Mr. Wullschleger, acting as Chairman in the absence of Mr. Quinn, called the meeting to order at 8 P. M. PRESENT: Mr. Wuiischieger Mr. Mink Mr. Butterfield ABSENT: Mr. Quinn Mr. Burke Presence was also noted of Town Attorney Delius and Building In- spector A. J. Foote. On motion duly made and seconded, the minutes of the previous meeting, held September 27th, were approved as presented. The first application before the Board was that of Fred Schmid for modification of Article II, Section 4, subdivision 13 of the Zoning Ordinance of the Town of Mamaroneck, to permit the making and selling of metal art and costume jewelry and wood items, on premises known as 4 Valley Place (Block 131, Parcel 3) in the Town of Mamaroneck. Mr. Samuel Schain, an attorney, 271 North Avenue, New Rochelle, appeared and addressed the Board in behalf of this application. He submitted a petition consenting to the granting of a variance, signed by 13 property owners in the vicinity of 4 Valley Place, which was received and filed. Mr. Shain stated that the property had beeri,for some years, used for light manufacturing and was, in fact, now so used, specifically. for wood working and the manufacture of costume jewelry and stated that in the future, they wished to continue substantially the same opera- tion. He stated that the character of the neighborhood is such as to make ordinary retail business permitted in this zone, unprofitable and impractical, and, therefore, asked that a variance be granted so as to allow this type of manufacturing. There was no opposition. Mr. Schain was told he would be notified of the Board' s decision. The next application before the Board was that of Elwood ri. oontz and Barbara B. Koontz for modification of Article III, Section 9 of the Zoning Ordinance, to permit an existing use, i.e. a one-family residence building on the corner of Ellsworth Road and Little Farms Road with a set-back of 23 feet from the street line of Ellsworth -7- Road and 20 feet from the front street line of Little Farms Road, known on the Tax Assessment Map of the Town of Mamaroneck as Block 212, Parcels 98 and 115 . Mr. Koontz appeared in behalf of the application and addressed the Board. He submitted a survey made by George W. Godfrey, dated April 26, 1946 and certified to the New Rochelle Federal Savings and Loan Association, which was received and filed. He said the house in question had been built in 1922 or 1923 and there is no evidence in the Building Department of a permit or variance ever having been issued or granted. The following people appeared and expressed approval of the appli- cation: Mrs. Clinton Bell, 20 Little Farms Road _42r. I. n . Pace, 51 Ellsworth Road Mr. C . A . McCarthy, Jr., 39 Ellsworth Road. .Mr. Koontz was told that he would be notified of the Board' s decision. Tile Board went into executive session and after discussion, upon motion duly made and seconded, the following resolution was adopted: WnERFAS, it appears that the one family residence built upon premises known as Block 212, Parcels 98 and 115, which is on the corner of Ellsworth Road and Little Farms Road, apparently violates the provisions of Article III, Section 9 of the Zoning Ordinance in that the buildingis 23 feet from the street line of Ellsworth Road and 20 feet from the street line of Little Farms Road as shown on the survey submitted by the applicant; and Wrir;REAS, it appears that no building permit for the construction of this building was ever issued and no variance was ever granted, by reason of which the applicant is unable to show strict compliance with the provisions of the Zoning Ordinance, NOW, THEREFORE, BE IT RESOLVED that the application of Elwood n . Koontz and Barbara B. Koontz for modification of Article III, Section 9 of the Zoning Ordinance, to permit an existing use, i.e. a one-family residence building on the corner of Ellsworth Road and Little Farms Road, with a set-back of 23 feet from the street line of Ellsworth Road and 20 feet from the front street line of Little Farms Road, known on the Tax Assess- ment Map of the Town of Mamaroneck as Block 212, Parcels 98 and 115, is granted upon the ground that the applicant has shown unnecessary hardship and practical difficulty in complying with the strict provisions of the Ordinance. -8- A vote taken on this resolution resulted as follows: AYES: Mr. W ullschleg er M r. Mink Mr. Butterfield i OES: bone After considering the application of Fred Schmid, the Board ad- journed the matter until its next regular meeting and the Clerk • was instructed to notify the applicants that they must produce more detailed specifications of the kited and type of machinery which they desire to use, and further information as to the method to be used in manufacturing the jewelry . An approval of the premises for such manufacturing from the State Labor Board will also be required.
