OF MAMARONECK, HELD OCTOBER 22nd, 1952, AT THE MAMAEONECK TOWN POLICE
STATION, 11 EDGEWOOD AVENUE, TOWN OF MAMAR0NECK.
Mr. Wullschleger called the meeting to order at 8 P . M.
Present: Mr. Wullschleger, Chairman

Mr. Rigano

ABSENT: None
Presence was also noted of Mr. Delius, Town Attorney and Mrs. Barnes,
Recording Secretary and Clerk to the Board.
On motion duly made and seconded, the minutes of the previous meeting,
held August 27th, 1952, were approved as presented.
The application before the Board was that of Alfred Willis, Architect, as
Agent for Philip Morrison, for modification of Article III, Section 9 of
the Zoning Ordinance to permit an addition to a non-conforming building,
namely an addition to an attached garage within 30 feet of East Brookside
Drive, to wit, 18.8 feet, on premises known as 58 East Brookside Drive and
known on the Tax Assessment Map of the Town of Mamaroneck as Block 212,
Parcel 167.
Mr. Willis addressed the Board and submitted a blue print and plot plan.
he said that Mr. Morrison finds it impossible to put his car in the garage.
Mr. Morrison corroborated this and stated that he had not been able to
find space anywhere in the neighborhood where he could shelter his car.
He said he purchased the property about 6 years ago.
Mr. Armand F. Macmanus, 74 Hickory Grove Drive W. , an attorney, represented
Mr. Peter Shuebruk, owner of the property immediately adjoining the sub-
ject property.
Mr. Macmanus said Mr. Morrison would not suffer any hardship if the
variance were denied, as he had several alternatives, whereas, Mr. Shuebruk
definitely would suffer hardship as his view would be spoiled and the
value of his property would be deteriorated. Mr. Shuebrukts house
is on a lower level than Mr. Morrison? s. Mr. Morrison? s situation is
not unique in that neighborhood. The previous owner regularly put his
car (a Buick) in that garage.
Mr. Macmanus also submitted a blueprint of the property.
Mr. Richard Sutherland, 40 Brookside Drive, asked whether it would not
be phisically possible to construct the garage without a variance.
Mr. Donald Vanderbilt, 47 Ellsworth Road, suggested that another solution
be found.

Mr. Macmanus submitted a letter from Mr. Thomas E. Sutton, a real es-
tate broker, in Larcnmont, substantiating his theory that vaue of the
property in the neighborhood would be deteriorated by the granting of this
variance. The letter was received and filed.
Mr. Herbert Eulenstein, E . Brookside Drive, believes there must be
some other solution.
Mr. Morrison, brotner of the applicant, said he understands the problem
and has talked with a number of contractors and they tried to arrive at
the best possible solution.
At this point the public meeting adjourned and the Board went into
executive session.
After discussion, upon motion duly made and seconded, it was
RESOLVED that the appeal of Alfred Willis, Architect, as
Agent for Philip Morrison, for modification of Article III ,
Section 9 of the Zoning Ordinance, to permit an addition
to a non-conforming building, namely an addition to an
attached garage within 30 feet of East Brookside Drive,
to wit, 18.8 feet, on premises known as 58 East Brookside
Drive and known on the Tax Map of the Town of Mamaroneck
as Block 212, Parcel 167, be and the same hereby is denied
on the ground that the applicant has failed to snow unneces-
sary hardship or practical difficulty in abiding by the
provisions of the Ordinance .
A vote taken on this resolution resulted as follows:

NOES: None
There being no further business, the meeting adjourned at 9 P. M.
