TOWN OF MAMARONECK, HELD MARCH 23, 1955, IN THE ROOM ASSIGNED TO THE
BOARD AT MAMARONECK TOWN POLICE HEADCUARTERS, 11 EDGEWOOD AVENUE, TOWN.
• PRESENT: Mr. Wullschleger, Chairman
Mr. Rigano
• Mr. Burke
Mr . Schuler
• Mr. Maggini
ABSENT: None
Presence was also noted of Mr. McEvoy, Building Inspector and Mrs .
Barnes, Clerk to the Board and Recording Secretary.
• Mr. Wullschleger called the meeting to order at 8 P. M. , and on motion
duly made and seconded, the minutes of the previous meeting, held
• February 23, 1955, were approved as presented .
• The first application before the Board was that of Alfred Willis, as
agent for Fazio, for modification of Article III , Section 9, of the
• Zoning Ordinance, to permit a proposed one-story addition to the
westerly side of present residence with a set-back of less than
• 30 feet from the street, to wit, 17.45 feet, on premises located
at 30 Weaver Street and known on the Tax Assessment Map of the
Town of Mamaroneck as Block 410 Parcel 420 .
4 Mr. Willis , an architect, 132 Larchmont Avenue, appeared and addressed
• the Board . He presented blue prints and plot plan and stated that the
house is a non-conforming use . The owner wants to enclose a porch
• over the garage and extend it 6 feet to make an additional room.
• There were a number of Mr. Fazio 's neighbors present who designated
their approval of the application and the following registered
their names with the Clerk:
• Mrs . John Civettini, 37 Weaver Street
Mrs . Rose Garofalo, 24 Weaver Street
• Mr . Fred Dodenhoff, 23 Weaver Street

There was no opposition .
Thereupon, on motion by Mr. Wullschleger, which was duly seconded ,k
it was unanimously •
RESOLVED that the above hearing be and it hereby
is closed .
The second application before the Board was that of Alfred Willis ,
• as agent for Becroft, for modification of Article III , Section•, 9
of the Zoning Ordinance, to permit construction of a one-family
• residence on a corner plot, with a set-back from Lafayette Road
`1 of less than the required 30 feet, to wit, 20 feet, on premises
located at the corner of North Chatsworth Avenue and Lafayette
Road and known on the Tax Assessment Map f the Town of Mamaroneck -
; as Block 133, Parcel 95.

Mr . Willis again appeared, submitting blue prints of the proposed
house and a plot plan, and addressed the Board . He said this is
•
a difficult lot on which to build as part of it is very low. The
• house will be kept 30 feet back from North Chatsworth Avenue and
28 feet from Lafayette Road at one corner and 20 feet at another
corner. This will permit the owner to get a car in and out of the
• garage . He said he had given this lot great study and feels that
the proposed house is the best and most practical . There will be
• a certain amount of necessary filling to be done . Also there is
a problem of "cars coming down the street and their lights shining
in the windows" .
• Mr. Louis M. Bernstein, 1 Huguenot Drive, addressed the Board next.
He said that he and his neighbors had studied the plans which had
• been delivered to them by Mr . Willis at the request of Mr. Bogardus,
and they wished to be helpful . He said it was their understanding
• that a variance, if granted, would be on the plans submitted, with
no changes permitted, and if this were the case, he and his neighbors
would be in favor of the application. The residents on Chatsworth
Avenue and Lafayette Road "feel that a resonable effort has been
made here to ,do something correct in the community and they consider
• it something sound and correct and they are delighted to say they
support the application" .
Mr. Robert L. Parsons, 42 North Chatsworth Avenue and Mr . Julian Bers ,
• 9 Lafayette Road, also registered approval of the application.
There was no opposition . •
• Mr. Willis was complimented by Mr. Burke upon the cooperation he had
given to the residents in the area of the subject property.
On motion duly made and seconded, it was unanimously
RESOLVED that the above hearing be and it hereby
• is declared closed .
• The Board then went into executive session and considered the applica-
• tion of Fazio and after some discussion, on motion duly made and
seconded, the following resolution was adopted :
WHEREAS, Alfred Willis, as agent for `Razio, has appealed to this
• Board for modification of Article III , Section 9 of the Zoning
Ordinance, to permit a proposed one-story addition to the westerly
• side of present residence with a. set-back of less than 30 feet
from the street, to wit, 17.45 feet, on premises located at 30
• Weaver Street and known on the Tax Assessment Map of the Town of
Mamaroneck as Block 410 Parcel 420; and
WHEREAS, this application has come on duly to be heard by
• this Board at its meeting held March 23 , 1955; and

WHEREAS , the members of this Board have inspected the property
for which a variance is requested ; and
• WHEREAS , because of the character of the neighborhood and the
fact that this house is a non-conforming use, it appears that it
• would be an unnecessary hardship to require applicant to comply
with the strict provisions of the Ordinance ; and
WHEREAS, all persons , either in favor of or against this appli-
cation, have been heard,
NOW, THEREFORE, BE IT
RESOLVED that the appeal of Alfred Willis, as agent for
• Fazio, be and it hereby is allowed, and the decision of
the Building Inspector reversed to the extent of permit-
• ting a proposed one-story addition to the westerly side
of present residence with a set-back of less than 30 feet
• from the street, to wit, 17.45 feet, on premises located
at 30 Weaver Street and known on the Tax Assessment Map
• of the Town of Mamaroneck as Block 410 Parcel 420, in
accordance with plans filed with the Building Inspector,
• provided, however, that in all other respects, applicant
comply with the Zoning Ordinance and Building Code of
• the Town of Mamaroneck.
A vote was recorded on this resolution as follows :

The Board next considered the application of Becroft and, after
• discussion, on motion duly made and seconded, the following resolu-
tion was adopted :

• a corner plot, with a set-back from Lafayette Road of less than

RESOLVED that the appeal of Alfred Willis , as agent for
