OF APPEALS OF THE TOWN OF MAMARONECK, HELD NOV-
EMBER 27, 1957, IN THE COUNCIL ROOM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARO-
NECK.
CALL TO ORDER
The Chairman called the meetingto order at 8:00 m
p.
PRESENT: Mr. A. E. Wullschleger, Chairman
Mr. Sydney Bierman
Mr. George Schuler
Mr. Laurence J. Sobel
Mr. Robert L. Parsons
ALSO PRESENT: Mr. Maurice Friedlander, Building Inspector
and Town Engineer.
APPROVAL OF MINUTES
The minutes of the meeting of October 2, 1957, were approved
as presented.
HEARINGS
The Secretary presented the affidavit of publication of notice of
hearing as published in the official newspaper of the Town of
Mamaroneck, The Daily Times, on November 20, 1957.
The Chairman declared the hearing open and requested the sec-
retary to present the first application.

APPLICATION # 1 --- DOMINIC T. MARTINO
The application of Dominic T. Martino for modification of
Article II, Section 6, of the Zoning Ordinance (Non Conforming
Uses) as amended October 9, 1955, so as to permit the struc-
tural alteration of building on premises known as 767 Forest
Avenue, Block 210, Parcel 50 on the Assessment Map of the
Town of Mamaroneck by adding to the building a two bedroom
addition 15' x 30' on ground of unnecessary hardship.
The Chairman informed the Board that Mr. Martino had
requested that his application be withdrawn to which request
the Board unanimously consented.
The Chairman requested the secretary to present the
second application.
APPLICATION # 2---ALFRED WILLIS, AGENT FOR WALTER
R. STONE

for modification of Article III, Section 9 as amended of the
Zoning Ordinance so as to permit the enclosure of an existing
open porch at front of building at 26 Glenn Road, Block 115,
Parcel 540, on the Assessment Map of the Town of Mamaroneck
with a front set back of less than 30 feet, to-wit, 25. 11 feet
from the street on the ground of unnecessary hardship.
The Chairman inquired whether any one present wished to be
heard either in favor of or in opposition to this application and the
following persons were heard:
For Appellant: Mr. Alfred Willis
In Opposition: None
Mr. Willis agent for Mr. Stone, presented a plan showing the
existing porch and the appearance of the proposed enclosure. He
explained that Mr. Stone needed more room and that enclosing
this porch is the only way to obtain this needed extra room without
encraaching on side or rear line limitations.

The Chairman having ascertained that no one else wished to
speak wither in favor of or in opposition to this application de-
clared the hearing closed.
Mr. Friedlander, the Town Engineer, and the Board examined
this plan in some detail and after further discussion upon motion
by Mr. Parsons, seconded by Mr. Schuler the following resolution
was unanimously adopted:
WHEREAS, Walter R. Stone has filed an appeal from a de-
cision of the Building Inspector of the Town of Mamaroneck ,
refusing a permit for the enclosure of a porch on premises
located at 26 Glenn Road, Town of Mamaroneck, and known as
Block 115, Parcel 540 on the Tax Assessment Map of the
Town of Mamaroneck; and
WHEREAS, Walter R. Stone requests that because of prac-
tical difficulty and unnecessary hardship this Board grant
a variance and over-rule the decision of the Building
Inspector; and
WHEREAS, this Board has viewed the property and has ex-
amined the plans and other matters submitted by the appli-
cant, and has heard all persons appearing for or against
the appeal;
NOW, THEREFORE , BE IT
RESOLVED that the appeal of Walter R. Stone from the de-
cision of the Building Inspector refusing the issuance of a
permit for the enclosure of an existing porch on premises
located at 26 Glenn Road and known as Block 115, Parcel
540, be granted on the grounds of practical difficulty and
unnecessary hardship as recited in the application and
which this Board finds exists; and it is
FURTHER RESOLVED that the application of the provision
of the Zoning Ordinance of the Town of Mamaroneck, i. e.
Article III, Section 9 of the Zoning Ordinance as amended,
relating to set back requirements on premises located at
26 Glenn Road and known as Block 115, Parcel 540 on the

Tax Assessment Map of the Town of Mamaroneck, be varied
and modified so as to allow the enclosure of an existing open
porch having a set back of 25' 11 " from the street rather
than the required 30' set back, provided that the applicant
complies in all other respects with the Zoning Ordinance
and Building Code of the Town of Mamaroneck; and it is
FURTHER RESOLVED that this decision be filed with the
Town Clerk as provided by Section 267 of the Town Law.
The Chairman requested the secretary to present the third
application.
APPLICATION # 3---JANE N. ROGOW
The application of Robert Rogow for modification of Article
III, Section 9 as amended of the Zoning Ordinance so as to per-
mit existing structure at 143 Palmer Avenue, Block 401, Parcel
102, on the Assessment Map of the Town of Mamaroneck having a
rear yard of less than 15% of the depth of the lot and cubic content
of less than 19, 000 cubic feet, to-wit, 17, 900 cubic feet on
ground of unnecessary hardship.
Mr. Wullschleger asked if any one present wished to speak
either for or against this application and the following persons
were heard:
For Appellant: Mr. Richard G. Hewitt, 60 East
42nd ST. Attorney for Jane Rogow
In Opposition: None
Mr. Hewitt, attorney for Mrs. Rogow, outlined the facts
concerning the application and in the ensuing discussion asked
for permission to withdraw the application without prejudice.
This request was granted unanimously by the Board.
DATE OF NEXT MEETING
Because of the Christmas holidays the Chairman announced
that the next meeting will be January 8, 1958.

ADJOURNMENT
There being no further business to come before this meeting
it was adjourned at 8:30 p. m. to reconvene on Welinesday, January
8, 1958.
