HomeMy WebLinkAbout1955_05_25 Zoning Board of Appeals Minutes r - - • MINUTES OF A REGULAR MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK, HELD MAY 25, 1955, IN THE ROOM ASSIGNED TO THE BOARD, AT MAMARONECK TOWN POLICE HEADQUARTERS, 11 EDGEWOOD AVENUE, TOWN. PRESENT: Mr. Sullschleger, Chairman Mr. Rigano Mr. Burke Mr. Schuler Mr. Maggini ABSENT: None Presence was also noted of Mr. McEvoy, Building Inspector and Mrs . Barnes, Clerk to the Board and Recording Secretary. Mr. Wullschleger called the meeting to order at 8 P. M. , and on motion duly made and seconded, the minutes of the previous meeting, held April 27, 1955, were approved as presented . The first application before the Board was that of Alfred Willis , architect, as agent for Philip Torter, for modification of Article II , Section 3 of the Zoning Ordinance as amended, to allow extension of present commercial building into an "A" residence zone on premises known as 434 Boston Post Road and also known on the Tax Assessment Map of the Town of Mamaroneck as Block 503 Parcel 326. Mr . Willis appeared and said Mr. Torter wants to extend the present building back 60 feet . The building is now set back 50 feet from the property line and if the addition were put on the front of the building, it would create a hazard on the Post Road . The property is 321 feet in depth. Mr . Willis presented a sketch of the lot with the present building which is shown to be 40 feet by 40 feet . There will be a driveway of 40 feet . Mr . Christopher Loveley appeared representing his mother, Mrs . William Loveley, 5 Dillon Road, New Rochelle, and stated his mother has no objection to the application, provided the drainage situation is corrected . Mr. Louis Argenta, 519 English Place, appeared representing his mother, Mrs . Louis Argenta who lives at 30 Hartung Street, Larchmont, and said his mother is opposed to the application. Mr. Willis, in rebuttal, said he believes the proposed building will be an improvement, as the land was formerly swampland , and if the variance is granted, he promised the drainage situation will be corrected . The next application was that of Otto Scheuble for modification of Article III , Section 9 of the Zoning Ordinance as amended, to permit erection of a one-family dwelling within 30 feet of the street line, -9- to wit, 22 feet, on premises at 25 Rockridge Road and known on the Tax Assessment Map of the Town of Mamaroneck as Block 412 Parcel 25. Mr . Scheuble presented a plot plan and house plans . He said the land is 90 feet in depth and there is a sharp drop in the rear. He, there- fore, is only able to use about 75% of the depth of his property. He presented a sketch showing the adjoining houses with which he will line up his house . There was no opposition to this application . On motion duly made and seconded the hearing was declared closed . The Board then went into executive session and, after discussion, on motion duly made and seconded, it was RESOLVED that the application of Alfred Willis, architect, as agent for Philip Torter, for modification of Article II , Section 3 of the Zoning Ordinance as amended, to allow extension of present commercial building into an "A" residence zone on premises known as 434 Boston Post Road, also known on the Tax Assessment Map of the Town of Mamaro- neck as Block 503 Parcel 326 (and which building was erected in conformity with variance granted by this Board under date of November 22 , 1950) be and it hereby is denied and the decision of the Building Inspector upheld . The vote recorded on this resolution was as follows : AYES : Mr. Rigano Mr. Burke Mr . Schuler Mr. Maggini NOES: Mr . Wullschleger After further discussion, on motion duly made and seconded, the follow- ing resolution was adopted : WHEREAS , Otto Scheuble has appealed to this Board for modification of Article III , Section 9 of the Zoning Ordinance as amended, to permit erection of a one-family dwelling within 30 feet of the street line, to wit, 22 feet, on premises at 25 Rockridge Road and known on the Tax Assessment Map of the Town of Mamaroneck as Block 412 Parcel 25; and WHEREAS , this application has come on duly to be heard by this Board at its regular meeting, held May 25, 1955; and WHEREAS , it appears that the lot in question is only 90 feet in depth and that there are topographical difficulties due to a sharp drop in the rear of the land , -10- • NOW, THEREFORE, BE IT RESOLVED that the appeal of Otto Scheuble be and it hereby is granted and the decision of the Building Inspector re- versed to the extent of permitting erection of a one-family dwelling within 30 feet of the street line, to wit, 22 feet, in accordance with plans filed with the Building Inspector, on premises at 25 Rockridge Road and known on the Tax Assess- ment Map of the Town of Mamaroneck as Block 412 Parcel 25, on grounds of practical difficulties and unnecessary hard- ship because of severe topographical conditions and depth of the lot, provided that in all other respects , applicant comply with the Zoning Ordinance and Building Code of the Town of Mamaroneck. The vote recorded on this resolutionwwas as follows : AYES : Mr . Wullschleger Mr. Rigano Mr. Burke Mr. Schuler Mr. Maggini NOES: None There being no further business to come before the meeting, it adjourned at 9 P. M. e re ry -11-
