PRESENT: George D. Burcrelle , Chairman Charles F. Mink Cornelius J. Quinn Jeremiah C. Waterman ABSENT: None The matter of the application of Rockledge Folding Corroration, adjourned from the previous rreeting , was discussed . Mr. is"oody appeared before the Board and submitted a map showing his proposed plan. The Board then went into executive session and after further discussion, the following resolution was duly moved and seconded: r'TIEREAS Rockledge Holding Corporation , by C. W. Igoody President , filed an application taking an appeal from the deci- sion of the Building Inspector denying a building permit for the erection of a building on Block 224 , Parcel 714 , on the Tax Assessment Map of the Town of Mamaroneck in accordance with plans and specifications submitted to the Building Inspector , and it appears that the said Building Inspector has denied the granting of such permit for the reason that the building, accord- ing to the plot plan submitted , is not in conformity with Article III, Section 9 of the Zoning Ordinance which requires in the case of said lot , a front set back of a minimum of 40 feet and side yards of a minimum of 10 feet; and "WHEREAS it arrears that the said Rockledge Holding Corporation heretofore and on the 13th day of Sertember , 1949, filed a certain plot plan or subdivision map entitled "Revised Street Lines , Map of Rouken Glen, Bonnie Briar Section, Town of Mar^aroreck, Westchester County" , made by A. J. Foote , Sur- veyor , Larchmont , New York, which bears the Registration Office No. 6910; and li WHEREAS an examination of said plot plan indicates 4 that there are practical difficulties and unnecessary hard- ship, particularly because of the irregular share and the topography of the lot , NOW, THEREFORE , BE IT RESOLVED that the said appeal from the deter- mination of the Building Inspector be allowed and the determination of the said Building Inspector reversed , and he be and hereby is -38- • directed to issue to the arplicant , a building permit for the erection of a dwelling upon said premises in accordance with the plot plan and aofrementioned map submitted , which shall have a set back of less than 40 feet , to wit , 30 feet and a side yard on the northerly side , of less than 10 feet , to wit , 8 feet , and be in accor- dance with the plans , specifications and map filed in connection with said arrlication , provided that in all other resrects , the appli- cant abide by the provisions of said Ordinance and Building Code of the Town of Mamaroneck A vote taken on this resolution, resulted as follows : AVFS: T r.
