CALL TO ORDER The Chairman called the meeting to order at 8:00 p. m. PRESENT : MR. A. E. Wullschleger, Chairman Mr. Sydney Bierman Mr. George Schuler ABSENT: Mr. Laurence J. Sobel Mr. Robert L. Parsons ALSO PRESENT: Mr. Thomas J. McEvoy, for Mr. Friedlander, Town Engineer and Building Inspector APPROVAL OF MINUTES The Minutes of the meeting of February 27, 1957, were approved as presented. APPLICATION # 1 - --DAYHAR REALTY CORPORATION At the request of the Chairman , the Secretary presented the affidavit of publication of the notice of hearing as published in the official newspaper of the Town of Mamaroneck, The Daily Times, on March 22, 1957, and read the first application as follows: Application of Alfred Willis, Agent for Dayhar Realty Corporation, for modification of Article II, Section 4, of the Zoning Ordinance of the Town of Mamaroneck, granting a variance or license to use appellant's prop- erty located on the south side of the Boston Post Road, approximately 695 feet easterly from Bronson Avenue, and known on the Tax Assessment Map of the Town of Mamaroneck as Block 411, Parcel 242, so as to allow the erection of an addition to the present building, 134 and to be located within 200 feet of the Boston Post Road, attached to the southerly side of the present building and adjoining its westerly wall and not -6C project beyond the rear line of the present existing building, said addition to be used as an automobile repair shop. The following persons were heard: For Appellant : Alfred Willis, 24 Weaver St. , Larchmont, Agent for Dayhar Realty Corporation Mr. M. J. Abbene, 10 Boston Post Road, Larchmont, N. Y. In Opposition: None Mr. Willis, agent for Dayhar Realty Corporation, presented the plot plan, as filed with this application and with the Building Inspector. He explained that in accordance with the variance granted on Sept. 15, 1948, the appellant was requesting a further variance to construct an addition to the present building, to be located within 200 feet of the Boston Post Road and attached to the southerly side of the present building and adjoining its westerly wall and not to project beyond the rear line of the present existing building, which addition is to be used as an automobile repair shop. Mr. Willis stated that the variance previously granted to Dayhar Realty Corporation which operates an automobile sales and service business on the premises, has proved to be unpractical, in that the part of the property in the rear of the principal building cannot be used for any business purpose altho it is within 200 feet from the Boston Post Road. Under the circumstances he asked that the variance be modified so as to allow the extension maff the building as a general repair shop. At the request of the Chairman, and for the information of the members of the Zoning Board of Appeals, Mr. Bierman then read a resolution directly concerning the present application as adopted by the Zoning Board of Appeals, on November 25, 1952. Thereupon, after the Chairman had ascertained that no other person wished to speak either for or against this application, on motion by Chairman Wullschleger, seconded by Mr. Schuler, the following 135 resolution was unanimously adopted. WHEREAS, Alfred Willis, agent for Dayhar Realty Corpor- ation has filed an appeal from a decision of the Building Inspector of the Town of Mamaroneck refusing a permit for a structural addition on property located on the south side of Boston Post Road, 695 feet easterly from Bronson Avenue, and known on the Tax Assessment Map of the Town of Mamar- oneck as Block 411 , Parcel 242; and WHEREAS, Alfred Willis requests that because of practical difficulty and unnecessary hardsl.:ip, this Board grant a further variance and over-rule the decision of the Building Inspector; and WHEREAS, this Board had viewed the property and has ex- amined the plans and other matters submitted by the appli- cant, and has heard all persons appearing for or against the appeal; NOW, THEREFORE, BE IT RESOLVED thatthe appeal of Alfred Willis, agent for Dayhar Realty Corporation from the decision of the Building Inspec- tor refusing the issuance of a permit for a structural addi- tion to the present building, located on the south side of Boston Post R oad 695 feet easterly from Bronson Avenue, and known on the Tax Assessment Map of the Town of Mamaroneck as Block 411, Parcel 242, be granted on the grounds of practical difficulty and unnecessary hardship as recited in the application and which this Board finds exists; and it is FURTHER RESOLVED that the application of the provisions of the Zoning Ordinance of the Town of Mamaroneck, i. e. Article II, Section 4 of the Zoning Ordinance relating to the construction of a structural addition to the existing building on premises located on the south side of the Boston Post Road, 695 feet easterly of Bronson Avenue and known as Block 411 , parcel 242 on the Tax Assessment Map of the Twon of Mamar- oneck, be varied and modified so as to allow the construction of said addition to the existing building in accordance with 136 • with the plan filed with the Building Inspector and located within 200 feet of the Boston Post Road, attached to the • southerly side of the present building and adjoining its westerly wall, and not to project beyond the rear line of the present existing building, provided that the applicant complies in all other respects with the Zoning Ordinance and Building Code of the Town of Mamaroneck; and it is FURTHER RESOLVED that this variance shall be granted only subject to the following conditions; (1) That any structural additions hereafter made upon such premises, shall be subject to the approval of the Board of Appeals. (2) That said premises be maintained in a neat and clean condition, and that no dilapidated, wrecked automobiles, motor vehicles or parts thereof nor any motor vehicles not in good running condition be permitted to be stored upon said premises. FURTHER RESOLVED that this decision be filed with the Town Clerk as provided by Section 267 of the Town Law. ADJOURNMENT There being no further business to come before this meeting, it was adjourned at 8:30 p. m. , to reconvene on the fourth Wednesday of April, April 24, 1957.
