OF MAMARONECK, HELD JUNE 25th, 1952, AT THE MAMARONECK TOWN POLICE STA-
TION, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK.
Mr. Wullschleger called the meeting to order at 8 P . M.

Presence was also noted of Mr. McEvoy, Building Inspector/,A and Mrs.
Barnes, Recording Secretary and Clerk to the Board.
On motion duly made and seconded, the minutes of the previous meeting,
held May 28th, 1952, were approved as presented.
The only application before the Board was that of Thomas Scappaticci
for modification of Article III, Section 9 of the Zoning Ordinance to
permit the erection of a one-family dwelling with a set-back from the
front street-line of 20 feet instead of the required 30 feet on pre-
mises known as No. 8 Vine Road and also known as Block 107, Parcel 320
on the Tax Assessment Map of the Town of Mamaroneck.
Mr. Alfred Willis, Architect, 132 Larchmont Avenue and Mr. Thomas
Scappaticci, the applicant, were both present.
Mr. Willis addressed the Board and said that Mr. Scappaticci had pur-
chased the lot about a month ago and will build a house to sell. He
said the lot is very rocky and is level for about 40 feet and then
there is a drop of 18 or 20 feet.
Mr. Willis submitted plans of the proposed house.
Mr. Willis said the houses on both sides of Mr. Scappatticcits lot are
30 and 25 feet respectively back from the Street line .
Mr. C . De Witt Rogers, 4 Vine Road appeared and said his house is the
second house from the subject property. His house sets back about
35 1/4 feet. He objects to the proposed house because he feels if it
stands out in front of his house, it will be an eyesore. He believes
the request for a variance is made only to save money as, if the vari-
ance is not granted, blasting will be necessary, and he feels that added
expense is not a hardship in a case where the lot was purchased so re-
cently.
Mr. Marvin A. Rothlein, 6 Vine Road, believes the house will block his
view. He has owned his property since 1947-
M r. Stanley P . Judkins, 6 Villa Road, submitted photographs which were
taken from his driveway. These were received and filed. He said the
lot is level to a depth of approximately 70 feet and the drop is
between 10 and 12 feet.

Mr. John M. Elliott, 3 Vine Place, objects to the house and believes
the Zoning Ordinance should be upheld.
Mr. William T . Wright, 22 Vine Road, registered objection.
Mr. Gordon Biggar, 3 Vine Road, registered objection as he feels a
variance will deteriorate the neighborhood.
Mr. Willis said his client would be willing to compromise and accept
a variance of 3 feet for just the garage part of his house.
Mr. Scappaticci said if the variance is not granted he will be obliged
to erect a cheaper house .
The surrounding neighbors agreed that this would be preferable to a
house protruding beyond the 30 foot line.

The Board then went into executive session and discussed the applica-
tion.
Upon motion duly made and seconded, it was
RESOLVED that the appeal of Thomas Scappaticci for modi-
fication
of Article III, Section 9 of the Zoning Ordinance
to permit the erection of a one family dwelling with a set-
back from the front street-line of 20 feet instead of the
required 30 feet, on premises known as No. S Vine Road and
also known as Block 107 Parcel 320 on the Tax Assessment
Map of the Town of Mamaroneck, be and the same hereby is
denied, on the ground that the applicant has failed to show
unnecessary hardship or practical difficulty in abiding
by the provisions of the Ordinance.
A vote taken on this resulted as follows:

Mr. Rigano

There being no further business to come before the meeting, it adjourned
at 9: 15 P . M.
