittner asked the Commission members if she should request a change for the Town fl m August to September so the two are simultaneous. The members agreed that it was not worth changing. C. Congresswoman Nita Lowey's Environmental Advisory CarmnittPP will digcnss issues facing the 102nd Congress on February 10, 1992. The CZMC Chair is a member of this coYmnittPe. I E RS' RE POK15 Mrs. Fredston commented on the VOL Planning Board. They are looking for suggestions from all various boards and commissions regarding the Community Block Grant. It is wide open to what they will do. Board of Architectural Review (TOM) - Mr. Metzner reported that the Board of Architectural Review had only two applications. He also noted that the boom was put back into Pine Brook. The boom at Post Road was loose and they have fixed it. It needs to be cleaned out now. Town of Mamaroneck Planning Board - Richard Young reported that the Board approved the Finast extension. Regarding 26 Bonnie Way subdivision, Mrs. Tolley reported that the owners of the subdivided property will install a culvert froin Bonnie Way across that property and across the McCarthy property which will carry rainwater overflow to the stream at the rear of the property. This will be an easement 10 feet wide, which the new owner and the owner of the McCarthy property will grant to the Town. They will also be required to install dry wells on the new subdivided property. Mr. Young reported that the Nautilus dinner has new owners and they have not gotten a permit yet.
