The meeting commenced at 8:05 P.M. Members Present: Phyllis Wittner, Chairman Mary Feldtmose Lawrence Lowy C. Alan Mason Howard McMichael Robert Schoenberger Shirley Tolley Richard Young Others Present: Richard Coico, PhD Mary Anne Johnson Benson Billey, Sound View News Claudia Ng, Environmental Coordinator Rene' Rathschmidt, Recorder LARCHMONT WATERFRONT LAND USE STUDY Dan Shuster distributed a brief summary of findings and recommendations reflecting the status of the Larchmont Waterfront Study to date. Some of the topics presented and discussed pertaining to the proposed zoning amendment were: 1. Concerns (LWRP & Shuster 9/25/89 memo) 2. Options and Objectives (9/25/89 memo) 3. Key Issues 4. Review Existing Legislation (11/20/89 & 1/11/90) 5. Review Draft Legislation 6. Recommendations . CZMC MINUTES 2/20/90 AD After a thorough discussion, the Commission voted to approve the recommendations as drafted by Dan Shuster. Along with the recommendations, the CZMC voted to include a provision for R40 zoning and also giving the option to the Planning Board of mandating R30 lots when applicable. Mr. Mason stressed that by giving this option, better protection of the waterfront and open space could be provided. Ms. Wittner requested that Mr. Shuster return to the CZMC to review the Coastal Overlay District amendment (memo 1/11/90) with a draft of the first part of the proposed legislation for final approval. ADMINISTRATIVE MATTERS Approval of Minutes - The minutes of the January 23, 1990 were returned for minor corrections. CHAIRMAN REPORTS Correspondence - Incoming from: 1. Army Corps of Engineers (dated 2/6/90) re: Larchmont Yacht Club. (Previously constructed 2 stone seawalls and backfilled without a permit) . 2. Letter dated 1/31/90 which resulted from the Department of State (DOS) pre-Coastal Conference meeting regarding the formation of a NYS Coastal Alliance - regional networking group. Anyone interested please contact Ms. Wittner. 3. Malcolm Pirnie comments (2/6/90) re: FEIS Scarsdale Manor. Correspondence - Outgoing: 1. 2/26/90 - Village of Larchmont Facts of Life - 3rd Annual Report near completion. OTHER MATTERS 1. Ms. Wittner informed the Commission that she will be speaking at an Albany DOS Conference in Albany (DOS paid trip) . Her subject: Eliminating Non-Point Pollution thru a LWRP. 2. On 2/14/90 Congresswoman Nita Lowey's Citizen's Advisory Commission on the Environment met at Pace University. (Also meeting separately is a Subcommittee which is working on reauthorization of the Coastal Zone Management Act) . The following were documents distributed: Comparison of Clean Air bills EPA Special Report Hudson River PCB's Recycling legislation tl Oil Spill Bill C . Also at this meeting Professor of Law at Pace, Nicholas Robinson stated that HR 1113 amends the National Environmental Protection Act (NEPA) by forcing every agency to comply (provides procedures) . He noted that it also deals with cumulative effects of global warming, -2- vc,aav •at arvta..� c./t,VI 7V non-point pollution, etc. . . Agencies must issue guidelines and examine cumulative effects in general. Also the Supreme Court has narrowed NEPA to a disclosure document which really doesn't require protection of the environment. HR1113 reverses the Supreme Court by requiring alternatives to mitagate adverse affects. HR1113 passed the House. Senate Bill #1045 was held up behind the Clean Air Act. Everyone is urged to write their Senators to support the bill. 2372 Boston Post Road (VOL Planning Board) - Ms. Fredston attended the last Planning Board meeting and relayed the following to Ms. Wittner: The Applicant for 2372 Boston Post Road has requested a postponement. The Planning Board, which is the lead agency rather than the Zoning Board, required a long Environmental Assessment Form to be completed. As a footnote the Board requested CEA maps. Ms. Fredston also said that a referral for 711 North Avenue (parking for more than 20 cars - oil separator) will be forthcoming. LWRP Revisions - Ms. Wittner distributed a memo dated 2/16/90 which was addressed to Mr. Wallace Irwin, Jr, C.Alan Mason, the CZMC and liaisons. The memo addressed subjects to be updated. Ms. Wittner noted that the memo contained a "very preliminary list" and requested input from all to complete the task. SEQR Workshop (VOL) - Ms. Wittner stated that the SEQR Workshop conducted by Attorney James Staudt was very helpful. Third Annual Report - Near completion and distribution to begin shortly. MEMBER REPORTS Davids Island - Ms. Shirley Tolley, Chairman of the Subcommittee on Davids Island, distributed a memo urging the CZMC to become actively involved by lobbying their County Legislators re: their vote on allowing a portion of Glen Island County Park to be used for the construction of a bridge to Davids Island. Also included with the memo were sample letters that could be used along with a petition which required 5 signatures. Ms. Tolley stressed the importance of continuing to write letters to the DOS and County regarding the opposition to the Davids Island development and to be sure to include CZMC affiliation. Erosion and Sediment Control - Richard Young submitted a memo to the CZMC which was read by Ms. Wittner. Mr. Young stressed that the project, which was a combination of the Westchester Soil and Water Conservation model law and the City of Rye law, was at the point were someone with expertise in this specific area needed to review it. Ms. Wittner agreed to send a memo to the Town Administrator requesting assistance with technical and legal advice for this project. Earth Day Meeting - Mary Feldtmose attended the Earth day Meeting and -3- t.LfII. CI MLLE> L/LU/7U • reported the following: This year is the 20th anniversary of Earth Day. Organizations located in both the Town and Villages will be commemorating the day (April 22) by preparing activities and displays. These activities and displays are being coordinated by the Conservation Advisory Commission. The day's activities will be held at the Reservoir. Provisions for a rain date or rain site were still being discussed. Ms. Feldtmose said she will continue to keep the CZMC updated. Ms. Wittner requested ideas on how the CZMC could become actively involved. Several suggestions were mentioned and Ms. Feldtmose along with Mary Anne Johnson and Claudia Ng will coordinate a project. NEW OR OTHER BUSINESS The Chairman noted the following Town of Mamaroneck public hearings: 1. Zoning amendment 2/21/90. Ms. Wittner will send a memo regarding the inclusion of oil separator devices in the amendment. 2. Newspaper Recycling 3/7/90. 3. No Parking - Premium Conservation Area 3/7/90. Next Meeting - The next regular meeting has been scheduled for March 27, 1990. MEETING ADJOURNED AT 10:10 P.M. -4-
