A regular meeting of the Coastal Zone Management Commission (CZMC) was held • on August 27, 1991 in Conference Room A of the Town Center, 740 West Boston Post Road, Mamaroneck, New York. The meeting commenced at 8 P.M. Members Present: Phyllis Wittner, Chairman • Richard Coico Mary Feldtmose • Elinor Fredston Angel Martin • Howard McMichael Richard Metzner • Richard Young Others Present: Cheryl Lewy, liaison, Larchmont Trustee Elaine Price, liaison, Town Councilwoman Claudia Ng, Environmental Coordinator REFERRAL - TOWN PLANNING BOARD - McCARTHY SUBDIVISION The applicant's attorney called to inform the CZMC that they would be unable to appear at tonight's meeting. The Chairman directed Ms. Ng to write a memo • to the Planning Board to tell them that the applicant has twice now postponed reappearance before the CZMC. • MINUTES June 25, 1991 - approved. • July 23, 1991 - approved subsequent to correction on page 5. CHAIRMAN REPORTS A. Correspondences - Incoming: 1. Memo from Supervisor Silverstone requesting information on planned • activities for Coastweeks - Activities known so far include: Coastal Cleanup - Sunday, Sept. 22, 1-4 p.m. , sponsored by r.w L.I.F.E. & CZMC Premium Event - PPPA - October 20 CZMC Minutes August 27, 1991 Page 2 (:: 2. 8/15/91 - Notice from Lt. Governor received 8/21 informing local government agencies that on August 28 in the Town Center there will be an informal session from 4-5 p.m. and a public hearing at 7 p.m. on the recommendations of the Governor's Task Force on Coastal Resources - Mrs. Wittner, Mr. McMichael, and Ms. Ng received this notice. Mr. McMichael, who owns a marine business, commented that - the new regulations are destroying small business. For instance, the new EPA permits for dredging are overwhelming. Businesses will need to collate their resources and be able to submit one application in order to make it cost-effective for each small business. Correspondences - Outgoing: 1 . 7/30/91 - CZMC to Mayor Curnin; Responses to Waterfront Rezoning Memorandum. The hearing will probably be held on September 17. 2. 7/30/91 - CZMC to Supervisor Silverstone; RE: Locust Ridge Road. Recommendation for Town to retain land. 3 . 7/31/91 - CZMC to Commissioner Thomas Jorling (NYS DEC) , Constantine Sidamon-Eristoff (Regional Admin. of EPA) and Kevin Bricke (Region 2 of EPA) ; RE: Encourage all members of the Long Island Sound Study Policy Committee to immediately adopt "No net increase in Nitrogen" policy for Long Island Sound. On April 4, 1990, the Town Board submitted a resolution to this effect. Mrs. Price updated the Commission exlaining that some agencies do not think it is feasible, while others do. The Town is trying to set up a meeting to settle the controversy. 4. 8/6/91 - Memo to Town Planning Board written by Shirley Tolley; RE: Ten Grand - note that the proposal has now been found consistent with the LWRP. 5. 8/6/91 - Consistency referral letter to Town Planning Board written by Mrs. Tolley; RE: Beringer Subdivision - reminder that there should be no increase in the rate of runoff, otherwise found to be neutral with respect to the LWRP. Correspondence - Copies: 1. 7/16/91 - U.S. Army Corps of Engineers (NY & CT joint) Public Notice; RE: Dredging of Premium River. 2. 8/5/91 - Malcolm Pirnie, Inc. , to NYS Dept. of State; RE: Consistency review for Premium dredging project (required because federal permit was needed) . 3. 8/6/91 - NYS DEC Permit for Premium Dredging Project. CZMC Minutes • August 27, 1991 Page 3 4. Undated - Received 8/15/91, FEMA to Mr. Alkan Oral of 5 Hommocks Road; RE: Determination of whether property is located in the Special Flood Hazard Area. Was exempted as being outside boundary. • Other • 1. 1380 Boston Post Road - Saturn dealership withdrawn; no letter written. Lamborghini is now applying to the Board of Architectural Review (BAR) . • Mr. Metzner, liaison to BAR, reported that Lamborghini said that there would be no servicing done on the premises; it would he just a showroom. • Mrs. Price informed the Commission that the BAR has asked Lamborghini to come back to the next meeting with concrete plans for improvements. • 2. DGEIS on the Golf Course Issue - Mrs. Wittner compiled a biological inventory using existing documents, which was reviewed by Irma Volk, • Wallace Irwin and Elizabeth Lehman, and provided it to Ferrandino & Associates at a meeting on August 27. She emphasized that a naturalist • is needed to review this aspect. In addition, she provided them with archeological and historical information and references, advising them • that further research needs to be done. Mrs. Price reported that the Town Board is considering commissioning the consultants to do a • supplement to the DGEIS. A scope of the supplement should he completed soon. Mrs. Price encouraged local assistance to help keep costs down. 3. Visit by Department of State - Charles McCaffrey, Peter Walsh (CZMC's new • 4..., contact person) , Mike Weber (Budget Analyst, NYS Senate Finance Committee) , State Senator Suzi Oppenheimer and aide, Stacy Begin, Supervisor Caroline Silverstone, Deputy Mayor Cheryl Lewy, Shirley Tolley and Phyllis Wittner gathered to discuss local concerns such as the length • of docks, sea walls, Davids Island and the Premium Marsh. • 4. Recommended reading: Larchmont, N.Y. People and Places by Judith Doolin Spikes. The Chairman requested Ms. Ng to purchase a copy for the office. 