HomeMy WebLinkAbout1957_10_02 Zoning Board of Appeals Minutes MINUTES OF A REGULAR MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK, HELD OCT. 2, 1957, IN THE COURT ROOM OF THE MAMARONECK POLICE DEPARTMENT, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. CALL TO ORDER The Chairman called the meeting to order at 8:00 p. m. PRESENT: Mr. A. E. Wullschleger, Chairman Mr. Sydney Bierman Mr. George Schuler Mr. Laurence J. Sobel Mr. Robert L. Parsons ALSO PRESENT: Mr. Maurice Friedlander, Building Inspector and Town Engineer. APPROVAL OF MINUTES The minutes of the meeting of September 11. 1957, were approved as presented. HEARING The Secretary presented the affidavit of publication of notice of hearing as published in the official newspaper of the Town of Mamaroneck, The Daily Times, on November 20, 1957. The Chairman declared the hearing open and requested the secretary to present the first application. 165 APPLICATION # 1---BEORAMA REALTY CORPORATION Application of Beorama Realty Corporation, for modification of Article II, Section 3 of the Zoning Ordianace, as amended, so as to permit the construction of a storage shed on premises adjoining 2 Weaver Street. and known on the Tax Assessment Map of the Town of Mamaroneck as Block 410, Parcel 268, on the ground that Article II, Section 3 of the Zoning Ordinance of the Town of Mamar- oneck requires that no building or premises shall be used and no building be erected, which is arranged, intended or designed to be used as a house or dwelling for more than one family. The Chairman declared the hearing open and Mr. Thomas Hory, 2 We aver Street, Larchmont, representing Beorama Realty Cor- poration appeared before the Board and stated that the proposed building would be used for storage of slow-moving parts. Tie further advised that they were very limited in space and that to- day's business made it necessary to carry all these parts and that they urgently needed storage space for same. The Chairman inquired whether anyone present wished to be heard in favor of or opposed to this application and the following persons were heard: Mr. Frank Dodenhoff--23 Weaver Street, Larchmont, N. Y. I live across the street and I am not favor nor exactly against this application. I am concerned, however, about the appearance of these sheds or buildings in our neighborhood. I am anxious that the building does not give the appearance of just a shed and that it be kept in good condition, painted, clean etc. The Chairman questioned Mr. Hory about this matter and was assured that the storage shed would be maintained and run in the same clean and orderly fashion that the entire Chevrolet place is kept. Mr. Schuler inquired as to the type of rooW and Mr. Hory re- plied that it would be a galvanized steel peak roof. Mr. Bierman inquired as to how the windows would be covered and Mr. Hory stated that present plans were to use plywood pos- sibly in panels with grill work . 166 r---- ____ Mr. Bierman questioned the Building Inspector as to the appli- cation not specifying usage and Mr. Friedlander assured the Board that the permit would be granted in accordance with the variance were such variance granted. In favor of Application: Mr. Anthony Garofalo--24 Weaver Street, Larchmont, N. Y. In Opposition: Mr. Salvatore Fazio--30 Weaver Street, Larchmont, N. Y. Mr. Fazio opposed this structure due to the fact that this area is not zoned for business and he, himself, is not permitted to operate a business as such at his home. This results in his not being permitted to store his truck in his yard and not being able to obtain plywood and supplies at wholesale prices. He objected to the existence of the First National Store, the road connected therewith, etc. , stating that all of this existed on what was sup- posed to be residential property and yet he was discriminated against in the conduct of his business. Mr. John Civettini--37 Weaver Street, Larchmont, N. Y. Mr. Civettini also objected to use of this property for business and to any further business structures for this purpose. Mr. Sobel asked whether it was possible or practicable for this property to be used for any other purpose under present conditions and following a short discussion for this entire area and its use by the Board, upon motion of Mr. Schuler, seconded by Mr. Bierman the Board unanimously adopted the following resolution: WHEREAS, Thomas Hory, representing Beorama Realty Cor- poration has applied for a variance in connection with Block 410 Parcel 268, on the Tax Assessment Map of the Town of Mamaro- neck, so as to permit the erection of a storage shed for slow- moving parts and accessories, within the area for which a vari- ance was granted by this Board on September 12, 1950, for the 167 1 purpose only of erecting and maintaining a paint shop; and WHEREAS, in the opinion of the Board the construction of such a storage shed will not adversely affect the neighboring properties providing it was built and maintained in conformity with other buildings on this property; and WHEREAS, this Board has viewed the property and has examined the pland and other matter submitted by the applicant and heard all persons appearing for or against the appeal; NOW, THEREFORE, BE IT RESOLVED permission is hereby grantedbr the erection of a storage shed for slow-moving parts and asseccories adjoining the northerly wall of the existing one story, brick garage approximately 115'north of the Boston Post Road, Larchmont, New York, pro- viding, however, that such storage shed shall be built strictly in accordance with the plans submitted with the application and en- titled, Utility Building, John Cooper Co. , Inc. , 301-9 Second Street, Hackensack, New Jersey, and the construction of such storage shed shall comply with all building codes of the Town of Mamaroneck and the Labor Laws of New York State;and it is FURTHER RESOLVED that this decision be filed with the Town Clerk as provided by Section 267 of the Town Law.
