HomeMy WebLinkAbout1952_08_27 Zoning Board of Appeals Minutes MINUTES OF A REGULAR MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK, HELD AUGUST 27th, 1952, AT THE MAMAR0NECK TOWN POLICE STATION, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. Mr. Wullschleger called the meeting to order at 8 P. M. PRESENT: Mr. Wullschleger, Chairman Mr. Burke Mr. Maggini Mr. Rigano ABSENT: Mr. Brush Presence was also noted of Mr. McEvoy, Building Inspector, and Mrs. Barnes, Recording Secretary and Clerk to the Board. On motion duly made and seconded, the minutes of the previous meeting, held June 25th, 1952, were approved as presented. The application before the Board was that of Hubbell Construction Co. , Inc. for modification of Article III, Section 8 of the Zoning Ordinance, to permit the erection of a one-family dwelling within 30 feet of Weaver Street, to wit, 21 feet and within 30 feet of Murray Avenue, to wit, 25 feet, on premises located at the junction of Murray Avenue and Weaver Street and known on the Tax Assessment Map of the Town of Mamaroneck as Block 107, Part of Parcel 602. No one appeared in behalf of the application. The Clerk announced that the application had been duly advertised. The following people appeared and registered their opposition to the application: Dr. George T. Rapp, representing Mrs. Constance Rapp, 482 Weaver Street. Dr. Rapp feels the Zoning Ordinance should be upheld to protect surround- ing owners. Mr. B. S. Goldman, 5 Rockland Avenue. Feels the restrictions should not be let down. Feels no variance is necessary. Mr. Roy A. Davis, 462 Weaver Street, objects to any variance. Sees no reason why the applicant should not conform with the Ordinance. Upon inquiry, Mr. McEvoy reported that the applicant has owned the subject property approximately 3 or 4 months. Mr. Edward Hubbard, 431 Weaver Street, objects to the application because he feels the laws were made to protect the neighborhood and both Murray Avenue and Weaver Street are "front and back door to Larchmont and people seeing houses crowded there will get the wrong impression of the neighborhood" . -95- Mr. Michael Gubar, 427 Weaver Street, said he had purchased his home with the knowledge of the restrictions and he would like to see them enforced. Mr. John E. Williamson, 454 Weaver Street, objects because he feels a new house should conform with the zoning restrictions. Mr. Vincent Caricati, 429 Weaver Street, objects because he feels that when the applicant purchased the property he knew about the restrictions and "probably wants to build more than one house" . Mr. James P. Wall, 430 Weaver Street, objects because he feels it may establish a precedent. Mr. Burke assured him this would not be so. Mr. Milton Friedman, 288 Murray Avenue, is opposed to any variance unless hardship to the applicant can be shown. In this case, he does not be- lieve there is justifiable hardship to warrant granting the application. Mr. Edward Holt owns the 2 lots next to the subject property and did not want to make any statement as he is being represented by Mr. Brewer, an attorney. Mr. Robert Garlock, 6 East Drive, wanted to know what percentage of the property owners affected by the application, were present at the meet- ing. He said he had just returned home that day and had had no time to look into the application. He said he would like to suggest that the matter be adjourned for a short time. Mrs . Henel Doyne, 468 Weaver Street, objects to the granting of a variance because she feels it would obstruct the view of her driveway, and wo4d be dangerous. There being no one else who wished to be heard, the public meeting was adjourned and the Board went into executive session. After discussion, on motion duly made and seconded, it was RESOLVED that the appeal of Hubbell Construction Co. , Inc. for modification of Article III, Section 8 of the Zoning Ordinance to permit the erection of a one-family dwelling within 30 feet of Weaver Street, to wit, 21 feet and within 30 feet of Murray Avenue, to wit, 25 feet, on premises located at the junction of Weaver Street and Murray Avenue and known on the Tax Assessment Map of the Town of Mamaroneck as Block 107, Part of Parcel 602, be and the same hereby is denied on the ground that the applicant has failed to show unnecessary hardship or practical diffi- culty in abiding by the provisions of the Ordinance. -96- A vote taken on the foregoing resolution resulted as follows: AYES: Mr. Wullschleger Mr. Maggini Mr. Burke Mr. Rigano NOES: None There being no further business to come before the meeting, it adjourned at 9: 50 P.
