MINUTES OF A REGULAR MEETING OF THE ZONING BOARD OF APPEALS
OF THE TOWN OF MAMARONECK, HELD MAY 22, 1957, IN THE COURT
ROOM OF THE MAMARONECK POLICE DEPARTMENT, 11 EDGEWOOD AVENUE,
TOWN OF MAMARONECK.
CALL TO ORDER
The Chairman called the meeting to order at 8:00 p.m.
PRESENT:

Mr. Sidney Bierman
Mr. George Schuler
MMr. Laurence J. Sobel
Mr. Robert L. Parsons
ABSENT: None
ALSO PRESENT:
Mr. Maurice Friedlander, Town Engineer
Mr. Thomas J. McEvoy, Town Assessor
APPROVAL OF MINUTES
On motion of Chairman Wullschleger, seconded by
Mr. Parsons, the minutes of the meeting of April
24, 1957, were approved as presented.
APPLICATION #1 - Arnold Zelvin
At the request of the Chairman, the Secretary presented
the affidavit of publication of the notice of hearing
as published in the official newspaper of the Town of
Mamaroneck, The Daily Times, on May 15, 1957, and read
the first application as follows:
Application of Arnold Zelvin for modification of
Article III, Section 9 of the Zoning Ordinance, as
amended, so as to permit the construction of an
extension to the existing building on premises

knownas Block 115, Parcel 445 on the Tax Assessment
Map of the Town of Mamaroneck, 3.0 feet on the south-
erly side and 1.3 feet on the easterly side and with-
• in 22 feet of Valley Road, on the ground that Article
III, Section 9 of the Zoning Ordinance of the Town of
Mamaroneck requires that no part of any building shall
be built within 30 feet of any street line, except that
on corner lots such buildings may be set back a less
distance from the side street with the approval of the
Board of Appeals.
The following persons were heard:

Mr. Bernard Rush

In Opposition: None
Mr. Zelvin appeared and submitted plans and' pictures of the
property. He explained that the reason for his request was
that the rooms in his home are inadequate and the addition
of another room is necessary.
Mr. Rush and Mr. Strong also appeared and spoke in favor of
this application
Mr. Zelvin presented two letters, in favor filf the application,
from Mr. Edwin L. TIoiles, 192 Rockingstone Avenue, and
Mrs. E. Stephans, 17 Valley Road. These were read by the
Secretary and filed.
Thereupon, after the Chairman had ascertained that no other
person wished to speak wither for or against this application,
on motion by Chairman 1•?ullschleger, seconded by Mr. Sobel,
the following resolution was unanimously adopted.
WHEREAS, Armld Zelvin, has filed an appeal from a
decision of the Building Inspector of the Town of
Mamaroneck refusing a permit for an structural
addition on property located at the intersection of
Rockingstone and Valley Roads , and known as Block
115, Parcel 445 on the Tax Assessment Map of the
Town of Mamaroneck; and

WHEREAS, Arnold Zelvin requests that because the
present structure is inadequate for his needs, this
Board grant a variance and over-rule the decision
of the Building Inspector; and
WHEREAS, this Board has viewed the property and has
examined the plans on other matter submitted by
the applicant, and has heard all persons appearing
for or against the appeal:
NOW, TIEREFORE, BE IT
RESOLVED that the appeal of Arnold Zelvin from the
decision of the Building Inspector refusing the
issuance of a permit for the construction of an
addition to the existing building on premises lo-
cated at the intersection of Valley and pocking-
stone Roads and known as Block 115, Parcel 445 on
the Tax Assessment Map of the Town of Mamaroneck,
be granted pursuant to Article III, Section 9 of
the Zoning Ordinance of the Town of Mamaroneck,
which required that no part of any building shall
be built within 30 feet of any street line,except
that on corner lots such buildings may be set back
a less distance from the side street with the
approval of the Board of Appeals; and it is
FURTHER RESOLVED that the application of the pro-
visions of the Zoning Ordinance of the Town of
Mamaroneck, i.e. Article III, Section 9 of the
Zoning Ordinance as amended, relating th set back
requirements on premises located at the intersec-
tion of Valley and Rockinz stone Roads and known
as Block 115, Parcel 445 on the Tax Assessment
Map of the Town of Mamaroneck, be varied and mod-
ified so as to allow construction of an addition
to the existing building and having a set back of
22 feet from the street rather than the required
30 feet, provided that the applicant complies in
all other respects with the Zoning Ordinance and
Building Code of the Town of Mamaroneck; and it is
FURTHER RESOLVED that this decision be filed with
the Town Clerk as provided by Section 267 of the
Town Law.
ADJOURNMENT
There being no further business to come before this
meeting is was adjourned at 8:15 p.m. , to reconvene
on the fourth Wednesday of June 26, 1957.
