HomeMy WebLinkAbout1959_05_27 Zoning Board of Appeals Minutes MINUTES OF A REGULAR MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK, HELD MAY 27, 1959, IN THE COURT ROOM OF THE MAMARONECK POLICE DEPARTMENT, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. CALL TO ORDER Mr. Wullschleger, Chairman, called the meeting to order at 8:00 p. m. PRESENT: Mr. A. E. Wullschleger, Chairman Mr. George Schuler Mr. Sydney Bierman Mr. Laurence Sobel Mr. Phil Corby ALSO PRESENT: Mr. Maurice Friedlander, Building Inspector and Town Engineer APPROVAL OF MINUTES The minutes of the meeting held May 6, 1959, were approved as presented. HEARING The secretary presented the affidavit of publication of notice of the hearing as published in the official newspaper of the Town of Mamaroneck,the Daily Times, on May 20, 1959. The Chairman declared the hearing open and requested the secretary to read the first application. 44 APPLICATION NO. 1---MRS, MARK D. SOROKO Case # 39 1. The application of Mrs. Mark D. Soroko for modification of Article III, Section 9 of the Zoning Ordinance of the Town of Mamaroneck, as amended, so as to allow the erection of a car-port having a set back of less than 30 feet from the street line at premises located at 263 Murray Avenue, and known on the Tax Assessment Map of the Town of Mamaro- neck as Block 113, Parcel 116, on the ground of practical difficulty and unnecessary hardship. The Chairman asked if anyone present wished to speak either in favor of or in opposition to this application and the following persons were heard: For Appellant: Robert J. Marcus, Esquire 138 Chatsworth Avenue, Larchmont Mark D. Soroko, 263 Murray Avenue In Opposition: Mr. & Mrs. Ed. Lau, 283 Murray Ave. William J. Vey, 1 Bryson Street Mr. Marcus, representing Mrs. Mark D. Soroko, appeared and stated that this car-port had been erected for the purpose of protecting his client's cars. The present garage is not large enough for two cars and it is necessary, for business reasons, that two cars be maintained by the Sorokos. Mr. and Mrs. Lau and Mr. Vey stated that many of the driveways in the surrounding area could be utilized in the same way but that it would tend to depreciate the neighborhood and they felt this was not a true hardship and so the variance should be denied. The question of screening and proper landscaping was also dis- cussed and Mr. Marcus and Mr. Soroko assured the Board that all measures would be taken to have the car-port blend in with the present shrubbery. Following further discussion Mr. Marcus requested that action be deferred on this matter until the next meeting of the Zoning Board at which time he would submit a new plan, showing structural changes and proper landscaping,for the Board's consideration. 45 Whereupon, on motion by Mr. Schuler, seconded by Mr. Corby, the following resolution was unanimously adopted: RESOLVED that action on the application of Mrs. Mark D. Soroko be deferred until a new application accompanied by new plans showing structural changes and proper landscaping be submitted for the Board's consideration. The Chairman requested the secretary to notify Mr. Marcus of the Board's decision. ADJOURNMENT There being no further business to come before the meeting it was adjourned at 9:20 p. m.
