HomeMy WebLinkAbout1953_01_28 Zoning Board of Appeals Minutes MINUTES OF A REGULAR MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK, HELD JANUARY 28, 1953, AT THE MAMARONECK TOWN POLICE STATION, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. In the absence of Mr. Wullschleger, Mr. Brush acted as Chairman and called the meeting to order at 8 P . M. PRESENT: Mr. Brush, Acting Chairman Mr. Rigano Mr. Maggini ABSENT: Mr. Wullschleger, Chairman Mr. Burke Presence was also noted of Mr. Delius, Town Attorney, Mr. McEvoy, Building Inspector, and Mrs. Barnes, recording secretary and Clerk to the Board. On motion duly made and seconded, the minutes of the previous meeting held November 25, 1952, were approved as submitted. The application before the Board was that of Gustave Kilthau, R. A. , agent for John H. Banks, for modification of Article II, Section 3 of the Zoning Ordinance to permit 3-family occupation with adequate room and sanitary facilities provided by alteration to existing second floor of structure as required by present occupants, premises on the north side of Fifth Avenue, 50 feet east from Williams Place, known on the Tax Assessment Map of the Town of Mamaroneck as Block 132, Parcel 23. Plans and a survey were submitted, and Mr. Kilthau appeared in behalf of the application and addressed the Board. He said the Banks family situation is such that there are two brothers, a son and possibly a sister with their respective families to occupy the house. Another son is coming out of the Army and will need living quarters. They want to raise the roof of the house in question so they can get good rooms on the second floor. There is a basement, first floor and second floor in the house. These people will be living there whether they obtain a variance or not and Mr. Kilthau feels their living conditions will be greatly improved if they are granted this vari- ance. It will not be in the nature of an apartment, it is merely to provide for the expansion of the family. Mr. Banks owns the property free and clear. The alteration will cost in the neighborhood of $3,500. There are, at present, three families living in the house and there are multi-family houses next door, across the street and in the rear of the subject property which is known as 616 Fifth Avenue. This alteration will not alter the character of the neighborhood. -108- There was no opposition to this application. The Board then went into executive session and on motion duly made and seconded, the following resolution was adopted: WHEREAS, Gustave Kilthau, R. A. , agent for John H. Banks, has appealed to this Board for modification of Article II, Section 3 of the Zoning Ordinance to permit 3-family occupation with adequate room and sanitary facilities provided by alteration to existing second floor of structure as required by present occupants, on premises on the north side of Fifth Avenue, 50 feet east from Williams Place, known on the Tax Assessment Map of the Town of Mamaroneck as Block 132 Parcel 23 and also known as 616 Fifth Avenue; and WHEREAS, this application has come on duly to be heard before this Board at its regular meeting, held January 28, 1953; and WHEREAS, it appears that it would be an unnecessary hardship to require the applicant to comply with the strict provisions of the Ordinance, NOW, THEREFORE, BE IT RESOLVED that the appeal of Gustave Kilthau, R. A . , agent for John H. Banks, be and the same hereby is allowed and the de- cision of the Building Inspector reversed to the extent of permitting 3-family occupation with adequate room and sanitary facilities provided by alteration to existing second floor of structure as required by present occupants on premises on the north side of Fifth Avenue, 50 feet east from Williams Place, known on the Tax Assessment Map of the Town of Mamaroneck as Block 132 Parcel 23 and also known as 616 Fifth Avenue, in accordance with plans and specifications filed in connection with this application, provided, however, that in all other respects, applicant comply with the provisions of the Zoning Ordinance and Building Code of the Town of Mamaroneck and the Multiple Residence Law of the State of New York. A vote taken on this resolution resulted as follows: AYES: Mr. Brush Mr. Rigano Mr. Maggini NOES: None There being no further business to come before the meeting, it ad- journed at 8:45 P .
