TOWN OF MAMARONECK, HELD NOVEMBER 22nd, 1950, IN THE BOARD ROOM AT
11 EDGEWOOD AVENUE, LARCHMUNT, N. Y.
Mr. Wullschleger, acting as Chairman in the absence of Mr. Quinn,
called the meeting to order at 8 P. M.

Presence was also noted of Town Attorney Delius and Assistant Building
Inspector, Thomas McEvoy.
On motion duly made and seconded, the minutes of the previous meeting,
held October 25th, 1950, were approved as presented.
The first application before the Board was that of Sol Rosen, agent for
Selig Rosen, which was an appeal from a determination of the Building
Inspector refusing a permit for the erection of a car washing plant, which
refusal was on the ground that the area upon which the proposed b ilding
is to be erected, is zoned "C Business" for a depth of only 100 feet,
whereas the plans show the building and parking area for cars to line up
before entering this washing plant, to be 200 feet, the premises being on
the north side of the Boston Post Road on the corner of Van Guilder
Street, known as Block 503, Parcel 342, with a frontage of 87 feet, a
depth of approximately 315 feet, irregular, and an average width of
76 feet.
Mr. Sol Rosen and Mr. Selig Rosen, 423 Halstead Avenue, Mamaroneck,
appeared in behalf of the application, and submitted blue prints and a
plot plan. They said they expect to spend $4,000. to fill in the pro-
perty. In response to questions, Mr. Rosen said that a Mr. Harry Crown is
the present record owner of the property and they have entered into a
conditional sales contract with him, conditioned upon their obtaining a
variance from this Board. After further discussion it was decided to
ask Mr. Crown to appear before the Zoning Board.
There was no opposition to this application.
The Board next considered the application of Fred Schmid which had been
adjourned from the meeting of October 25th, in order that the applicant
might produce more detailed specifications of the kind and type of
machinery which they desire to use, and further information as to the
method to be used ini&nufacturing they do on the premises.
Miss Schmid appeared and submitted a letter from Mr. Fred Schmid,
stating that he requests permission to use several motors not exceeding
an aggregate total of 15 H. P. ; a list of machines now used at 4 Valley
Place; a list of tools suggested for use at the Woodcraft Studios (4
Valley Place) ; and a letter from the State Department of Labor,
setting forth regulations which must be complied with if applicant for
a variance intends to employ more than 5 people.

Mr. Samuel Schain, attorney for Mr. Schmid, appeared and said that as
far as he knows, Mr. Schmid does not intend to sell the premises at No.
4 Valley Place.
Mr. Wullschleger thanked Mr. Schain for appearing and the Board then
went into executive session and upon motion duly made and seconded, it-
was
RESOLVED that the application of Fred Schmid for modification
of Article II, Section 4, Subdivision 13 of the Zoning Ordin-
ance of the Town of Mamaroneck, so as to permit the use of •
premises at No. 4 Valley Place, known as Block 131, Parcel 3
on the Assessment Map of the Town of Mamaroneck, for the
making and selling of metal art and costume jewelry and wood
items in addition to a wood working plant as presently
operated, be granted on the ground that the applicant has shown
practical difficulty and unnecessary hardship in complying
strictly with the provisions of the Ordinance regarding
business uses in a "C" district, subject, however, to strict
compliance with the regulations of the Department of Labor
as set forth in letter dated October 18th, 1950, from the
New York State Labor Department, or other applicable regu-
lations now or hereafter applicable to the premises in
question.
A vote taken on this resolution resulted as follows:

At this point, Mr. Harry Crown appeared. He stated that he has owned
the subject property some 3 or 4 months, and has given Mr. Selig Rosen
a conditional contract to purchase it. He said he had purchased the
property ,from Shirley Goode. The contract is at present in the posses-
sion of his attorney, Mr. Rubin Sirlin of Mamaroneck who, Mr. Crown
stated, is confined to his home by illness.
Mr. Wullschleger thanked Mr. Crown for appearing before the Board and
assured Messrs. Rosen that they would be notified of the Board' s de-
cision.
After discussion and on motion duly made and seconded, it was
RESOLVED that the appeal of Sol Rosen, agent for Selig
Rosen, from the determination of the Building Inspector
be allowed and the determination of the Building Inspector
reversed and he hereby is directed to issue to the appli-
cant, a building permit for the erection of a car washing

plant with parking area for cars to line up before entering
this washing plant, in accordance with plans and specifi-
cations submitted to the Building Inspector, on the ground
of practical difficulty and unnecessary hardship because of
the location of this property on the Boston Post Road which
is zoned for business to a depth of 100 feet only and the
fact that the proposed building and its use extend beyond
the 100 feet, provided that in all other respects, the
applicant abide by the provisions of said Ordinance and
the Building Code of the Town of Mamaroneck.
A vote taken on this resolution resulted as follows:

There being no further business to come before the meeting, it ad-
