MINUTES OF A REGULAR MEETING OF THE ZONING BOARD OF APPEALS OF THE
TOWN OF MAMARONECK, HELD JUNE 22, 1955, IN THE ROOM ASSIGNED TO THIS
BOARD AT MAMARONECK TOWN POLICE HEADQUARTERS, 11 EDGEWOOD AVENUE, TOWN .
PRESENT: Mr . Wullschleger, Chairman
Mr. Maggini
Mr. Schuler
ABSENT: Mr. Burke
Mr. Rigano
Presence was also noted of Mr. McEvoy, Building Inspector, and Mrs .
Barnes, Clerk to the Board and Recording Secretary.
Mr. Wullschleger called the meeting to order at 8 P. M. , and on
motion duly made and seconded, the minutes of the previous meeting,
held May 25, 1955, were approved as presented .
The first application before the Board was that of B. S . Goldman
for modification of Article III , Section 9 of the Zoning Ordinance
to permit extension of a building (which was erected pursuant to
terms of a variance granted May 5, 1948, permitting erection of
a building 23 feet 2 inches from street line) i .e. addition of
a screened porch to be 24 feet 9 inches from front street line,
on premises located at 5 Rockland Avenue and known on the Tax
Assessment Map of the Town of Mamaroneck as Block 221 Parcel 121.
Mr. Goldman appeared and submitted a plot plan and answered questions
put to him by the various Board members .
The Building Inspector presented the blue prints of the proposed
extension.
Also presented to the Board was a written statement from G. J. O'Reilly,
President of Macar Holding Co. , stating that as a representative of the
only property directly affected by this application, he endorsed the
indicated improvement to the Goldman property. This was received
and filed.
There was no opposition to the application.
After some further discussion, the Chairman declared the hearing closed.
The Board then went into executive session and on motion duly made and
seconded, the following resolution was adopted:
WHEREAS, B. S . Goldman has appealed to this Board for modification
of Article III , Section 9 of the Zoning Ordinance to permit extension
of a building (for which a variance was granted May 5, 1948) i .e.
addition of a screened porch to be 24 feet 9 inches from front street
line (previous variance allowed erection of house 23 feet 2 inches from
street) on premises located at 5 Rockland Avenue and known on the Tax
Assessment Map of the Town of Mamaroneck as Block 221 Parcel 121 ; and
WHEREAS , this application has come on duly to be heard by this
Board at its regular meeting held June 22, 1955; and

WHEREAS, it appears that a variance was granted to applicant on
May 5, 1948 by a former Zoning Board, permitting erection of this
dwelling within 30 feet of the front street line, i .e. 23 feet 2 inches ;
and
WHEREAS , applicant now wishes to extend said dwelling by the
addition of a screened porch within 30 feet of the front street line,
i.e . 24 feet 9 inches ; and
WHEREAS , all persons, either in favor of, or opposed to this
application, have been heard,
NOW, THEREFORE, BE IT
RESOLVED that the appeal of B. S . Goldman be and it hereby is
granted and the decision of the Building Inspector reversed
to the extent of permitting the addition of a screened porch
within 30 feet of the front street line, i .e. 24 feet 9 inches
from Rockland Avenue, in accordance with plans filed with
the Building Inspector, on premises at 5 Rockland Avenue,
known on the Tax Assessment Map of the Town of Mamaroneck
as Block 221 Parcel 121, provided that in all other respects
applicant comply with the Zoning Ordinance and Building Code
of the Town of Mamaroneck.
The vote recorded on this resolution- was as follows :

There being no further business to come before the meeting, it ad-
journed at 8:30 P. M.
