MINUTES JANUARY 22, 1991 A regular meeting of the Coastal Zone Management Commission (CZMC) was held on January 22, 1991 in Conference Room A of the Town Center, 740 West Boston Post Road, Mamaroneck, New York. The meeting commenced at 8: 10 P.M. Members Present: Phyllis Wittner, Chairman Richard Coico Mary Feldtmose Elinor Fredston Angel Martin C. Alan Mason Shirley Tolley Richard Young Others Present: Mary Anne Johnson, former member Cheryl Lewy, liaison, Larchmont Board of Trustees Claudia Ng, Environmental Coordinator NEW MEMBER The chairman introduced new member Angel Martin who was appointed to the CZMC on December 3, 1990. Mr. Martin is an attorney and has a Master's degree in Engineering. He is currently vice president at the New York Power Authority. APPROVAL OF MINUTES The minutes of November 27, 1990 were approved following corrections. CHAIRMAN REPORTS A. Correspondences - Incoming: 1) 1/16/91 - Referral from Mayor Curnin and Trustees, Re: Westchester County's Request to Complete Paper Work on Sewer Easement. Type 1 action (unlisted in CEA) . Block 709, lot 1. -- Since this is purely to secure maintenance and repair rights on the sewer, the Commission found that this application is not inconsistent with the Local Waterfront Revitalization Program (LWRP) . Dr. Mason offered the suggestion that something be done to secure the manhole cover near the Premium Marsh. The chairman will relay these comments to the Village Engineer. CZMC Minutes - 1/22/91 • 2) 12/21/90 - Memo from Steven Silverberg, Town Counsel, Re: Tree (:2Preservation Law amendment. -- CZMC had no comments on the proposed amendment. • 3) 1/17/91 - Meeting dates were announced for the Town's new Board of Architectural Review. Its first meeting will be held Febuary 7, with • regular meetings to be held on the third Thursday of the month. No liaison was appointed, but Dr. Mason agreeed to sit in on a few beginning sessions. • • Correspondences - Outgoing: • 1) 12/5/90 - to TOM Planning Board, Re: Collision Tech and Louis • Vitiello. Consistency opinion and clarification of CZMC's findings. • • 2) 12/6/90 - CZMC Chairman to Mayor Curnin, VOL, Re: Request by Dr. • Robert Leaf for sewer hookup from Premium Point to Pryer Lane and • advice from NYS DEC. -- The proposed sewer connection would require a • State tidal wetlands permit. Since the action is categorized as a "presumptively incompatible" use, it would be difficult to get the • required approval from the Department of Environmental Conservation, so Mr. Leaf withdrew the sewer hookup request from the Village. However, the proposal to build a residence on the property will still need to go the Town Building Department. • ed" Correspondence - Copies: • 1) 12/5/90 - Richard Young to Katherine Carsky, Chair of Westchester • County's Budget Committee, Re: restoration of the Westchester County Soil and Water Conservation District in the 1991 budget. • 2) 12/11/90 - Phyllis Wittner to Katherine Carsky, Re: same as above. • 3) 12/12/90 - Councilwoman Elaine Price to NYS Assemblyman Ronald Tocci, • Re: request for financial assistance from Member Item Funding for the Town's hydrologic study for the golf course properties. • 4) 12/6/90 - Richard Coico to Dr. Barbara Dexter, Re: water quality • testing. • B. Other • 1) Infomal referral by Larchmont's Building Inspector, Re: Abadir, 1 Ocean Ave. -- This proposal for an addition would cut off a portion • of the view to the Sound. However, the CZMC found this application not to require CZMC comments. • 2) Statements of support were made by Shirley Tolley, Wallace Irwin, • Mary Anne Johnson, Phyllis Wittner, Mayor Curnin, Elaine Price and others at the Evaluation Meeting for the New York State Coastal Management Program held by the National Oceanic and Atmospheric Administration on November 29. • • • -2- CZMC Minutes - 1/22/91 4 3) A workshop on the Larchmont Waterfront Rezoning proposal was held by the Mayor and Trustees with the CZMC on January 14, 1991. The Chai rman noted the attendance of the following CZMC members: Larry Lowy, Elinor Fredston, Richard Metzner, Mary Feldtmose, and Angel • Martin, and gave special word of thanks to Howard McMichael and Mary Anne Johnson for their contribution. 4) Significant Coastal Fish and Wildlife Habitat Designation Impact • Assessment -- In the State document dated November 20, 1990, a section on impact assessment was included. The Chairman questioned • the implications of the statement: "Land and water uses or development shall not be undertaken if. . . " (underline added for • emphasis) . It was uncertain as to how this was supposed to be implemented and whether this could constitute a "taking." C. Budget Revision The Chairman summed up CZMC's expenses for 1990. She noted that the $1000 amount allocated for the LWRP Update was insufficient and that perhaps another $1000 would be needed to complete the project. The Commission approved the additional allocation. Mrs. Fredston thought that there should be greater utilization of the CZMC's consultant budget for smaller projects whenever the need arises. BOARD OF ARCHITECTURAL REVIEW (BAR) The Chairman noted that the BAR law was passed. However, since Town Councilwoman Elaine Price was not present to describe the significance of the • BAR law, discussion was postponed. ANNUAL REPORT Comments/Written Material - The Chairman solicited comments from the • members on the draft annual report. Mrs. Fredston and Mrs. Feldtmose advised against incorporating the historical sections from past annual reports in its • separate form and suggested integrating the historical information into one condensed paragraph. To that, Mrs. Tolley suggested just making references • to past annual reports for further detail. Mrs. Fredston noted that she had a few corrections and also that she thought the introduction was redundant. • Mrs. Tolley said that she would assist in writing the section on Davids Island. The Environmental Coordinator will help with the appendices and the • section on Earth Day. Dr. Coico and Dr. Mason also agreed to help with differenct sections. Table of Implementing Actions - The Chairman ran down the list on • Appendix D to update the status of implementing actions. She threw out for consideration whether some current laws should he enhanced (e.g. , the • consistency law could be strenghtened by making CZMC's opinions no longer advisory or by having disagreements appealed to a higher body) . With regard to the FEMA flood map, Dr. Mason commented that a revision had been made, but • feels further refinement is still necessary. Mrs. Tolley felt that Policy 21 dealing with water-related recreation use and its implementation needed to be -3- CZMC Minutes - 1/22/91 • • clarified. She will write her interpretation of appropriate public access and submit it to the Commission for their consideration. It was also noted • that the State will be coming up with regulations, pursuant to the Coastal Zone Management Act, for controlling nonpoint source pollution. • MEMBERS' MINUTE • • Erosion and Sediment Control - Mr. Young has almost finished developing a local erosion and sediment control ordinance, incorporating many of the state guidelines. He will incorporate written comments from Laura Tessier (WSC) • Water Quality - Dr. Coico reported that he sent a letter to Dr. Barbara Dexter, director of Riverwatch, asking about how we could be involved in the • water monitoring program, but he has not yet received a reply. It was noted • that Dr. Dexter will be working on a County project to establish a lab and • network of students to do water testing. Dr. Mason suggested that Dr. Coico • attend a Friends of the Reservoir meeting since she is on the board and • regularly attends. Mrs. Wittner suggested contacting David Sexton or Elaine • Burke of SoundWatch, because they will be conducting a water quality sampling • program in Eastchester Bay and the western part of the Sound which is •• scheduled to begin May 4 and run to September 28. There will be four teams of three volunteers each: one to handle the instruments, one to the • recording, and one would be the captain/owner of a small motorboat (Bill Robb • of Horseshoe Harbor was mentioned as a good contact person to find volunteers • with boats) . Each team would work every other Saturday and will measure dissolved oxygen, salinity, turbidity and temperature, once in the morning and once in the afternoon. She also suggested that he speak to Rick Schreiner of the Long Island Sound Taskforce who has received a grant to prepare a manual for citizens who want to do water monitoring. Questions that still need to be answered include: (1) where should sampling locations • be, (2) what tests should be conducted/what information should be gathered, (3) what equipment is needed and how much will it cost, (4) is other • information gathered by Hohberg of use or interest, (5) when should samples be taken, (6) how many volunteers are needed, and (7) who should get this • information and how will it be utilized on a comprehensive basis. • ENVIRONMENTAL COORDINATOR REPORTS - None. • • NEW OR OTHER BUSINESS • • Listen to the Sound Conference - The National Audubon Society is sponsoring a followup conference to its Listen to the Sound campaign to be • held on January 26 and 27 at the Tara Stamford Hotel. Mrs. Wittner told the Commission that she will be able to attend on Sunday. She further mentioned • that the Audubon Society has put together an excellent document summarizing the testimonies given during the campaign and offering 35 recommendations to • improve the Sound. Long Island Sound Study (LISS) Hearings - Hearings on LISS's "Status Report and Interim Actions for Hypoxia Management" have been scheduled • • • -4- • CZMC Minutes - 1/22/91 C throughout the Sound Shore throughout the month of February. The closest hearing will be at Rye City Hall on Wednesday February 13 from 1:30 - 4:30 p.m. and from 7:00 - 9:30 p.m. The Chairman noted that she is still waiting to receive copies of the report. New York State Coastal Management -ProgramMrs. Wittner reported the reauthorization of the federal Coastal Zone Management Program. • There being no further business, the meeting was adjourned. -S-
