TOWN OF MAMARONECK, HELD FEBRUARY 25, 1953, AT THE MAMARONECK TOWN
POLICE STATION, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK.
Mr. Wullschleger called the meeting to order at 8 P . M.
PRESENT: Mr. Wullschleger, Chairman
Mr. Maggini
Mr. Burke
Mr. Rigano
Also present, but not voting, Mr. C . Benjamin Brush, Jr.
ABSENT: None
Presence was also noted of Mr. Delius, Town Attorney, Mr. Kane from
the office of the Building Inspector, and Mrs. Barnes, Clerk to the
Board.
Upon motion duly made and seconded, the minutes of January 28, 1953,
were approved as presented.
The first application before the Board was that of James M. Booth, for
modification of Article II, Section 7 of the Zoning Ordinance, to per-
mit the erection of a detached garage within 75 feet of the front
street line, to wit, 57 feet, on premises located at 81 Murray
Avenue, known as Block 127 Parcel 284, on the Assessment Map of the
Town of Mamaroneck.
Mr. Booth appeareu' in his own behalf and a plot plan and blue print
were submitted to the Board.
Mr. Booth explained that his house, which he recently purchased, is
a very old one and the lot has a depth of only 79 feet.
There was no opposition to this application.
The next application before the Board was that of Ruth Becroft for
modification of Article III, Section 9 of the Zoning Ordinance, to per-
mit the erection of a dwelling on a corner lot at the corner of
Lafayette Road and Chatsworth Avenue, said dwelling to have a side
set-back from Lafayette Road of less than 30 feet, to wit, 19 feet
8 inches, premises known on the Tax Assessment Map of the Town of
Ma_:iaroneck as Block 133 Parcels 95 and 97.
There was no one present to represent tnis applicant and the plans
which had been presented were stated by the Secretary to be not
acceptable to the Building Inspector.
There were a number of people present and Mrs. Louis Bernstein,
1 Huguenot Drive, who acted as spokesman, stated that the neighbors
did not wish to register opposition to a house on the subject property,
unless it was, in their opinion, "a dog house or a chicken coop" .

After discussion, the Clerk was instructed to write the following
letter to Mrs . Ruth Becroft:

Dear Madam:
On February 18th, I notified you that the regular meeting of
the Board of Appeals would be held on Wednesday, February 25,
1953, at 8 P. M . , at which time your application, pending
before the Board, would be considered, and inasmuch as there
was no one present at that meeting to represent the applicant,
and the Building Inspector did not accept your plans, the
Chairman of the Board of Appeals has instructed me to notify
you that you must make a new application if you wish to
appear before this Board at its next meeting.
As you know, appeal notices and applications must be filed
not later than 12 o' clock noon on or before the second Wesnes-
day of the calendar month in order to come before the stated
meeting of the Zoning Board of Appeals for that month.

The Board considered the application of James M. Booth and on motion
duly made and seconded, the following resolution was adopted:
WHEREAS, James M. Booth has appealed to this Board for modifica-
tion of Article II, Section 7 of the Zoning Ordinance, to permit the
erection of a detached garage within 75 feet of the front street line,
to wit, 57 feet, on premises located at 81 Murray Avenue, known as
Block 127 Parcel 284 on the Assessment Map of the Town of Mamaroneck;
and

WHEREAS, this application has come on duly to be heard before
this Board at its regular meeting, held February 25, 1953; and
WHEREAS, it appears that it would be an unnecessary hardship to
require the applicant to comply with the strict provisions of the
Ordinance,
NOW, THEREFORE, BE IT
RESOLVED that the appeal of James M. Booth, be and the
same hereby is allowed and the decision of the Building
Inspector reversed to the extent of permitting the erec-
tion of a detached garage within 75 feet of the front
street line, to wit, 57 feet, on premises located at
81 Murray Avenue, known as Block 127 Parcel 284 on the
Assessment Map of the Town of Mamaroneck, in accordance
with plans and specifications filed in connection with
this application, provided, however, that in all other
respects, applicant comply with the provisions of the
Zoning Ordinance and Building Code of the Town of
Mamaroneck.
A vote taken on this resolution resulted as follows:

Mr. Rigano
NOES: None
There being no further business to come before the meeting, it ad-
journed at 8: 45 P. M.
