HomeMy WebLinkAbout1953_03_25 Zoning Board of Appeals Minutes MINUTES OF A REGULAR MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK, HELD ^_ARCH 25, 1953, AT THE MAMARONECK TOWN POLICE STATION, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. The meeting was called to order at 8 P . M. PRESENT: Mr. Fred L . Maggini Mr. C . Benjamin Brush, Jr. Mr. Joseph J . Rigano ABSENT: Mr. A. E. Wullschleger, Chairman Mr. Morgan J. Burke, Jr. In the absence of Mr. Wullschleger, Mr. Brush acted as Chairman of the meeting. Presence was also noted of Mr. McEvoy, Building Inspector, Mr. Delius, Town Attorney, and Mrs. Barnes, Clerk to the Board. On motion duly made and seconded, the minutes of the previous meet- ing, held February 25, 1953, were approved as presented. The first application before the Board was that of M. Shapiro & Son Construction Co. , Inc., for modification of Article II, Sec- tion 7 of the Zoning Ordinance to permit provision of garage space for each apartment as shown on plans for a proposed new apartment house to be erected on the north side of Palmer Avenue, 1,100 feet west from Weaver Street, on premises known as Block 401, Parcel 1, on the Assessment Map of the Town of Mamaroneck. Mr. Joseph M. Johnston, an attorney, appeared and requested an adjournment of this application, which was granted. The next application before the Board was that of Rockledge Hold- ing Corp. for modification of Article III, Section 9 of the Zon- ing Ordinance as amended, to permit the erection of a building on a corner lot to be less than 40 feet from the street line on premises located at No. 2 Dudley Lane, and known as Lot 2 on Seconded Amended Map of Glen Eagles Ridge, Section One, belonging to Rockledge. Holding Corp. , Town of Mamaroneck, Westchester County, N. Y. , made by A. J. Foote, C . E. and S. , dated June 2, 1952, and filed in the County Clerk' s Office, Division of Land Records on • June 5, 1952, as Map No. 7726, and also known on the Tax Assessment Map of the Town of Mamaroneck as Block 313, part of Parcel 148. Mr. Reginald E. Crawford, Secretary of Rockledge Holding Corp. , appeared in behalf of the applicant and submitted plans and addressed the Board. He said the parcel of land on the north has a brook running through it which drains the Winged Foot Golf Club. The land must be filled and a strong retaining wall built. The brook runs inside the property line. -115- There was no opposition present. The Clerk read a letter from Mrs. Edgar I . Roedelheimer, 2 Boulder Brae Lane, advising the Board that she is opposed to the granting of this variance. The last application before the Board was that of Eugene R. Giancola, Jr. , for modification of Article III, Section 9 of the Zoning Ordin- ance as amended, to permit the erection of a one-family dwelling with less than 19,000 cubic feet of content on premises located at 773 Forest Avenue, known on the Tax Assessment Map of the Town of Mamaroneck as Block 210, Parcel 25 . Mr. Eugene Giancola, . Sr. , appeared representing the applicant and stated that the nature of the land in question is such that a larger house could not be erected there. He submitted plans of the contemplated house which will be 36 feet by 28 feet and con- tain 15,200 cubic feet exclusive of the cellar. The surrounding houses all contain less than 19,000 cubic feet. There was no opposition present. The Board then went into executive session and on motion duly made and seconded, the following resolution was adopted: WHEREAS, Eugene R. Giancola, Jr. has appealed to this Board for modification of Article III, Section 9, of the Zoning Ordinance as amended, to permit the erection of a one-family dwelling with less than 19,000 cubic feet of content, on premises located at 773 Forest Avenue, known on the Tax Assessment Map of the Town of Mamaroneck as Block 210 Parcel 25; and WHEREAS, this application has come on duly to be heard be- fore this Board at its regular meeting, held March 25, 1953; and WHEREAS, it appears that it would be an unnecessary hard- ship to require the applicant to comply with the strict provisions of the Ordinance, NOW, THEREFORE, BE IT RESOLVED that the appeal of Eugene R. Giancola, Jr. ` be and the same hereby is allowed and the decision of the Building Inspector reversed to the extent of permit- ting the erection of a one-family dwelling with less than 19,000 cubic feet of content, to wit, 15,200 cubic feet, exclusive of cellar, on premises located at 773 Forest Avenue, known on the Tax Assessment Map of the Town of Mamaroneck as Block 210 Parcel 25 in accordance with plans and speci- fications filed in connection with this application, pro- vided, however, that in all other respects, applicant com- ply with the provisions of the Zoning Ordinance and Build- ing Code of the Town of Mamaroneck. -116- The vote recorded on this resolution was as follows: AYES: Mr. Brush Mr. Rigano Mr. Maggini NOES: None The Board next took up the application of Rockledge Holding Corp. and some residents of that section entered the meeting. Mr. Brush informed them that the Board was in executive session but would be willing to hear whatever they might wish to say. They registered their names with the Clerk as follows: Mr. Edward B. Polak, 1 Boulder Brae Lane Mr. M. Sluis, 4 Boulder Brae Lane Mrs. Howard Lichtenstein, 3 Boulder Brae Lane Mr. Polak stated that they objected to the granting of the variance and stated that he owned a strip of land abutting Mr. Moody' s land, over which he would not permit access. The map which had been filed with the application did not show this strip. After discussion, the Board agreed to adjourn decision on this matter as it appears that the survey is incorrect insofar as part of the land on Boulder Brae Lane belongs to Mr. Edward Polak. There being no further business to come before the Board, it adjourned at 9 P. M. Secretary -117-