5. LWRP Update - Wallace Irwin has submitted the last section of the • update. Mrs. Wittner will work on it before distributing it to the members. 6. Publications - Mrs. Wittner just received Sound Choices - A Practical Guide for Boaters, by SoundWaters. MEMBERS' REPORTS/MINUTE 1. Water Monitoring - Richard Coico reported that he received a draft video from Long Island Sound Taskforce (LIST) showing how citizens can help • monitor the water quality of Long Island Sound. LIST plans to come out with a manual and an edited tape in the near future. The suggested • program appears to be very intense--sampling to be done twice a day. CZMC Minutes August 27, 1991 Page 4 Baseline measurements plus a biological inventory will be taken and sent • to a central database station. The focus is primarily on hypoxia. A dedicated full-time paid operator with a boat appears to be needed to do • this program. Dr. Coico overheard that the Village of Mamaroneck and Rye are planning to share a boat and suggested that we inquire about joining • in. Mrs. Wittner felt that the Conservation Advisory Commission (CAC) should oversee such a program since they have been in charge of water • monitoring studies. She will contact the CAC chairperson. 2. Larchmont Centennial - Mary Feldtmose reported that members are needed to march in the parade on September 28. It will begin at the train station at noon. People are also needed to help with refreshments at Turtle • Park. • 3. Memberships - Howard McMichael, Richard Young and the Chairman are up for reappointment. The Chairman endorses continuation of both members. • GOVERNORS TASK FORCE ON COASTAL RESOURCES • The Commission discussed their views of the draft recommendations. Mr. McMichael felt that a lot of what is being proposed has already been covered in other areas. He suggested coordination amongst the existing agencies. However, further noted that these agencies are most likely understaffed as it is. Mr. McMichael also felt that too much concentration was being placed on • education and public awareness instead of the real problem--sewage. Similarly, he disagreed with the proposed sources of revenue, which were • targeted toward the already heavily taxed marine users. He felt that a water user fee which would encompass all water use contributing to sewage output, • would be more equitable. Lack of cooperation from upland communities which contributes to • siltation was also cited as a problem that needs addressing. Mrs. Fredston felt that the CZMC should comment on understaffing problems, but not on the funding issues. Mrs. Wittner thought it would be appropriate to mention that some of the proposed taxation would discourage public use of the coast. Another comment was that both Westchester County and school districts (which would require overturning state law) should be made subject to • consistency review under SEQR. With regard to regional planning, Mrs. Price mentioned that she did not • think the County should have its own coastal plan. Mrs. Wittner felt that it all should be kept simple at this point and that they should just concentrate • on incentives for bringing local governments into the Coastal Program. Many felt that this document was very difficult to follow, particularly • the section on consistency review. Mrs. Wittner ventured to say that the centralized review system would be the best, giving local commissions with LWRPs jurisdiction. CZMC Minutes • August 27, 1991 Page S Other comments included: more teeth is needed to enforce protection of local habitats (currently no prohibitions) ; minimum wetland size for 'w.• inclusion in state program should be reduced; and support should be given to • keep the coastal management program in the Department of State. Two weakenesses identified were lack of state funds to implement such • recommendations and lack of authority of the state to make its decisions binding. • The Commission agreed that the chairman should make a statement at tomorrow's hearing and submit a more detailed letter to the CZMC for its • comments before the September 21st deadline.
