HomeMy WebLinkAbout1952_11_25 Zoning Board of Appeals Minutes MINUTES OF A REGULAR MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK, HELD NOVEMBER 25, 1952, AT THE MAMARONECK TOWN POLICE STATION, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. Mr. Wullscnleger called the meeting to order at 8 P . M. PRESENT: Mr. Wullschleger, Chairman Mr. Brush Mr. Rigano Mr. Maggini ABSENT: Mr. Burke Presence was also noted of Mr . Delius, Town Attorney, Mr. McEvoy, Building Inspector, and Mrs . Barnes, Clerk and Recording Secretary to the Board. On motion duly made and seconded, the minutes of the previous meeting, held October 22nd, 1952, were approved as presented. The first application before the Board was that of Alfred Willis, Archi- tect, as Agent for Philip Morrison, for modification of Article III, Section 9 of the Zoning Ordinance to permit an addition to a non-con- forming building, namely, an addition to an attached garage within 30 feet of East Brookside Drive, to wit, 18.8 feet, on premises known as 58 East Brookside Drive and known on the Tax Assessment Map of the Town of Mamaroneck as Block 212 Parcel 167. Mr. Willia appeared for the application and submitted a plot plan and sketches. No one appeared in opposition to the application and Mr. Willis stated that Mr. Peter Shuebruk, the next door neighbor, now has no objection. Mr. J . Eulenstein, 46 East Brookside Drive, was present and stated that he had objected to Mr. Morrison' s application for a variance as pre- viously presented, but he has no objection to the present application before the Board . The applicant was told he would be ynotified of the Board' s decision. ******n i� -n F *n i** * ***** The next application before the Board was that of Alfred Willis, Agent for Dayhar Realty Corporation for modification of Article II, Section 4 of the Zoning Ordinance of the Town of Mamaroneck, granting a variance or license to use appellants property on the south side of the Boston Post Road and known on the Tax Assessment Map of the Town of Mamaroneck as Block 411, Parcel 252, for the storage of automobiles. Mr. Willis appeared for the application and submitted a photostatic copy of a blue print of the property. There was no opposition to this application -103- The Board went into executive session and after discussion, on motion duly made and seconded, the following resolution was adopted: WHEREAS, Alfred Willis, Architect,as Agent for Philip Morrison, has appealed to this Board for modification of Article III, Section 9 of the Zoning Ordinance, to permit an addition to a non-conforming build- . ing, namely, an addition to an attached garage within 30 feet of East Brookside Drive, to wit, 18.8 feet, on premises known as 58 East Brook- side Drive and known on the Tax Assessment Map of the Town of Mamaro- neck as Block 212, Parcel 167; and WHEREAS, the application came on duly to be heard before this Board ' at its regular meeting held November 25, 1952; and WHEREAS, it appears that it would be an unnecessary hardship to re- quire the applicant to comply with the strict provisions of the Ordinance, NOW, THEREFORE, BE IT RESOLVED that the appeal of Alfred Willis, Architect, as Agent for Philip Morrison, be and the same hereby is allowed and the decision of the Building Inspector reversed to the extent of permitting an addition to a non-conforming building, namely, an addition to an attached garage within 30 feet of East Brookside Drive, to wit, 18.8 feet on premises known as 58 East Brookside Drive and known on the Tax Assessment Map of the Town of Mamaroneck as Block 212, Parcel 167, in accordance with plans and specifications filed in connection with this application, provided, however, that in all other respects, applicant comply with the provisions of the Ordinance and Building Code of the Town of Mamaroneck. The vote recorded on this resolution is as follows: AYES: Mr. Wullschleger Mr. Brush Mr. Rigano Mr. Maggini NOES: None ************#********* After discussion, on motion duly made and seconded, the following resolution was adopted: WHEREAS, on September 15, 1948, Dayhar Realty Corporation made applica- tion to this Board for modification of Article II, Section 4 of the Zoning Ordinance of the Town of Mamaroneck granting a variance or license to use appellantts property for business purposes to a depth of 200 feet from the Boston Post Road, instead of the present limitation of 100 feet in connection with premises on the south side of the Boston Post Road 695 feet easterly from Bronson Avenue and known on thew y Asses sment Map of the Town of Mamaroneck as Block 411 Parcel 257;�Wnd r " -104- Wok WHEREAS, Alfred Willis, Agent for Dayhar Realty Corp. , now makes an application to this Board for modification of Article II, Section 4 of the Zoning Ordinance, granting a variance or license to further ex- tend the use of appellant' s property to its entire depth (average depth 295 feet) for the storage of automobiles; and WHEREAS, it is the opinion of the Board that such property cannot be utilized for any economic purpose in conformity with the Ordinance, and that to require the applicant to conform to the Ordinance would cause him unnecessary hardship and there are other practical diffi- culties to the utilization of said property in accordance with the Ordinance, NOW, THEREFORE, BE IT RESOLVED that said application be and the same hereby is granted to the extent that applicant be and he hereby is given a variance from the strict provisions of the Zoning Ordinance, to permit the use of the property known as Block 411 Parcel 257, only for the storage of automobiles and for no other purpose. ,k FURTHER RESOLVED that any structural additions hereafter made upon such premises, shall be subject to the approval of the Board of Appeals; and FURTHER RESOLVED that said premises be maintained in a neat and clean condition, and that no dila- pidated, wrecked automobiles, motor vehicles or parts thereof nor any motor vehicles not in good running condition be permitted to be stored upon said premises. The vote recorded on this resolution is as follows: (Mr. Wullschleger not voting, having disqualified himself from taking any part in the con- sideration of this application) AYES: Mr. Brush Mr. Rigano Mr. Maggini NOES: None There being no further business to come before the meeting, it adjourned at 9: 15 P .
