HomeMy WebLinkAbout1954_01_27 Zoning Board of Appeals Minutes MINUTES OF A REGULAR MEETING OF THE Z ONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK, HELD JANUARY 27, 1954, IN THE COURT ROOM OF THE MAMARONECK TOWN POLICE DEPARTMENT, 11 EDGEWOOD AVENUE, TOWN OF MAMARO- NECK. Mr. Wullschleger called the meeting to order at 8 P. M. PRESENT: Mr. Wullschleger, Chairman Mr. Burke Mr. Schuler ABSENT: Mr. Rigano Mr. Maggini Presence was also noted of Mr. Delius, Town Attorney, Mr. McEvoy, Building Inspector, and Mrs. Barnes, Clerk to the Board and Record- ing Secretary. Upon motion duly made and seconded, the minutes of the previous meet- ing, held December 23, 1954, were approved as presented. The Chairman welcomed Mr. George Schuler, the new member replacing Mr. C. Benjamin Brush who was elected to the Town Council at the recent general election. On motion by Mr. Wullschleger, seconded by Mr. Burke, it was unanimously RESOLVED that this Board accepts with great regret the resignation of C. Benjamin Brush, Jr. , who has so ably served as a member of the Zoning Board of Appeals of the Town of Mamaroneck for three years. His wise counsel and good judgment have been a great help to his associates. FURTHER RESOLVED that this Board extends to C. Benjamin Brush, Jr. , its best wishes for success in his new duties as a member of the Town Council. FURTHER RESOLVED that the Clerk be and sne hereby is instructed to send a copy of this resolution to Mr. Brush. The application before the Board was that of Armand Mignarri for modi- fication of Article II, Section 7 of the Zoning Ordinance to permit erection of an office building and commercial garage to store equip- ment used in the landscaping and nursery business, such as lawn mowers and small tractors, on premises on the east side of valley Place, (8 Valley Place) (Business District C) known on the Tax Assess- ment Map of the Town of Mamaroneck as Block 131 Parcel 11. Mr. Mignarri appeared and submitted plans of the proposed building. There was no opposition to this application. There was some discussion and the Board went into executive session. On motion duly and seconded, the following resolution was adopted: WHEREAS, Armand Mignarri has appealed to this Board for modifica- tion of Article II, Section 7 of the Zoning Ordinance, to permit erection of an office .building and commercial garage to store equip- ment used in the landscaping and nursery business, sucn as lawn mowers and small tractors, on premises on the east side of Valley Place (8 valley Place) (Business District C) known on the Tax Assessment Map of the Town of Mamaroneck as Block 131 Parcel 11; and s WHEREAS, this application has come on duly to be heard by this Board at its regular meeting, held January 27, 1954; and WHEREAS, it appears tnat it would be an unnecessary hardship, because of the character of the property and the neighborhood, to require the applicant to comply with the strict provisions of the Ordinance; and WHEREAS, all persons, either in favor of or against this application, have been heard, NOW, THEREFORE, BE IT RESOLVED that the appeal of Armand Mignarri be and the same hereby is allowed and the decision of the Building Inspector reversed to the extent of permitting erection of an office building and commercial garage to store equipment used in the landscaping and nursery business, such as lawn mowers and small tractors, on premises on the east side of Valley Place (8 valley Place) (Busi- ness District C) known on the Tax Assessment Map of the Town of Mamaroneck as Block 131 Parcel 11, in accordance with plans and specifications filed in con- nection with this application, provided, however, tnat in all other respects, applicant comply with the provi- sions of the Z oning Ordinance and Building Code of the Town of Mamaroneck.
