HomeMy WebLinkAbout1957_09_11 Zoning Board of Appeals Minutes MINUTES OF A SPECIAL MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK, HELD SEP- TEMBER 11, 1957, AT POLICE HEADQUARTERS, 11 EDGE - WOOD AVENUE, TOWN OF MAMARONECK. CALL TO ORDER The Chairman called the meeting to order at 8:00 p. m. PRESENT: Mr. A. E. Wullschleger, Chairman Mr. Sydney Bierman Mr. Laurence Sobel Mr. Robert Parsons Mr. George Schuler ABSENT: None ALSO PRESENT: Mr. Maurice Friedlander, Town Engineer and Building Inspector APPROVAL OF MINUTES The minutes of the meeting of August 28, 1957, were approved as presented. APPLICATION--CONSTANCE FERGENSON The Chairman explained that this meeting was called for the purpose of making a decision upon the application of Con- stance Fergenson as presented at the hearing on August 28, 1957, and adjourned to this date and at his request, the Sec- 1 retary presented the application as follows: Application of Constance Fergenson for modification of Ar- ticle III, Section 9, of the Zoning Ordinance, as amended, so as to allow the construction of an extension to the exist- ing attached garage on premises known as Block 405 - Par- 1 cel 231 on the Tax Assessment Map of the Town of Mamar- 161 oneck and located at 7 Meadow Place, Larchmont, which would result in a setback from Carleon Avenue of 22 3/4 feet, on the ground that Article III, Section 9 of the Zon- ing Ordinance of the Town of Mamaroneck requires that no part of any building shall be built within 30 feet of any street line, except that on corner lots such building may be set back a less distance from the side street with the approval of the Board of Appeals. The Building Inspector, Mr. Friedlander, presented a revised plan of the Fergenson garage and the following persons were heard in connection with this application: For the applicant: Mr. Leon Fergenson In opposition: None Mr. Fergenson, appearing on behalf of the applicant, his wife, stated that Mrs. Fergenson was requesting this var- iance because the present garage was not sufficiently large to accommodate two modern cars. The Chairman then inquired whether anyone present wished to be heard either for or against this application, and since no one did, Mr. Sobel offered the following resolution, which was seconded by Mr. Parsons and unanimously adopted by the Board: WHEREAS, Constance Fergenson has filed an appeal from a decision of the Building Inspector of the Town of Mamaroneck refusing a permit for structural ad- dition on property located on the southerly side of Carleon Avenue and westerly side of Meadow Place and known on the Tax Assessment Map of the Town of Mamaroneck as Block 405 - Parcel 231; and WHEREAS, Constance Fergenson requests that be- cause the present structure is inadequate for modern type automobiles, this Board grant a variance and over-rule the decision of the Building Inspector; and WHEREAS, this Board has viewed the property and has examined the plans and other matters submitted by the applicant and has heard all persons appearing for or against the appeal; 162 NOW, THEREFORE, BE IT RESOLVED that the appeal of Constance Fergenson from the decision of the Building Inspector refusing the issuance of a permit for a structural addition to the present building, located on the southerly side of Carleon Avenue and westerly side of Meadow Place and known on the Tax Assessment Map of the Town of Mamaroneck as Block 405 - Parcel 231, having a set back of 25 feet rather than the required 30 foot set back as specified in Article III, Section 9 of the Zoning Ordinance of the Town of Mamaro- neck which requires that no part of any building shall be built within 30 feet of any street line, ex- cept that on corner lots such buildings may be set back a less distance from the side street with the ap- proval of the Board of Appeals, be granted. FURTHER RESOLVED that this decision be filed with the Town Clerk as provided by Section 267 of the Town Law. WELCOME TO CHAIRMAN The members of the Board extended a cordial welcome to the Chairman, Mr. Wullschleger, who had recently re- turned from his trip abroad. DATE OF NEXT MEETING Mr. Schuler called to the Board's attention the fact that September 25th, the date for the next regular meeting of the Board, fell on the eve of the Jewish New Year and suggested that this meeting be held on the next Wednes- day evening, October 2nd, instead of on the regular date. The Board so fixed the date and the Secretary was dir- ected to clear the matter on the calendar at Police Head- quarters and to send out notices in accordance therewith. 163 ADJOURNMENT There being no further business to come before the meeting, it was adjourned at 8:30 p.m. , and the Chairman stated that the Board would reconvene in regular session on the first Wednesday evening in October, October 2nd, 1957, at 8:00 p.m. r\ Acting Secretary 164
