K A regular meeting of the Coastal Zone Management Commission (CZMC) was held on August 28, 1990 at 8 P.M. in Conference Room A of the Town Center, 740 West Boston Post Road, Mamaroneck, New York. Members Present: Phyllis Wittner, Chairman Richard Coico Elinor Fredston C. Alan Mason Howard McMichael Shirley Tolley • Others Present: Mary Anne Johnson Claudia Ng, Environmental Coordinator ADMINISTRATIVE MATTERS New Secretary - Carol Hayes was announced as the new secretary, replacing Rene' Rathschmidt. Minutes - The minutes of June 26, 1990 were approved with minor corrections. The minutes of July 24, 1990 were accepted pending clarification in one section as well as some minor corrections. Copying of Correspondences - The Commission briefly discussed whether all letters written or received by the Commission should be copied to all members. No conclusion was reached. CHAIRMAN REPORTS Correspondences • INCOMING: • 7/30/90 Mary Anderson (Cornell Cooperative Extension) - acknowledging • our reply to Storm Drain Stenciling Proposal. 8/2/90 Richard A. Young - letter and article re: consumer disposal of used motor oil. 8/9/90 Village of Larchmont Engineer Joseph Morgan - copy of Converse Engineering Consultants Dam Safety Inspection report for the Larchmont Reservoir Dam (see agenda item 4.c. ). CZMC Minutes 8/28/90 OUTGOING: 8/21/90 Mary Anderson and Melissa Beristain of Cornell Cooperative Extension re: better government program for collection of used oil. 8/21/90 Harbormaster James Mancusi - response to "Daily Times" article regarding floating debris. CZMC offer to participate in Mamaroneck River/Sheldrake Watershed Council when formed. COPIES: Davids Island: 7/23/90 Mayor Curnin to DEC Administrative Law Judge Pearlstein -Reasons that adjudicatory hearing should be cancelled. 7/24/90 DEC Judge Pearlstein to David Paget - Project & DOS. Will wait to hear applicant's intentions. 8/3/90 Secretary of State Gail Shaffer to Mayor Curnin. 8/6/90 Paget to Pearlstein - No changes will be made, and there are no adjudicable issues. 8/10/90 Shirley Tolley to Supervisor Silverstone, Councilwoman Price and Mayor Curnin re: Motion to adjourn. Aug. '90 Senator Oppenheimer to Mayor Curnin - No superficial alterations will do; project out-of-scale for Long Island Sound. • US Army Corps 8/6/90 Notification of New Rochelle Harbor maintenance dredging - ... 1(:: 11,000 cubic yards, ocean disposal (off Sandy Hook, site used for dredge disposal since 1914) ; continued use of marine • facility. • Village of Mamaroneck 8/10/90 Notification of McMichael Boat Yard dredging/reconfiguration in • Mamaroneck Harbor - 6 year project. Maintenance dredge - 17,607 cubic yards, disposal WLIS III or other LIS site. • Reconfigure marina facilities; construct approximately 422.5 linear feet of interlocking steel or wood sheet pile bulkhead; • reconfigure perimeter (docks, piers, ramps) . • Soil & Water Conservation 8/16/90 Laura Tessier to Elain Price - District involvement in • hydrologic study of upper Sheldrake watershed. Other Proposed Conservation/Recreation Zoning (TOM) - At CZMC's urging • and with Elaine Price's strong determination, a hydrologic study of the upper Sheldrake River watershed was authorized for inclusion in the Draft Generic Environmental Impact Statement (ETS) by the Town Board on August 8, 1990. Laura Tessier, Westchester County Soil and Waver Conservation District manager, stated in the aforementioned letter that while inter-municipal cooperation must he obtained before the District could do a study of the whole watershed, the District would assist by providing • copies of the 1985 TR-20 computer runs for the Upper Sheldrake and Larchmont Reservoir and copies of the 1985 revised soil survey sheets to -2- • CZMC Minutes 8/28/90 • • ..1 Malcolm Pirnie. The District would also evaluate potential mitigation measures for minimizing flooding impacts and stormwater quality impacts, provide a preliminary review of the draft EIS for this project and perform minor technical and policy planning assistance as requested. Reappointments - Phyllis Wittner was reappointed as chairman. Robert Schoenberger declined reappointment. C. Alan Mason and Richard Metzner will he reappointed (Mr. Metzner had been fulfilling Bruce Allen's unexpired term) . LWRP Revisions - The revisions will be reviewed next month. • Books Acquired: . Karen Blumer, Long Island Native Plants for Landscaping, A Source Book. • Christopher Bucknall, The Real Cost of Development. • SEQR amendment - The Chairman noted a letter from NYS Dept. of Environmental Conservation which discussed amending SEQR to include solid • waste issues. She felt that this would not be of particular concern to the CZMC. • REFERRAL • Global Cities Project: Environmental