MINUTES OF A REGULAR MEETING OF THE ZONING BOARD OF
APPEALS OF THE TOWN OF MAMARONECK, HELD AUGUST 27,
1958, IN THE COURT ROOM OF THE MAMARONECK POLICE
DEPARTMENT, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK.
CALL TO ORDER
In the absence of the Chairman, Mr. Wullschleger, the
meeting was called to order by Mr. Schuler, Acting Chairman.

ABSENT: Mr. Arthur Wullschleger
ALSO PRESENT; Mr. Maurice Friedlander, Building Inspector and
Town Engineer
APPROVAL OF MINUTES
The minutes of the meeting of June 25, 1958, and the special
meeting of August 6, 1958, were approved as presented and the
minutes of the meeting of July 23, 1958, were deferred until the next
regular meeting of the Board.
HEARINGS
The secretary presented the affidavit of publication of notice of
hearing as published in the official newspaper of the Town of Mamaroneck,
the Daily Times, on August 20, 1958, and after the Chairman declared
the hearing open and in accordance with his request, read the first
application as follows:
APPLICATION #1--ALFRED WILLIS, AGENT
Application of Alfred Willis, agent, for modification of Article II

Sections 3 and 4 of the Zoning Ordinance of the Town of
Mamaroneck, as amended, so as to allow the erection of a
building to be used for automotive parts distributors, accessories
and equipment, on premises located at 30 Boston Post Road and
known on the Tax Assessment Map of the Town of Mamaroneck
as Block 411, Parcel 224, the rear line of the building to be
113 feet from the Boston Post Road and the rest of the plot to
be used for the parking of cars, on the ground that this would
provide more off street parking and eliminate a traffic hazard.
The Chairman asked if anyone present wished to speak either
in favor of or in opposition to this application and the following persons
addressed the Board:
For Application Mr. Alfred Willis, 132 Larchmont Avenue

Mr. Willis, appeared and filed a revised plan, Plan #456, dated
August 27, 1958, showing a 40 foot set-back from the Boston Post Road,
and said that this space would be used for off-street parking.
Mr. Bierman asked Mr. Willis if their would be any automotive
repair work done on these premises and Mr. Willis stated that there
would be no work of this kind done at any time. That the request to
have the building set-back was to eliminate a traffic hazard which would
be created if people had to park on the Post Road.
After some discussion, and upon the Chairman ascertaining that
no one wished to speak in opposition to this application, upon motion by
Mr. Parsons, seconded by Mr. Bierman the following resolution was
unanimously adopted:
WHEREAS, Alfred Willis, agent, has filed an appeal for modifi-
cation of Article II, Sections 3 and 4 of the Zoning Ordinance of
the Town of Mamaroneck, as amended, so as to allow the erection
of a building to be used for automotive parts distributors, accessor-
ies and equipment, on premises located at 30 Boston Post Road and
known as Block 411, Parcel 224, on the Tax Assessment Map of
the Town of Mamaroneck, the rear line of the building to be 113
feet from the Boston Post Road and the rest of the plot to be used
for the parking of cars, on the ground that this would provide more
off street parking and eliminate a traffic hazard; and

WHEREAS, this Board has viewed the property and has examined
the plans and other matters submitted by the applicant and has
heard all persons appearing either in favor of or opposed to this
appeal:
NOW, THEREFORE, BE IT
RESOLVED that the appeal of Alfred Willis, agent, for modifi-
cation of Article II, Sections 3 and 4 of the Zoning Ordinance of
the Town of Mamaroneck, as amended, so as to allow the erection
of a building to be used for automotive parts distributors, accessor-
ies and equipment, on premises located at 30 Boston Post and
know on the Tax Assessment Map of the Town of Mamaroneck as
Block 411 , Parcel 224, the rear line of the building to be 113
feet from the Boston Post Road and the rest of the plot to be
used for parking of cars, on the ground that this would provide
more off street parking and eliminate a traffic hazard, be granted
on the ground that it eliminates a traffic hazard which would
otherwise exist; and it is
FURTHER RESOLVED that Article II, Sections 3 and 4 of the
Zoning Ordinance of the Town of Mamaroneck, as amended,
relating to the rear line of buildings in business property, on
premises located at 30 Boston Post Road and known on the Tax
Assessment Map of the Town of Mamaroneck as Block 411,
Parcel 224, be varied and modified so as to allow the erection
of a building having a rear line 113 feet from the Boston Post
Road, provided that the applicant complies in all other respects
with the Zoning Ordinance and Building Code of the Town of
Mamaroneck;and it is
FURTHER RESOLVED that this variance is granted solely pn
condition that the following requirements be strictly adhered to:
1. Mr. Friedlander is to be consulted as to flow of
traffic, so that the vision of drivers shall not be
impaired.
FURTHER RESOLVED that this decision be filed with the Town
Clerk as provided by Section 267 of the Town Law.
APPLICATION #k2--H. Ruegger
At the request of the Chairman the secretary presented the second

application as follows:
Application of H. Ruegger, for modification of Article III, Section
9, of the Zoning Ordinance of the Town of Mamaroneck, as
amended, so as to permit the erection of a one family dwelling
on Larch Road and Ormand Place, and known as Block 203, Part
of Parcel 813 on the Tax Assessments Map of the Town of
Mamaroneck, having a set back of 35 feet from Ormand Place
and 38 feet feet from Winged Foot Drive, on the ground that
Article III, Section 9 of the Zoning Ordinance of the Town of
Mamaroneck requires that no part of any building shall be built
within 40 feet of any street line except that on corner lots such
building may be set back a less distance from the side street
with the approval of the Board of Appeals.
The Chairman asked if anyone present wished to speak either
in favor of or in opposition to this application.
Mr. Lee Gagliardi, attorney for Mr. Ruegger, asked if he
might withdraw the application at this time.
The Board acceded to this request.
Mr. Jerome Wanshel, attorney for Mr. & Mrs. Harold Schapiro,
asked that a letter sent by Mrs. Schapiro in opposition to this variance
be withdrawn. He stated that Mrs. Schapiro was not fully aware of
the entire situation when the letter was written.
The Board also granted Mr. Wanshel's request.
ADJOURNMENT
There being no further business to come before this meeting it
was adjourned . The next meeting of the Zoning Board will be on
Wednesday October 1, 1958 due to the Jewish Holidays.
