HomeMy WebLinkAbout1958_08_06 Zoning Board of Appeals Minutes MINUTES OF A SPECIAL MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK, HELD AUGUST 6, 1958, IN THE COURT ROOM OF THE MAMARONECK POLICE DEPARTMENT, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. CALL TO ORDER In the absence of the Chairman, Mr. Wullschleger, the meeting was called to order by Mr. Schuler at 8:00 p. m. PRESENT: Mr. George Schuler Mr. Sydney Bierman Mr. Laurence Sobel Mr. Robert Parsons ABSENT: Mr. Arthur Wullschleger HEARING Mr. Schuler, acting Chairman, announced that this was a special meeting to continue consideration of the Application of the Post Road Building Corporation, heretofore commenced on May 28, 1958 and continued June 25, 1958. The Chairman declared the hearing open and asked if anyone present wished to address the Board, either in favor of or opposed to this application and the following persons were heard: For Appellant: Murray Fuerst, Esquire, 271 North Ave, New Rochelle, Attorney for Appellant Mr, Irving Roussin, President of Post Road Building Corp. In Opposition: Mr. Robert Spickler, Hommocks Road Larchmont Mr. H. R. Brownell, 508 Hommocks Road In Opposition: Mrs. Abraham Walis, 512 Hommocks Road Mr. J. H. Zeeman, 520 Hommocks Road Mrs. Leon Gilbert, Eagle Knolls Road, Larchmont Mr. Murray Fuerst, attorney, reviewed the facts underlying the application as originally submitted to the Board at the May and June meetings and contended that to deprive Post Road Building Corp. of its right to build would be taking property without due process of law. Mr. Roussin, as president of Post Road Building Corp, pointed out that he had kept this piece of land with the intention of building a house for himself some day and that if he could not build then the property was useless except to pay taxes on it. Mr. Bierman and Mr Sobel again asked Mr. Roussin if the applicant had considered repurchasing of the lot previously sold to Mr. Marx since Mr. Marx had never paid anything but the $300. down payment, and Mr. Roussin responded that this was not possible. Mr. Parsons stated that there did not appear to be any sound reason for the July 1955 sale which created the non-conformity. Mr. Spickler then addressed the Board, and after reviewing the facts of his opposition again pointed out that the proposed con- struction would depreciate his property by $10, 000. and he submitted a sketch to show the relative location of the structures on adjoining parcels. Messrs. Brownell and Zeeman and Mesdames Walis and Gilbert then stated that they wanted to go on record as being opposed to the granting of this application. The secretary then read two letters one from the Agrion Co. and one from Mr. Ralph W. Burger, adjacent property owners, also opposing the granting of this application. After some further discussion by the Board and examination of the data submitted, Mr. Bierman offered the following resolution: RESOLVED that the application of the Post Road Building Corp. for modification of Article III, Section 9 be granted as made. Mr. Sobel seconded c this resolution. I The Chairman then asked that a vote be taken and the resolution was defeated by the following vote: Mr. Bierman Aye Mr. Sobel Aye Mr. Parsons Naye Mr. Schuler Naye Mr. Wullschleger absent and not voting. ADJOURNMENT There being no further business to come before the meeting it was adjourned at 9:00 p. m. Gentlemen: I hereby protest and object to the application of Post Road Building Corporation for modification of Article III, Section 9, of the Zoning Ordinance, as amended, so as to permit the erection of a one-family dwelling on Hommocks Road, as set forth in the Public Notice of hearing scheduled before your Board on August 6, 1958, upon the ground that the granting of such application would seriously depreciate the value of the property owned by me on Hommocks Road and would deprive the undersigned property owner of the protection to which I am entitled under the Zoning Ordinances now in effect. The granting of the requested application would not be in conformanc= with the general plan and purpose of the Ordinances d would change the entire character of the neighborhp.d. r Very y yours, ii • W. Gentlemen: We hereby protest and object to the application of Post Road Building Corporation for modification of Article III, Section 9, of the Zoning Ordinance, as amended, so as to permit the erection of a one-family dwelling on Hammocks Road, as set forth in the Public Notice of hearing scheduled before your Board on August 6, 1958, on the ground that the granting of such applica- tion would seriously depreciate the value of- the property owned by this corporation on Hammocks Road and would deprive the under- signed property owner of the protection to which it is entitled under the Zoning Ordinances now in effect. The granting of the requested application would not be in conformance with the general plan and purpose of the Ordinances and would change the entire cha ter of the neighborhood.
