OF THE TOWN OF MAMARONECK, HELD JANUARY 25, 1956, IN THE
COURT ROOM OF THE MAMARONECK POLICE DEPARTMENT,
11 EDGEWOOD AVENUE, TOWN OF MAMARONECK.
Mr. Wullschleger called the meeting to order at 8 p. m.
PRESENT: Mr. Wullschleger, Chairman
Mr. Maggini
Mr. Rigano
Mr. Schuler
ABSENT: Mr. Burke
Also Present: Mr. McEvoy, Building Inspector
On motion duly made and seconded, the minutes of the previous meeting held
December 28, 1955, were approved as presented.
HEARING: The application of David R. Schwarz for
modification of Article II, Section 7 as amended to permit the erection of a
detached car port which is to have a set back of 30 feet rather than the re-
quired 75 feet from the street. This is requested for the property located
off Fenimore Road and designated on the Tax Assessment Map as Block 320,
Part of Parcel 1.
Mr. Schwarz appeared in behalf of the application and explained that the lot
is high and rocky and due to the position of the rock, elevation of the ground
and the necessity of fill, his Architect felt that a detached garage might be
preferable. For this reason and before proceeding further with the plans,
he requested that the Board give consideration to this matter.
Chairman asked if there is anyone present who wishes to be heard in favor
of the application.
No one appeared.
Chairman asked if there is anyone present who wishes to be heard in opposition
to this application.
No one appeared in opposition.
Chairman thanked Mr. Schwarz for appearing.

HEARING: The application of Hubert M. Finnerty
as agent for Marjorie Petigor & Ors. for modification of Article III, Section 9
to permit a set back of 20 feet on a corner lot instead of the required 30 feet.
This is requested for the premises located on the corner of Blossom Terrace
and Merritt Street and designated on the Tax Assessment Map as Block 403,
Part of Parcel 299.
The application of Hubert M. Finnerty
as agent for Marjorie Petigor & Ors. , for modification of Article III, Sec-
tion 9 to permit a set back of 20 feet on a corner lot instead of the required
30 feet. This is requested for the property located on the corner of Palmer
Avenue and Merritt Street and designated on the Tax Assessment Map as
Block 403, Part of Parcel 61.
Mr. Finnerty appeared in behalf of the aforementioned applications and stated
that in order to meet the suggestions made by this Board at the hearing held
December 28, 1955, in connection with this matter he had made several changes
in the plans as now filed with the Building Inspector which he hoped would meet
with the Board's approval.
Chairman asked if there is anyone present who wishes to be heard in favor of
the application. No one appeared.

to this application.
No one appeared in opposition.
HEARING: The application of Raymond G. Richards
of 54 Edgewood Avenue, Larchmont, New York, for modification of Article III,
Section 9 to permit a set back of 20 feet on a corner lot instead of the required
30 feet. This is requested for the premises adjacent to No. 54 Edgewodd Avenue
and designated on the Tax Assessment Map as Block 122, Part of Parcel 15.
Mr. Viggo Borgen, Real Estate Broker, appeared in behalf of Mr. R. G.
Richards of 54 Edgewood Avenue, Larchmont, N. Y. , and asked permission to
set a new house on Edgewood Avenue, between Judson Street and Hillcrest Avenue,
20 feet instead of 30 feet from Hillcrest Avenue. Mr. Borgen explained that the
set backs on the other two streets are 30 feet or more. He pointed out that the
houses on the dead end of Hillcrest Avenue are built almost on the street line.
Chairman asked if there is anyone present who wishes to be heard in favor of
the application. No one appeared.

After discussion of the application of David R. Schwarz, it was, on motion
duly made and seconded:
RESOLVED that the application of David R. Schwarz
for modification of Article II, Section 7 as amended
to permit the erection of a detached car port which is
to have a set back of 30 feet rather than the required
75 feet from the street in connection with the property
located off Fenimore Road and designated on the Tax
Assessment Map as Block 320, Part of Parcel 1 , be

plicant has failed to show unnecessary hardship or
practical difficulty in abiding by the strict provisions

On motion duly made and seconded the following resolution was adopted;
WHEREAS Hubert M. Finnerty as agent for
Marjorie Petigor & Ors. , has appealed to this Board for
modification of Article III, Section 9 of the Zoning Ordinance;
and
WHEREAS this application has come on duly to be
heard by this Board at its meeting held December 28, 1955;
and
WHEREAS all persons, either in favor or against
this application, have been heard,
NOW, THEREFORE, BE IT
RESOLVED that the appeal of Hubert M. Finnerty
as agent for Marjorie Petigor & Ors. , be and it
hereby is allowed and the decision of the Building
Inspector reversed, and he hereby is directed to
issue to the applicant a building permit to erect a
one-family house on a corner lot in a two-family
area (A-2) with a front set back of less than 30 feet,
i, e. , 20 feet on premises located at the corner of
Blossom Terrace and Merritt Street and designated
on the Tax Assessment Map as Block 403, Part of
Parcel 299, provided however that constiauction of
the house shown on the plans submitted to the Build-
ing Inspector be commenced within six months from
the date of this resolution.

On motion duly made and seconded, the following resolution was adopted:

Part of Parcel 15, be and it hereby is granted, provided
that in all other respects the applicant comply with the
Zoning Ordinance and Building Code of the Town of
Mamaroneck, and provided further that construction
of the house shown on the plans submitted to the Building
Inspector be commenced within six months from the date
of this resolution.
A vote was recorded on this resolution as follows:

Chairman Wullschleger presented the following statement:
"As you gentlemen know, the new Zoning Board and the new
Planning Board will take office on February First.
As Chairman of both Boards, I want to express my thanks and
appreciation to the members for their loyalty and cooperation. Thanks also
to Jack Delius, Town Attorney, and Tom McEvoy, Town Building Inspector.
I take this occasion to wish the new Planning Board the very
best of luck. I know that the members of the new Boards are both aggressive
and efficient, and I am certain that under the leadership of Morgan J. Burke,
Jr. , on the Planning Board they will do a good Job.
When the Planning Board was appointed a year ago, we started
from scratch and we had little or no financial assistance from the Town Council.

We have managed to thrive under the expert guidance of Colonel (William J. )
Shea who had twenty-five years experience on the Planning Board of the
City of New York. With his valuable assistance we have put in operation a
plan which will be of great benefit to the community.
So , good luck to all you gentlemen. I have had the honor
of being reappointed as Chairman of the Zoning Board, and I will do my
very best to fill this office as efficiently as I am able. I feel certain that
the new members of the Zoning Board will serve with loyalty and zeal, and
I am confident we will continue the excellent work which this Board is
accomplishing for the Township of Mamaroneck. "
There being no further business to come before the meeting, it adjourned
at 8:50 p. m.
