OF THE TOWN OF MAMAROI ECK, HELD NOVEMBER 3rd, 1948, IN THE
BOARD ROOM AT 11 EDGEWOOD AVENUE, LARCHMONT, N. Y.
PRESENT: Mr. Brewer, Chairman
Mr. Mink
Mr. Cross
Mr. Quinn
ABSENT: Mr. Burchell
This meeting was called for the purpose of considering the
application of Herman H. Bose, which application had been be-
fore the Board at its regular meeting on October 27th, 1948,
and decision on which had been reserved to give the Board mem-
bers an opportunity to view the property in question.
Each of the members present had viewed the property and after
discussion, the following resolution was duly moved and seconded:
WHEREAS, Herman H. Bose has taken an appeal
from the decision of the Building Inspector denying a
permit to erect a building in accordance with plans and
specifications filed with the Building Inspector and the
application therefor, upon the ground of unnecessary hard-
ship because of the character of the neighborhood, as the
property in part, being Block 410, Parcel 140 on the Tax
Assessment Map of the Town of Mamaroneck, lies in a Class nAn
Residence District; and
WHEREAS, it appears that the area in question
can be utilized only for business purposes and it would
deprive the owner of the beneficial use thereof if he were
not to use the entire premises in connection with the
business now existing on that portion thereof, fronting on
the Boston Post Road, and it is the opinion of the Board
of Appeals that such use is in keeping with the character
of the neighborhood and will not create a traffic hazard,
and will not be detrimental to residential properties on
Winthrop Avenue,
NOW, THEREFORE, BE IT
• RESOLVED that said appeal be and the same
hereby is allowed and the decision of the
Building Inspector reversed to the extent
that the applicant be and he hereby is per-
mitted to use the entire parcel for business
purposes upon the following conditions :
(1) That any part of any building to be
erected on any part of the premises lying in
the Class nAn residential district shall be
erected at least six (6) feet from the side
and rear lines of said parcel.

(2) That no part of any building, any part
of which is erected on the portion of said
pre ises located in the Class "A" residen-
t tial district, shall exceed in height, the
height of the existing building line and
known as "steel frame fire proof auto and
service building", as shown on plot plan sub-
mitted in connection with this application.
(3) No gasoline, petroleum products, paint
or oils shall be stored in any such building.
(4) This variance is granted upon the express
condition that at all times, all parts of
said premises lying in the Class "li" resi-
dential zone, shall be kept free from junk,
used automobile parts, oil cans and other
debris.
(5) That the six (6) feet, hereinabove pre-
scribed, between any building erected on said
premises and the property line, shall be
s free from any construction or obstruction
whatsoever and accessible for fire fighting
purposes.
There being no further business to come before the meeting,
it adjourned at 9:20 P. M.
