THE TOWN OF MAMARONECK, HELD IN THE COUNCIL ROOM OF THE '.BEAVER
STREET FIRE HOUSE, ON JANUARY 12th, 1950

ABSENT: None
The Chairman called the meeting to order at 8:15 P. M.
The minutes of the meeting held December 28th, 1949 were approved
with a correction which consisted of the recording of the Board' s
vote in connection with the application of Mr. Carmine Perciaseppe.
The vote recorded was as follows: AYES: Mr. Burchell, Mr.
Waterman, Mr. Wullschleger; NOES: Mr. Mink.
The Clerk was instructed to make this correction.
• The first application before this meeting was that of Rev. John J.
Flynn for modification of Article III, Section 9 of the Zoning
Ordinance to permit the extension of a building for use as a chapel
in connection with property on the east side of Weaver Street,
approximately opposite the Weaver Street Fire House, known on the
Tax Assessment Map of the Town of Mama.rmeck as Block 217, Parcel 1.
Father Flynn appeared before the Board in behalf of the applica-
tion and submitted blue prints of the proposed extension.
The following people appeared but did not register opposition:
Mrs. H. W. Kapp, 6 Heather Lane, Town
Mr. . James Brennan, 6 Heather Lane, Town
Mr. and Mrs. Alex Dawson, 4 Marder. Road, Town
Mr. R. A. Robinson , 12 Cooper Lane, Town
Mr. Frank Beede, 2 Heather Lane, Town
Mr. Robert Sackheim, 10 Marden Road, Town
Mr. James Bryce, 21 Cooper Lane, Town
Several of these people spoke of the traffic problem which they
fear will result from the building of the Church, but they were
informed that this question was not before the Board of Appeals.
Mr. Robinson said he wished to make a provisional objection on
the basis of the possibility of an entrance on Cooper Lane. He
said the situation would be serious if that happened as Cooper
Lane is a very narrow, steep, winding street.
The Chairman informed those present that the application would
be considered and Father Flynn would be notified of the decision.
The Board then proceeded to hear the proof in connection iith the
application of Carl Guglielmo, which application had been adjourned
from December 28th, 1949, for this purpose. The minutes of this
hearing were recorded by Miss Marian Meikle, 76 Echo Avenue, New
Rochelle.
At the conclusion of this hearing, the Board went into executive
session and after discussion, the following resolutions were duly
moved and seconded:
(1) WHEREAS, an application was made by Rev. John J.
Flynn, Pastor of the Church of Sts. John and Paul, for modifica-
tion of Article III, Section 9 of the Zoning Ordinance, to permit
the extension of a building, now upon certain premises known and
described as Block 217, Parcel 1 on the Tax Assessment Map of the
Town of Mamaroneck, for use as a chapel; and
WHEREAS, such application was received by the Clerk
of this Board on January 4th, 1950, making it impossible therefore,
to publish the notice once a week for two weeks immediately pre-
ceding the adjourned hearing of this Board set for January 12th,
as required by Rule 9 of this Board; and
WHEREAS, the Town Law of the State of New York,
Section 267, requires that notice of hearing before a zoning board
of appeals be published not less than 5 days prior to the date of
the hearing,
NOW, THEREFORE, BE IT
RESOLVED that the strict application of Rule 9
is hereby waived and this Board hereby enter-
tains the application of Rev. John J. Flynn
above mentioned, upon proof that same has been
published in the Daily Times of Mamaroneck on the
5th and llth days of January, 1950.
(2) WHEREAS, it appears from the application of Rev.
John J. Flynn, Pastor of the Church of Sts. John and Paul, for
modification of Article III, Section 9 of the Zoning Ordinance, to
permit the extension of a building now upon certain premises known
and described as Block 217, Parcel 1 on the Tax Assessment Map of
the Town of Mamaroneck, that the building in question is situated
in a Class "A" Residential area and was, until the present time,
used as a garage or stable with living quarters incidental to the
main residence or dwelling upon the same plot, and that it is
now intended to extend or enlarge said building for the purpose
of constructing a parish chapel,
NOW, THEREFORE, BE IT
RESOLVED that the application as made be
granted and that said building or structure
as enlarged and extended, may have a rear yard
of 1.4 feet instead of the rear yard required
by Article III, Section 9 of the Zoning Ordinance.
FURTHER RESOLVED that this variance from the
strict provisions of this Ordinance, is granted
upon condition that the structure be altered,
enlarged or extended in accordance with the
plans heretofore submitted to the Building
Inspector and approved by this Board at this
hearing, and further, upon the condition that
the said structure or building shall be used
only for purposes connected with said Church
of Sts. John and Paul and its Parish.
A vote taken upon these resolutions resulted as
follows:
AYES: Mr. Burchell
Mr. Mink
Mr. Wullschleger
Mr. Quinn
Mr. Waterman
NOES: None
The Board next considered the application of Carl Guglielmo
and it was decided to postpone decision in this matter until
the next meeting of the Board which will be January 25th, 1950.
There being no further business to come before this meeting, it
adjourned at 10:30 P. M.
