HomeMy WebLinkAbout1953_05_09 Zoning Board of Appeals Minutes MINUTES OF A SPECIAL MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK, HELD MAY 9th, 1953, IN THE MAMARONECK TOWN POLICE STATION, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. PRESENT: Mr. Wullschleger, Chairman Mr. Rigano Mr. C . Benjamin Brush, Jr. ABSENT: Mr. Fred L. Maggini Mr. Morgan J . Burke, Jr. Presence was also noted of Mr. Delius, Town Attorney, and Mrs. Barnes, Clerk to the Board and Recording Secretary. Mr. Wullschleger called the meeting to order at 10 A. M. Upon motion duly made and seconded, the minutes of the previous meet- ing, held April 22nd, 1953, were approved as presented. Mr. Wullschleger stated that this meeting had been called to con- sider the application of Rockledge Holding Corp. for modification of Article III, Section 9 of the Zoning Ordinance as amended, to permit the erection of a building on a corner lot to be less than 40 feet from the street line on premises located at No. 2 Dudley Lane, and known as Lot 2 on "Second Amended Map of Glen Eagles Ridge, Section One, belonging to Rockledge Holding Corp. , Town of Mamaroneck, Westchester County, N . made by A. J . Foote, C . E. and S. , dated June 2, 1952, and filed in the County Clerk' s Office, Division of Land Records on June 5, 1952, as Map No. 7726, and also known on the Tax Assessment Map of the Town of Mamaroneck as Block 313, part of Parcel 148, which application had been adjourned to this date at the meeting held April 22nd. 4afj )1 o- g 19 5 3 Mr. Wullschleger presented a letterAfrom Mr. Edward B. Polak, 1 Boulder Brae Lane, and requested that it be read. Mr. Polak, in his letter, stated that he wished to change the basis of his objection to the Rockledge application. Heretofore such objection was based on his ownership of Boulder Brae Lane where the same is con- tiguous to his property and also of the one-foot strip of land adjoining the north side of Boulder Brae Lane and running from Dudley Lane in a westerly direction to the Winged Foot Golf Course and also his belief that such ownership gave him an absolute right to prevent the granting of the application. He went on to say that he now withdraws any claim to owner- ship of Boulder Brae Lane and of the one-foot strip, but not his opposi- tion to the granting of the application. He concluded by stating that he would have no objection to the applicant building as near the street lines as he may wish and as the Board may con- sent, if no part of the building goes further west than 80 feet from the Dudley Lane street line. Such a structure would not be directly oppo- site his home or obstruct his view. Mr. Moody appeared and addressed the Board and answered questions. Mr. Francis B. Upham, Jr. , Mr. Polak' s attorney, also appeared. After discussion, the Board went into executive session and on motion duly made and seconded, it was -128- 4 RESOLVED that a variance be and it hereby is granted to Rockledge Holding Corporation to permit erection of house for which it filed plans with the Building In- spector on March 3, 1953 (Plan No. 3693) which plans the Building Inspector has otherwise approved, provided that said house snail be located not more than 45 feet from Dudley Lane as shown on "Second Amended Map of Glen Eagles Ridge, Section One, belonging to Rockledge Holding Corp., Town of Mamaroneck, Westchester County, N . Y.", made by A. J . Foote, C . E. and S . , dated June 2, 1952 and filed in the County Clerk' s Office, Divi- sion of Land Records on June 5, 1952, as Map No. 7726, and not less than 25 feet from Boulder Brae Lane as shown on said map, provided, however, that in all other respects, applicant comply with the provisions of the Zoning Ordinance and Building Code of the Town of Mamaroneck. A vote taken on this resulted as follows: AYES: Mr. Wullschleger Mr. Rigano Mr. Brush NOES: None There being no further business to come before the meeting, it adjourned. Secretary -129-
