FRIDAY, JULY 7th, 1950, AT 11 EDGEWOOD AVENUE, LARCHMONT, N. Y.
PRESENT: Mr. Quinn, Chairman
Mr. Burke
Mr. Wullschleger
ABSENT: Mr. Butterfield
Mr. Mink
Presence was also noted of Mr. Delius and Mr. Foote.
The Chairman called the meeting to order at 8: 15 P . M. , and
announced that this meeting had been again adjourned for the purpose
of giving Dr. Carlucci another opportunity to appear before the
Board with his architect.
The Clerk stated that the neighbors had also been notified of this
adjourned hearing.
Dr. Carlucci appeared with his architect, Mr. Nicholas Jacobus.
Mr. Jacobus said that this house, which is only large enough to
accommodate the doctor' s family, cannot be built in any other way on
that lot. ' ,
Mr. Burke asked whether this house could be built with a- 8-6" set-
back.
Mr. Jacobus replied that it would mean a smaller house.
Mr. Walter L. Roe, who occupies the premises directly across the
street (Weaver Street) from the property in question, requested that
the Board, if it granted the application, would provide that if
Weaver Street is ever widened, an equal amount of property shall be
taken from both sides of the road at this point.
Mr. Quinn, upon advice from Mr. Delius, said that this was a matter
controlled by the State of New York.
After further discussion, upon motion duly made and seconded, the
following resolution was adopted:
WHEREAS, Joseph P . Carlucci has taken an appeal from the decision
of the Building Inspector denying his application to permit the erec-
tion of a one family dwelling on the northwest side of Weaver Street,
corner of Bonnie Way, known on the Tax Assessment Map as Bock 104,
Parcel 92, with a front set-back of less than 30 feet as required by
Article III, Section 9 of the Zoning Ordinance of the Town of Mamaro-
neck, to wit, 20 feet; and
WHEREAS, the application came on duly to be heard before this
Board at its regular meeting held June 28th, 1950, and the Board,
after hearing all persons who appeared for and against the application,
thereafter adjourned the matter until the 30th of June, and there-
after further adjourned the matter to July 7th, to enable residents
of Bonnie Way to express their views and also to enable the appli-
cant to produce his architect; and

WHEREAS, it appears that all persons in the immediate neigh-
borhood were notified of the adjourned date, i.e. July 7th, 1950,
and that it would be an unnecessary hardship, because of the size
and location of the lot, to require the applicant to comply with
the strict provisions of the Ordinance with respect to the prescribed
30 foot set-back, and it appears to the Board that the variance,
if granted, would not be detrimental to the public welfare, safety
or health,
NOW, THEREFORE, BE IT
RESOLVED that the appeal of Joseph P . Carlucci be and the
same hereby is allowed and the decision of the Building
Inspector reversed to the extent of permitting the erection
of a one family dwelling with a set-back of 20 feet from the
street line of Weaver Street as shown on the plot plan and
drawings filed in connection with this application, provided
however, that applicant comply in all other respects with the
Zoning Ordinance and Building Code of the Town of Mamaroneck.
There being no further business to come before the meeting, it
adjourned at 9: 10 P . M.
