HomeMy WebLinkAbout1950_05_24 Zoning Board of Appeals Minutes MINUTES OF A REGULAR MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK, HELD IN THE BOARD ROOM AT 11 EDGEWOOD AVENUE, LARCHMONT, NEW YORK, ON MAY 24th, 1950. Mr. Quinn called the meeting to order at 8 P. M. PRESENT: Mr. Quinn, Chairman Mr. Wullschleger Mr. Butterfield Mr. Mink Mr. Burke ABSENT: None Presence was also noted of Town Attorney Delius and Building Inspector Foote. On motion by Mr. Butterfield, seconded by Mr. Mink, the minutes of the previous meeting, held April 26th, were approved as pre- sented. Mr. Delius recommended certain changes in the Rules and Regu- lations of the Zoning Board of Appeals and upon motion made by Mr. Mink, seconded by Mr. Butterfield, it was unanimously RESOLVED that Rules 8 and 9 of the Rules and Regula- tions of the Zoning Board of Appeals of the Town of Mamaroneck, be and they hereby are amended to read as follows: 3. All notices of appeal and applications must be filed not later than 12 o' clock noon, on or before the second Wednesday of the calendar month in order to come before the stated meeting of the Zoning Board of Appeals for that month . 9. Notice of the initial hearing of all appeals and applications shall be given by publication thereof once in the official newspaper of the Town of Mamaro- neck, at least five days prior to the date of such hearing. FURThhER RESOLVED that this resolution shall take effect immediately. Mr. Quinn read a letter from William G . Paonessa which had been referred to this Board by the Town Board at its meeting of May 17th. Mr. Paonessa' s letter read as follows: -90- 412 Monroe Avenue Mamaroneck, N. Y . April 20, 1950 Town Clerk, Town of Mamaroneck 158 W. Boston Post Road Mamaroneck, N. Y . Gentlemen: This is in reference to the matter of re- applying for the leasing of Town-owned land for the use of a golf driving range on Boston Post Road south of Hommocks Road. I understand that the leasing of such land would be subject to a change in the variance of the Zoning Law permitting such driving range. I am, therefore, asking that this matter be brought up before the Board for consideration at the earliest possible convenience. Would you also advise me whether this Town-owned property is for sale. Thanking you for your prompt attention in this matter and hoping to receive an early reply, I am Very truly yours, William G. Paonessa /s The Clerk was instructed to check the files to see whether or not this application had previously been before the Zoning Board, and if so, what disposition had been made of it. The application before the Board was that of Shirley L. Goode for modification of Article II, Section 4 of the Zoning Ordinance to permit the erection of a sales office for used car business on premises on the north side of Boston Post Road, 600 feet east from the New Rochelle-Town of Mamaroneck line, known on the Tax Assessment Map of the Town of Mamaroneck as Block 503, Parcel 342. Mr. Edward J . Payne, a real estate broker of 133 Prospect Avenue, Mamaroneck, was present to represent Mr. Goode. Mr. W. L. Rockett appeared representing Mrs. J . L. Smith, owner of premises known as 445 Post Road, Larchmont, and 185 Boston Post Road, New Rochelle, who, he stated, would have no objection tc this application, provided the premises were operated as a legitimate used car business. -91 - Mr. Payne was informed that he would be notified of the Board' s decision. ****** The Board went into executive session and after discussion, on motion duly made and seconded, it was RESOLVED that the appeal of Shirley L. Goode be and the same hereby is granted and the Building Inspector directed to issue a permit for the erection of the pro- , posed building upon the premises involved in this appeal as shown on plan or sketch submitted by the appellant and marked Exhibit "A" as of this date, to be located with a set-back of not less than fifteen (15) feet from the northerly street line of the Boston Post Road, and that the appellant be granted a variance ftom the strict provisions of the Ordinance in that he be permitted to store used cars upon the premises in question, for the purposes of display for sale only; and FURTHER RESOLVED that the variance hereby granted shall not be construed to permit the storage of used auto- mobiles for any purpose other than the sale thereof, and shall not be construed to permit the storage of dilapidated, wrecked or other motor vehicles not in running condition, or the parts thereof; and FURTHER RESOLVED that this variance be granted only upon the applicant' s complying with the follow- ing conditions and limitations: (a) That no cars shall be parked upon any part of said premises closer than the distance from the front of the building to be erected on the premises, to the northerly side of the Boston Post Road; (b) That no part of the premises shall be devoted to the parking or storing of cars beyond a depth of 100 feet from the Boston Post Road; ( c) That no change in the grade of Van Guilder Street as presently existing, shall be made by reason of any filling or grading of the lot or plot which is the subject of this variance; and FURTHER RESOLVED that the variance hereby granted to the applicant is hereby limited in time to the 1st day of July, 1951. - q - - II A vote on this resolution resulted as follows: AYES: Mr. Quinn, Mr. Burke, Mr. Mink, Mr. Wullschleger, Mr. Butterfield NOES: None There being no further business to come before the meeting, it adjourned at 9: 10 P .
