HomeMy WebLinkAbout1953_07_22 Zoning Board of Appeals Minutes LINUTES OF A REGULAR IEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK HELD JULY 22 1953, IN THE MALARONECK TOWN POLICE STATION, 11 EDGEWOOD AVENUE, TOWIt: OF LiAL,.ARUI'ECK. The meeting was called to order at 8 P. M. , by Mr. Burke who acted as Chairman in the absence of Mr . Wullschleger . PRESENT: Mr . Burke, Acting Chairman Mr . Brush Mr . Rigano ABSENT: Mr . Wullschleger Mr . Maggini Presence was also noted of Hr. McEvoy, Building Inspector, and I�r. Delius, Town Attorney. On motion duly made and seconded, the minutes of the previous meeting, held June 24, 1953, were approved as presented. The first application before the Board (which application had been before this Board on Larch 25, 1953, and on April 22, 1953) was that of M. Shapiro & Son Construction Co. , In. , for r odification of Article II, Section 7 of the Zoning Ordinance, to permit provision of garage space for each apartment asshown on plans for a proposed new apartment house to be erected on the north side of Palmer Avenue on premises known as Block 401 Parcel 1 on the Assessment Map of the Town of Mamaroneck. (65 Palmer Avenue) No one appeared in behalf of this applicant and Mr. Price Topping, President of Howell Park Association, suggested that the natter be put over until the Town Board has passed on the amendment to the Zoning Ordinance . This matter was adjourned to the next regular r'eeting. The next application to core before the Board was that of Adam Sumetz for modification of Article III, Section 9 of the Zoning Ordinance, to permit erection of a one-family dwelling within 30 feet of the front property line, to wit, 25 feet, on premises on the west side of Little Farms Road, known as 18 Little Farms Road, and also known as Block 212 Parcel 121, on the Assessment Map of the Town of Mamaroneck. ` Mr . Adam Sumetz appeared in his own behalf . He stated that he had not actually closed the transaction which would give him title to this property but expected to do so on August 4th. Mr. Burke inquired whether he had contracted to purchase the property with knowledge of .the Zoning Ordinance restriction. Mr. Sumetz stated that there is a rock ledge running through the pro- perty which prevents compliance with the Zoning Ordinance . He sub- mitted plans of the proposed house . -141- Mrs . Alan R. Ernst, 22 Little Farms Road, thought he could comply with the Zoning Ordinance if it meant blasting another 5 or 6 feet. The Board then went into executive session and, after discussion, upon motion duly rade and seconded, the following resolution was adopted: WHEREAS Adar. Suretz has appealed to this Board for modification of Article III, Section 9 of the Zoning Ordinance, to permit erection of a one-family dwelling within 30 feet of the front property line , to wit, 25 feet, on premises on the west side of Little Farrs Road, known as 18 Little Farms Road, and also known as Block 212 Parcel 121 on the Assessment flap of the Town of Mamaroneck; and WHEREAS, this application has come on duly to be heard by this Board at its regular reeting, held July 22, 1953 ; and WHEREAS, it appears that it would be an unnecessary hardship, be- cause of the ledge of rock running through the property, to require the applicant to comply with the strict provisions of the Ordinance, NOW, THEREFORE, BE IT RESOLVED that the appeal of Adam Sumetz be and the same hereby is allowed and the decision of the Building Inspector reversed to the extent of permitting construction of a one- family dwelling within 30 feet of the front street line , to wit 25 feet, on premises on the west side of Little Farms Road, known as 18 tittle Farms Road, and also known as Block 212 Parcel 121 on the Assessment Map of the Town of Mamaroneck, in accordance with plans and specifications filed in connec- tion with this application, provided, however, that in all other respects, applicant comply with the provisions of the Zoning Ordinance and Building Code of the Town of Mamaroneck. A vote recorded on this resolution was as follows: AYES: Ir . Burke Ir . Brush Mr. Rigano NOES: None 4 There being no further business to come before the neeting, it adjourned at 9:30 P. P.
