MINUTES OF A 38:b t? P E7,TING OF THE ZONING BOARD OF APPEALS,
HELD IN THE BOARD ROOM AT 11 ED( 00D AVENUE', LARCHYONT , NEW
YORK, ON SEPTFM"BFR 9th , 1949
At 8 o'clock P. M. , the Chairman announced to those present
that the application of Frank Turco, for a variance to permit
him to erect and maintain a gasoline service station in con-
nection with premises known as Block 126 , Parcel 442 , on the
Tax Assessment Map of the Town of Mamaroneck, had been with-
drawn. Petitions were submitted which were ordered received
and filed.
The meeting was called to order at 8:15 P. N.

The minutes of the meeting held August 24th , 1949, were approved
as presented.
The first application before the Board was that of Donata
Guglielmo for a variance to permit the erection of a private
dwelling 25 feet from the street line in connection with
premises known on the Tax Assessment Map as Block 402, Par-
cel 77.
The Clerk strted that the application had been duly advertised.
The Guglielmo brothers appeared before the Board in behalf
of the application , and submitted a blue print and sketch of
the property.
Ir. William Harper , a resident of Flkan Park appeared and
7 structurewas that he wished to learn ,hat type of con-
templated. Mr. Harper replied in answer to a question by the
Chairman, that he did not wish to register any objection.
The Guglielmo brothers were informed that they would be advised
of the Board 's decision.
The next application before the Board was that of Rockledge
Holding Corporation represented by Mr. C. sirMoody , President ,
for a. variance to permit the erection of a private dwelling
within 40 feet of the street line and 8 feet from one side
line in connection with premises known as Block 224, Parcel
714 on the Tax Assessment Map.
Mr. Moody appeared in behalf of the application and submitted
blue prints , plot plan and pictures.

The Clerk stated that the annlicatior had been duly advertised .
Mr. Robert Adler appeared , representing his father , Mr. Herbert
M. Adler , and stated that his father wished to onnose the
application as he felt "it would be establishing a precedent".
After discussion and questioning, Mr. Moody was informed that
he would be notified of the Board ' s decision.
The Chairman presented a letter which had been addressed to
the Board by Mr. William Tieder in connection with Y'remises "
known as Block 221 , Parcel 78, requesting a re-hearing in con-
nection with his application made to this Board on March 23rd .
1949.
The Chairman stated that the Board would consider the letter to
ascertain whether Mr. Tieder had presented any new facts. If
new facts or information are presented , the Board would then
have jurisdiction and could order a new hearing which would
again have to be advertised.
Mr. Tieder was present and said that he wished to stress the
fact that the structure would not be a two-family house.
He next asked if he could use the structure for domestic
help if he could not obtain a variance.
He was advised by the Board to take the matter up with Town
Attorney Delius and Town Engineer Foote.
The Chairman stated that the application of Modern Swimming
Pool had been withdrawn as had also the application of Edward
Fly Hoxie.
After discussion, it was
RESOLVED that the request of William Tieder ,
contained in his letter of July 6th , 1949,
for reconsideration of his application made
to this Board on March 23rd , 1949, is hereby
denied for the reason that the applicant has
shown no new facts or circumstances which were
not rresented et the time of his original anpli-
cation.
A vote taken on this resolution resulted as follows:
AYES: Mr. Burchell , Mr. Mink, Mr. Waterman, Mr. Quinn
NOES: None
The Board next took up the application of Rockledge Holding
M. Corporation and after discussion it was decided to post-
:
pone decision on this until a new map showing the proposed
new street and lot lines has been filed.
After discussion of the application of Donata Guglielmo, it
was
RESOLVED that the application of Donata
Guglielmo for modification of Article III,
Section 9 of the Zoning Ordinance to permit
the erection of a private dwelling within
3C feet , to wit 25 feet of the street line ,
in connection with premises on the north
side of Palmer Avenue , 260 feet west of
Merritt Street , known on the Assessment
Map of the Town of Warnaroneck as Block 402 ,
Parcel 77, be and the same hereby is denied
upon the ground that the aprlicant has failed
to show unnecessary hardship or practical
difficulty in abiding by the provisions of
the Ordinance.
A vote taken on this resolution resulted as follows:
AYES: Mr. Burchell , Mr. Mink, Mr. Waterman, Mr. Quinn

There being no further business to come before the
meeting , it adjourned at 9:30 F. M.