Charter - The Town and Village have received a letter from Elizabeth Hotzman, New York City Comptroller, asking them to consider adopting an Environmental Charter, similar to the one proposed for New York City. The charter contains guidelines for cities to operate in a more environmentally sound manner both in their own operations and in enforcement of environmental laws. Although the goals were good, the charter overall appeared to lack focus and applicability, because it did not • take into account what is currently being done or what has been . accomplished. CZMC will write a letter to the Boards expressing its • endorsement of the goals only. • . MEMBER REPORTS • Erosion and Sediment Control Law - update - The Chairman reported that • she and Richard Young met with Town Attorney Steven Silverberg on August 17. They had intended to send the draft law to District Manager Laura Tessier of • the Westchester County Soil & Water Conservation District. In conversation . with her, it was noted that the County's model law has been revised. Mr. • Young will finalize his draft and then it will he distributed to the CZMC for comments. • Town Litter Law - Shirley Tolley reviewed the currently proposed law with • CZMC's comments of November 1987 which was given for a previously proposed • litter law which eventually became the "Dumping Law. " She noted that the • concerns of the CZMC were more appropriate to the dumping law. However, • there was some overlap in definitions and it was suggested that the proposed CLitter Law be combined with the existing Dumping Law. Larchmont Reservoir Dam - C. Alan Mason reported on the engineering study that was authorized by the Village of Larchmont. Converse Engineering was contracted to study the upper dam. Several recommendations were made: • -3- • CZMC Minutes 8/28/90 IIII Within 6 months: Remove woody growth on dam's downstream slope. Remove vegetation overhanging downstream channel. Within 12 months: Patch and seal spalled and cracked concrete. Replace lost mortar between stone in spillway, spillway training walls, and downstream channel training walls Studies that should be undertaken within 6 to 12 months: .Monitoring of dam seepage at apparent points; Detailed inspection of upstream face of dam and gatehouse when lake is fully dewatered. . Long term: Assess flood routing for the dam since spillway is inadequate to pass the design storm flood. Dr. Mason said that overall the report was favorable. He noted that the engineers had verbally expressed to the Larchmont Village Engineer that the lower dam should receive similar attention. Dr. Mason further reported that the study had noted an audible leak from the sides of the upper dam and that a siphon may possibly be used to move water out of the reservoir in anticipation of a storm. MEMBERS MINUTE National Beach Clean Up Day - Elinor Fredston informed the commission 1101) that this year's clean-up would be held on September 23 at 9 a.m. , with a raindate of Sept. 30 at 1 p.m. Village of Larchmont Planning Commission (report by E. Fredston): 1. St. John's Church - subdivision was approved. 2. 1919 Palmer Avenue - still undetermined. 3. At 30 Park Avenue, a 4-ft. arbor-vitae screen was planted to block a next door neighbor's deck. 4. Richard Coico noted that a letter regarding grants to beautify the shoreline applied to the Hudson River, not to Long Island Sound. Town of Mamaroneck Planning Board: Finast Expansion - Shirley Tolley reported that Ten Grand, Inc. has submitted an application to expand the supermarket, located on Boston Post Road and Weaver Street, into the residential district. Mrs. Tolley had spoken with the applicant's consultant and explained some of the the CZMC's concerns. Mary Anne Johnson remarked that that area was known in the past as Dirty Swamp and that it drained into the East Creek. Mrs. Tolley arranged to walk over the site on Saturday, Sept 15, if the Planning Board receives the completed plans by its next meeting. ENVIRONMENTAL COORDINATOR REPORTS Budget - Claudia Ng distributed copies of the proposed budget for CZMC for fiscal year 1991. CZMC approved the proposed budget. • , -4- • CZMC Minutes 8/28/90 • NEW OR OTHER BUSINESS s0./ Membership to Other Organizations - The CZMC decided against joining Federated Conservationists of Westchester County and Soundwatch as a • commission of the Town and Village. However, individual membership was encouraged. City of New Rochelle - A zoning change from residential to commercial was • proposed behind the Old Colonial Village Shopping Center, off Weaver Street. CZMC felt that it was important to bring to the Town Administrator's • attention because it was located along the banks of the West Branch of the Sheldrake River. • • • • -5-
